The defendant rear-ended the plaintiff on a highway, and the defendant agreed to fix the damages. The plaintiff, an Uber driver, lost several days of work while the car was in the shop, so he’s suing for lost wages. The defendant argues he agreed to pay for a certain number of days of lost wages, but now he thinks he’s being ripped off.

  • I would never deal with the person who caused the accident so they can save a little money. I will not use their body shop or work out a deal. This is why I paid all that money for insurance. Plus, it will keep them from changing the agreement and complaining about the total price.

  • My pregnant wife and I were on vacation driving a nice rental in Cali and a guy hit us from the rear. He had 2 women with him who obviously distracted him. He wanted to leave bc he saw no marks. I didn't want to take a chance as it was an expensive car. We sat there for an hour and he was the one getting angry. I told him straight up, I am on vacation and I don't want to have to waste my time waiting for the cops either. He caused it, not me. The rental car company did end up going after him. It's crazy that people have no shame or humility when they are in the wrong. I am all about spreading kindness but this also doesnt mean u have to get stepped on or be naive. Don't ever give a step to people when it has to do with money. Be up front unless u are okay with losing money.

  • 2:20 He already lost the case with this statement. If he had a spacing of three car lengths then that's tell me you were speeding. That's more than enough time to stop if the car in front of you breaks. Plus from that impact, he never breaks.

    • He never had a defense, he always admitted his fault and his debt. He just can’t pay. JMM jazzes it up for TV a little bit this is just really creating a judgment that sets the terms of the debt in stone and allows plaintiff other avenues to collect.

  • Him saying that the car's not even his is irrelevant. He still had to pay someone and he agreed to do that. Can't believe that he said, "You don't want to push me away." Plaintiff was so sweet w his texts, possibly intentionally to try to avoid what ultimately happened. But, I still saw no reason for the Def to get nasty w them. Seems like he was literally describing what ppl do when they owe money and don't want to pay it back: pretend to be offended and try to cut off communication.

  • Obviously the defendant didn't have extra cash lying around. It's why he made a deal with his client to fix the plaintiff's car and deduct the repair cost from his wages that would be paid to him when he finished the electrical work. Also obviously the repair was good quality, so it was a great deal for all parties involved. The defendant planned to pay the plaintiff's lost wages when he finished the electrical work and received payment for it, but he was really bad at explaining that. The problem was that the plaintiff couldn't wait for the defendant to finish his job, and who could blame him? He needed that money to pay his bills, and none of this was his fault. I was feeling sorry for both of them until the defendant got nasty.

  • I wouldn't have agreed to pay $180/day lost wages. He's an Uber driver...all he needs is $60/day for a rental car and the problem is solved. But I also would've filed through my insurance if I didn't have the money instead of playing games.

  • 6:40 It IS TRUE. Because instead of the body shop paying HIM they just took it off his bill. So he DID paid. It's very simple judge!!!! The money never reached his wallet. It stayed with the body shop. Either way he didn't get the money which would have meant he was short. He should have given him SOMETHING. At least a few day's worth of salary.

  • This defendant is very wrong and should have paid since he agreed to. The plaintiff blowing up the defendant because his rent and bills are due sucks. I have lived paycheck to paycheck that is my fault. Ten days is not that long..the defendant should have made a contract that stated the parameters such as $100 a week for whatever amount of weeks etc.

  • Why does the judge ask stupid questions like, “why didn’t you pay?” After the person says, “I didn’t have the money.” If someone doesn’t have money, like Harvey said you can’t squeeze blood from a turnip. I feel like the plaintiff had a reason for not wanting to go through the insurance themselves, I mean that’s unusual and it doesn’t make sense.

    • With taxis you have to lease the car for a set time period. Uber drivers use their own vehicles. Cab companies provide maintenance, insurance, etc.

  • Aren't you supposed to mediate your damages. Why didn't the plaintiff get a rental car and charge the defendant with the rental instead. Judges need to understand people's situations better. If you don't have the money, you don't have it. Atleast rule on doing a payment plan.

    • I just looked it up. If you use a rented car for either of those you have to go through their rental agency. I couldn’t find a price for that. Other than that, even if you were able to use a regular rental the average cost a day is about $170. So the original deal sounds as if it would be cheaper.

  • NY tags.. what they don't tell you is sudden stops is normal. This happens often.. If you don't tailgate you get cut off and brake checked. It's a NY trait. That said, 200.00 a day, 7 days a week, is 87k a year, minus vehicle wear and tear, minus fuel costs.. You can't use a loaner for these companies and you can use a certain age vehicle, also you need to meet and maintain a certain level of cleanliness.. frankly, the old rav4 in the picture is probably close to too old anyway, should have just taken the total amount and bought a new car.. also, the defendant, should have done insurance, ny'ers are broke, no one has an extra 200.00 a day..

  • I get the plaintiff does rideshare and was without a car after being hit. But that is one of the risks to doing rideshare full time, if something happens to your car, even if it breaks down, you're with no source of income. Some drivers have to rent vehicles from one of these companies that lease to rideshare drivers. I am a part time driver. He can't expect the guy to fork over money for lost wages right off the bat. I get that he is entitled to it but calling the guy and asking him to give him money is wierd. He should have given him a reasonable deadline to pay him or else be sued. I was hit by a drunk driver years ago, it sucked and I got screwed so bad. My attorney told me not contact the party, let insurance handle it and any money I am owed, I need to send a demand letter and give him time to pay, then if I get ignored file small claims. But the plaintiff was asking for money from the very beginning.

Shouldn't he have gotten a rental car for those days and not used it as an excuse not to work, so that the guy was only having to pay him $50-100 a day for a rental, rather than give him a paid vacation?🤔🤔...it sounds to me like she gave the plaintiff the Bonanza that she is always accusing plaintiffs of trying to cash in on...this ruling was strictly out of emotion, rather than what is reasonable

    • Uhhh except the defendant lied about paying $5,000 to get the car fixed. He didn't pay anything. He blew the couple off repeatedly. The couple didn't go to the guys insurance and took the car to the a place the guy picked, for at least some of the repair process. The defendant was out of control in front of a judge, he's likely way worse in other environments

    • No she's not. You are clueless. He said that they were going to pay him 14,000 when the job is done so he didn't spend anything out of pocket which is what he was implying. He said he can't give them any more money because he just paid 5 g as if he took it from his pocket. All the shop did was minus it from what he would be paid in the future. He wouldn't have had that 5 g even without the accident because the work isn't done.
