The defendant rear-ended the plaintiff on a highway, and the defendant agreed to fix the damages. The plaintiff, an Uber driver, lost several days of work while the car was in the shop, so he’s suing for lost wages. The defendant argues he agreed to pay for a certain number of days of lost wages, but now he thinks he’s being ripped off.

People can pretend to be all nice until they have to actually fork out the $$$. Congrats to the plaintiffs.
Absolutely true….
nowadays an uber driver would only be suing for about 80 bucks per day because thats all they make after expenses .
The sweetest and nicest couple too.
The defendant…..”I was actually driving.” Ummm, yes, we realize this, sir.🙄🤦🏽♀️
I noticed that too. I think he started his testimony too early. He should have started after that given the obvious. Lol
Totally thought the same thing 😂
I hope the defendant wasn’t lying about his mom passing away cause that would just be sad smh …and I would never understand how people get mad at a person asking for money that is OWED to them smh
Disgusting attitude for someone who rear-ended them!
Would've been cheaper to pay for a rental for him than loss wages.
You can’t drive for Uber or Lyft with a rental.
@@mikesteele05 yes you can, just have to be with certain companies or a contractor in other situations.
Yes, that is what WOULD have been fair...the defendent should have offered him the use of another vehicle, not a paid vacation
@@mikesteele05 there are companies that lease to Uber and Lyft drivers. The guy should have contacted a company that does that until his car was fixed instead of waiting around and asking the guy for money
Smart to tick off & disrespect the judge 😒
😂😂
Wow for the defendant nothing but excuses at the end when he realized that he was in the wrong and was losing
I would never deal with the person who caused the accident so they can save a little money. I will not use their body shop or work out a deal. This is why I paid all that money for insurance. Plus, it will keep them from changing the agreement and complaining about the total price.
I hope so too. But he sounds like the guy that in every new job and interaction he has both parents, all four grandparent, and step relatives that all reset
$240 A day. I need to quit my job.
But don’t you get employee discounts for food at McD’s?
They are making 20 dollars an hour. No shame for hard work. @@christopherbako
He was 100% lying bout making that a day, anyone who drives Uber and Lyft knows. 😂
It would have been cheaper for the defendant to rent a car for the plaintiff.
@@dacyberman0929he proved his wages with his Uber and lyft statements. Depending on the area, you most definitely can make $240 daily.
Using the “dead relative” excuse!🤷♀️
If they didn't have the money to pay for his time lost then he should have let insurance handle the whole thing where HE takes the hit. Not the person who was hit.
He hoped they would just go away after the excuses
Defendant is a pail of red herrings.
How bad do your brakes hafta be to slide 3 car lengths into the person in front of you. I think someone is fibbing. 😆
And doesn’t the antilock mostly take care of that?
Prolly panicked & hit the gas pedal instead. 😂
@@markgalgano8649 Or he was speeding and just didn't want to admit it.
Hafta😂
3 car lengths does not give you enough room to stop at higher speeds.
NEVER "BARTER". JUST PAY UP.
My pregnant wife and I were on vacation driving a nice rental in Cali and a guy hit us from the rear. He had 2 women with him who obviously distracted him. He wanted to leave bc he saw no marks. I didn't want to take a chance as it was an expensive car. We sat there for an hour and he was the one getting angry. I told him straight up, I am on vacation and I don't want to have to waste my time waiting for the cops either. He caused it, not me. The rental car company did end up going after him. It's crazy that people have no shame or humility when they are in the wrong. I am all about spreading kindness but this also doesnt mean u have to get stepped on or be naive. Don't ever give a step to people when it has to do with money. Be up front unless u are okay with losing money.
Defendant is trash.
Defendant never wanted to pay to begin with. He thought he would just get away with it with these nice people but nope! What a loser!
1:07 to get past Harvey's ridiculousness.
😅😂🤣
Mr tmz is SO annoying. He makes me cringe. I always fast forward thru his nonsense.
2:20 He already lost the case with this statement. If he had a spacing of three car lengths then that's tell me you were speeding. That's more than enough time to stop if the car in front of you breaks. Plus from that impact, he never breaks.
He never had a defense, he always admitted his fault and his debt. He just can’t pay. JMM jazzes it up for TV a little bit this is just really creating a judgment that sets the terms of the debt in stone and allows plaintiff other avenues to collect.
It doesn't matter he never said that he was right he agreed that he was at fault all he was trying to tell the judge was I had to finish the job so I can get the 14,000 Plus for the job he was doing for the Collision place to pay his wages
He was texting maybe? Theres not much excuse no matter what.
3 car lengths does not give you enough room to stop at higher speeds.
NO WAY is he making $240/day with Uber. The drivers are always complaining that Uber is ripping them off and they barely make minimum wage.
People like him are the reason why it’s hard to take people at their word.
Him saying that the car's not even his is irrelevant. He still had to pay someone and he agreed to do that. Can't believe that he said, "You don't want to push me away." Plaintiff was so sweet w his texts, possibly intentionally to try to avoid what ultimately happened. But, I still saw no reason for the Def to get nasty w them. Seems like he was literally describing what ppl do when they owe money and don't want to pay it back: pretend to be offended and try to cut off communication.

Judge should have asked to see the obituary of the defendant’s mom. I’m not convinced she passed away
Me either.
I'm not convinced he ever _had_ a mother, at this point. I think I saw something like him crawl out of a pond somewhere.
Maybe his mother passed in the past some time
I’m sure his mom passed, just before this happened. Probably years ago.. smh
No she did pass during this time smh
And this is why you don’t try to help people who are in the wrong in the first place.
Unfortunately that's the way alot of people think now that why should they have to pay for damages they caused if the other party doesn't own the car so why should I pay. Stupid minded reality.
How did he know about it was Ubers vehicle
Someone was tailgaiting....one thing i noticed theres always some sad stories inside, but who knows if its true or not just to get the judges side...hope he wasnt lying about his mom passing tho...
Obviously the defendant didn't have extra cash lying around. It's why he made a deal with his client to fix the plaintiff's car and deduct the repair cost from his wages that would be paid to him when he finished the electrical work. Also obviously the repair was good quality, so it was a great deal for all parties involved. The defendant planned to pay the plaintiff's lost wages when he finished the electrical work and received payment for it, but he was really bad at explaining that. The problem was that the plaintiff couldn't wait for the defendant to finish his job, and who could blame him? He needed that money to pay his bills, and none of this was his fault. I was feeling sorry for both of them until the defendant got nasty.
People like the defendant are why you ALWAYS call the police and ALWAYS deal with insurance when you are hit. People will lie through their teeth to get out of paying you for the damages.
She likes to argue with ppl lol 😂
I don't even believe the defendant's mom passing away, he's just trying to make excuses.
She did. This is my FIL and she passed so no he didn’t lie
this is why i will always go through insurance... i dont care how small the damage is to my car
I wouldn't have agreed to pay $180/day lost wages. He's an Uber driver...all he needs is $60/day for a rental car and the problem is solved. But I also would've filed through my insurance if I didn't have the money instead of playing games.
Defendant played games because he didn't have insurance
@missa1goins Yeah, maybe I shouldn't have assumed he was telling the truth on that part.
It sucks that he rear ended them, but why didn't they mitigate their damages by renting a car, just like the judge has said before.
6:40 It IS TRUE. Because instead of the body shop paying HIM they just took it off his bill. So he DID paid. It's very simple judge!!!! The money never reached his wallet. It stayed with the body shop. Either way he didn't get the money which would have meant he was short. He should have given him SOMETHING. At least a few day's worth of salary.
Dumb deal by the defendant. He should’ve agreed to pay for a rental car @ $50 to $70 per day. Instead he agreed to fund a paid vacation.
“Well I was actually driving” 😂😂😂 really
They agreed for 180 a day. That is what should have been the judgement
Defendant might as well have just confessed that he didn't have any intentions on paying him. Especially when he's trying to differentiate between the Plaintiff driving a Uber rental as a reason.🙄
The defendant is a dirtbag, plain and simple.
I wouldn’t be paying lost wages WTH! Turn it into insurance
We all know his mom didn't die. Okay Johnny Fairplay
Never trust a stranger.. Especially if its about money.
It seems to me that EVERY business in America doesn't make money, as people always say 'I own this business but I don't have any spare cash to pay off what I owe', then either they aren't running their business properly or they are lying on their taxes, because a business is supposed to make a profit and put extra money in the bank...
What an asshole taking his car to another mechanic and then had the nerve to bring it back to the defendants mechanic, Thank god he told the judge!!
I like your sense of humor 😂
Ayo! The title
Yeah, he really **rear-ended** that guy.
Don’t sleep at the wheel …..don’t tale gate… keep your distance fooooooo
The defendant is a real life chump
They should have just gone through insurance. And provided a rental
The defendant doesn't make sense, had it gone through his insurance, he wouldn't be out $5000 and would only have owed the lost wages, but doing it his way, he is out big time, I bet he didn't have any insurance...
It's a rough to go through life both stupid and entitled..
Does he really think he can give the judge attitude !!! What a loser !!! and liar !!!
I’ve never had an insurance company pay my lost wages
Damn I need to do Uber…all I see are ppl bitching about not getting enough tips and they makin 200$ a day????
Defendant must be one of those people who have an excuse for everything.
He should of sold that gold chain he is wearing to pay the wages.
This defendant is very wrong and should have paid since he agreed to. The plaintiff blowing up the defendant because his rent and bills are due sucks. I have lived paycheck to paycheck that is my fault. Ten days is not that long..the defendant should have made a contract that stated the parameters such as $100 a week for whatever amount of weeks etc.
Ahahahaha Rear ending a guy 😅 nice 👬
Why does the judge ask stupid questions like, “why didn’t you pay?” After the person says, “I didn’t have the money.” If someone doesn’t have money, like Harvey said you can’t squeeze blood from a turnip. I feel like the plaintiff had a reason for not wanting to go through the insurance themselves, I mean that’s unusual and it doesn’t make sense.
Right about the plaintiffs, because why wouldn't you after the first excuse? Did the plaintiff mention attempting to contact the insurance?
Who makes these titles tho. They need to be investigated 🔎
...well, anyways, Good Bye...🤣
He paid for the damages and that should have been done. He should have never said he would pay wages.
This was a five-min case.
So is it $180 or $400 per day?
Whoever owns the car should sue the defendant for the depreciated value of the car from the accident.
Technically he did pay the 5,000 by working in trade to cover the cost
Omg pay the man your wrong
What’s the difference in taxi and Ubering ?
With taxis you have to lease the car for a set time period. Uber drivers use their own vehicles. Cab companies provide maintenance, insurance, etc.
@@mikeyh0 Also with Uber you work on your own schedule and in the area you want. I also think if you're on vacation and want to pick up some hours you can work in that area as well.
@@michellehawkins1027 I considered driving for them after 16 years of driving a taxi. I retired instead. Las Vegas in the 80's behind the wheel of a cab was exhilarating.
Tf does the judge want him to do ? Shit money ?
Lady plaintiff is a cutie pie 😊
this was the worst coddling i've ever seen!!!
Wow dude just quit, instead of fighting thru it,that's a quiter
Aren't you supposed to mediate your damages. Why didn't the plaintiff get a rental car and charge the defendant with the rental instead. Judges need to understand people's situations better. If you don't have the money, you don't have it. Atleast rule on doing a payment plan.
Are you allowed to drive a rental car for Uber or Lyft?
I just looked it up. If you use a rented car for either of those you have to go through their rental agency. I couldn’t find a price for that. Other than that, even if you were able to use a regular rental the average cost a day is about $170. So the original deal sounds as if it would be cheaper.
NY tags.. what they don't tell you is sudden stops is normal. This happens often.. If you don't tailgate you get cut off and brake checked. It's a NY trait. That said, 200.00 a day, 7 days a week, is 87k a year, minus vehicle wear and tear, minus fuel costs.. You can't use a loaner for these companies and you can use a certain age vehicle, also you need to meet and maintain a certain level of cleanliness.. frankly, the old rav4 in the picture is probably close to too old anyway, should have just taken the total amount and bought a new car.. also, the defendant, should have done insurance, ny'ers are broke, no one has an extra 200.00 a day..
Being a delivery driver, cars are supposed to be kept cleaned, some are spotless I've seen some filthy cars where people delivery orders are being kept, a car had roaches another car with passengers and their cigarettes
Uninsured Underinsured
And if he is Uber X I wonder what market he is in that he makes $240 a day, unless it is busy season somewhere and constant surging- it was easy to make that10 yrs years ago but not today
i hope he's not lying about his mom
Oohh the chubby asian, the rarest of birds...❤
Doug is super shady!!!
I get the plaintiff does rideshare and was without a car after being hit. But that is one of the risks to doing rideshare full time, if something happens to your car, even if it breaks down, you're with no source of income. Some drivers have to rent vehicles from one of these companies that lease to rideshare drivers. I am a part time driver. He can't expect the guy to fork over money for lost wages right off the bat. I get that he is entitled to it but calling the guy and asking him to give him money is wierd. He should have given him a reasonable deadline to pay him or else be sued. I was hit by a drunk driver years ago, it sucked and I got screwed so bad. My attorney told me not contact the party, let insurance handle it and any money I am owed, I need to send a demand letter and give him time to pay, then if I get ignored file small claims. But the plaintiff was asking for money from the very beginning.
The defendant is an electrician and doesn't have money??? There is something wrong. All of my electrician friends are well off. They have to pay extremely high taxes, but they know how to save money for emergencies.
Heyyyy
wHAT DOES A gaY horse eat? Heyyyy
What in the hell was the defendant TRYING to say at the end!?! Something about uber isn't supposed to rent something and it wasn't dudes car 😂😂😂!! He's really just reaching for the stars still trying to justify why he shouldn't pay!! I don't know what he was saying but I know it wasn't true.
Does liability pay lost wages or do you need more insurance for that?
There is no insurance for lost wages.
@@mikeyh0yes there is
@@coooooool12342 Really? My car insurance doesn't have that feature.
Really? She is not going to force the Uber driver to show his prior earnings to show that he really averages $240 a day, and works 7 days a week nonstop?!...and what about "mitigating his damages"? Shouldn't he have gotten a rental car for those days and not used it as an excuse not to work, so that the guy was only having to pay him $50-100 a day for a rental, rather than give him a paid vacation?🤔🤔...it sounds to me like she gave the plaintiff the Bonanza that she is always accusing plaintiffs of trying to cash in on...this ruling was strictly out of emotion, rather than what is reasonable

Sorry huh what? Why are these 2 men even texting each other exactly? I rear ended a guy by accident... this is an insurance problem, not a personal issue between people? I never had to share phone numbers with the guy... just insurance info and police report kinda thing😅 am I the only one who can't relate?
He acknowledges his debt. He is honestly trying to do the right thing but their attitudes are getting in the way. Can’t act like you’re doing him a favor by paying your debt.
Uhhh except the defendant lied about paying $5,000 to get the car fixed. He didn't pay anything. He blew the couple off repeatedly. The couple didn't go to the guys insurance and took the car to the a place the guy picked, for at least some of the repair process. The defendant was out of control in front of a judge, he's likely way worse in other environments
The judge is wrong once again. The defendant did pay the $5,000 for the repair from the money he was owed. Does she think the money came out of thin air. She is clueless.
No she's not. You are clueless. He said that they were going to pay him 14,000 when the job is done so he didn't spend anything out of pocket which is what he was implying. He said he can't give them any more money because he just paid 5 g as if he took it from his pocket. All the shop did was minus it from what he would be paid in the future. He wouldn't have had that 5 g even without the accident because the work isn't done.
Defendant= thug
The plaintiff is greedy as fuck! He was very nice to fix it!! Shame on them
Say what? When you're in an accident and it's not your fault, you're entitiled to everything you're out. Have you not seen this show before?
