The plaintiff hired the defendant to build a deck on her house. She says she paid the deposit, but then was not able to get money to build the deck. She’s suing for her money back. The defendant argues the lumber yard charged him a restocking fee and he offered her a way to get out of her contract. He’s countersuing for lost work, lost profits, and restocking fees.
Case #24-104
I’m a bad person. I so very much enjoy when someone tries to sue someone and inadvertently ends up owing them money. Those are my favorite episodes 🤣🤣🤣
Then I guess we are all bad….hehe
Don’t feel bad, it gives me lifeeeee 😂
I’m wallowing in the dirt with you. That was well deserved. She was behaving like a child.
I'm a member...lol
Snidely Whiplash with a humpback posture rubbing his palms together and alternately twisting his moustache. 🤔🤨😏
The contractor is straight forward, honest guy...rare in their industry.
Definitely. It's like cops with the people they pull over, you get the most understanding and reasonable ones versus the most insane customers or people they pull over.
This plaintiff will go her entire life thinking she was the victim here.
Because she is foolish and feels entitled.
@@kerrylynnparsons9441 She also seems to be acting like she doesn't know English too well
Moral of the story. Don’t try to spend money you don’t have.
And don't be greedy and inconsiderate.
💯
Sorry to be blunt but the plaintiff does not seem bright enough to run a business. The IRS should be auditing her to make sure she hasn't been ripping them off for business taxes too.
My thoughts exactly
The defendent seems like a genuine guy. All of his evidence was organized, he stuck with facts of what he did/what occurred and didn't get emotional, and he even gave her a contact at the lumberyard he used to show he wasn't being shady. Wish I could hire him.
Yes he sounds like a great contractor, as opposed to many other ones. This guy was the most reasonable contractor I've ever heard of. This decision was very well deserved.
Yes, he went way over and above in trying to be as upfront and honest as possible.
He was an excellent defendant. Composed and articulate
He is wearing a cross. He is a man of God. Good man.
@@jinjinb528 what a crock. There are plenty of pedophiles that "wear a cross"
This was an outcome that was well deserved. She was foolish enough to sign a contract before having her financing lined up and approved. Foolish on her part!
💯💯💯💯💯💯
As foolish as her haircut and dye job!!!
i think the plaintiff's main mistake is that she did not realize or know that she could be counter sued . alot of people out there think that if they lose a lawsuit against somebody then they just dont get any money but they never think about the chance that they may have to pay money or pay more money if they lose .
@@marleonetti7 - Yes. I also think her main mistake was being selfish and inconsiderate. She never even thought about how it affected anybody but her.
She didn’t only inconvenience one person that’s what she’s failing to realize. I’m glad he at least got something.
I learned a long time ago that if u sue someone then they can also counter sue u and if u dont really believe u have a really good case then dont do it becuz u can end up not only losing the lawsuit itself but u can also end up owing the person money if the judge gives them a judgement against u .

Her face tells it all 🤣😂😂😂
Yes. She made multiple men be out of work for that day. She's lucky they're not suing her for their wages for that day. You don't make a contract for something, and then try to figure out if you can get the money for it. That's the most ridiculous thing I've ever heard.
Yuck. The plaintiff was so unlikeable. She was lucky the defendant was so gracious with her, most people wouldn't have been given her gross attitude
This was so satisfying. Talk about not taking onus and thinking things just revolve around you if you stomp your feet like a child.
@ThankYouForIncorrectingMe : Onus- my word of the day! This case and the expanding of my vocabulary is a great ending to a Wednesday. Ps-Your screen name is just icing in the cake! Love it!

Not going to lie i thought dv
She has some nerve taking him to court 😂😂
I could think of a dozen contractors that would have taken HER to court over this lmao, so foolish
I am sure she would be livid is someone came in and said they wanted to rent the whole salon and have 20 sets of nails done. They sign a contract and pay a deposit and then right before the big day they cancel and demand a refund. I am sure she would be fine with losing business, nail techs losing money and would happily give them a refund. By the way what legitimate business owner signs a contract BEFORE they have funding for a renovation?
You made a very good point.
bingo bango
The plaintiff runs a business and I can’t believe it still operating with her logic
It's just a nail salon
OUCH...but on a side note I'll hire that contractor he seemed to be on the ball and get things done 👍
The market must be very different where they are than where I am. No chance you get a decking contractor who is able to start a job within a couple of weeks of first contact where I am. More like 4-6 months.
@@jgodbee3090 Right? But that defendant and his crew were ready to do that job! Would be wonderful to feel like their most important customer. All I'd need to see is some examples of his work & I'd hire him.
I would have made her pay for the entire contract, as it doesn't sound like there was a cancellation fee.
You signed a contract, he and his workers were out a lot of money and you should have paid the restocking and cancellation fee. This is what happens when you don’t want to hand over a penny even though you have made a contractual agreement.
Hell, there wasn't a cancellation fee. There was no room in the contract for her to cancel. He was being nice to her and allowing her to cancel. All he expected was the restocking fee and paying for his work. And not much for that at all. I'm sure that he probably could have insisted she pay the whole amount that was in the contract.
😂😂 she deserves everything she got. ignorance is not an excuse. and at the end maybe her advise should be don't sign a contract BEFORE u get money 🤦🏻♀️ that's just common sense
She’s greedy is what it is, she should’ve taken the $700.
Amen Sister, and she called him a bad name lol.
At the end she still wouldn’t accept responsibility for her idiocy. She’ll do it again.
i think the plaintiff's main mistake is that she did not realize or know that she could be counter sued . alot of people out there think that if they lose a lawsuit against somebody then they just dont get any money but they never think about the chance that they may have to pay money or pay more money if they lose .
@@marleonetti7 That’s so true.
At first I thought she wasn't thinking. She was able to rationalize the fact that it wasn't in the contract really made me look at her different. She knew exactly what she was doing. Either way she owe the money. She doesn't have a attorney. She was bold in that text.
That's clear. If she talked to an attorney, she would have taken his first steel which was incredibly reasonable. She actually thought he shouldn't get paid for the work that he did, and his costs. She's lucky that the Lumberyard even allowed him to return most of the supplies.
The plaintiff really thought she had a case. She had two chances to get out of the contract. She could've been out for $600+, instead she had to pay more than double.
👍🏿
Yeah! She had to pay the whole $5000! She deserved that
She loses her full $3500, then ends up owing the difference of $5000. She paid more than 8x the amount this nice gentleman offered her for breaking their contract.
@@covfefeyourself7329 lol I did the same math too because I was wondering how the OP said “double” but I think she meant more than double the amount she had intended. Not than the $600
"A lumber yard that's open between a 7 o clock on a Saturday night and 9 o'clock Sunday morning"... She called a Home Depot or Lowes LMFAO.
Who told this lady to sue?! She really screwed herself. 🙄
The plaintiff is totally wrong! When you break a contract, then there is a price to pay. My main question is " Why would you enter into & sign a contract, without having the finances to do so"? Then when the defendant try to give her a break , and was only asking for the money he was out of, she was so crazy to not take it ? No , she got exactly what she deserved!
Happens every day. As they say, common sense aint so common.
Perfectly put! Btw… I love your pup! I had to click on your pic to see if it was a bear, I'm still not sure. lol Adorable nonetheless.
@@thankyouforincorrectingme Thanks for your comments, and the compliment for my dog. She was a Akita/chow mix, but I had to put her down in December. Her name was Kits.

The contractor is very honest and fair
I worked at a construction company right out of college as a production manager. The hardest part of the job was when the weather was iffy. We were located in Chicago so weather was impossible to predict. I mean some days we had all 4 seasons I kids u not. If I called the job off on account of rain, I had to live with having our crews sit at home and not make money. If we called them out and we have to stop work on account of weather, it would be a waste of time. I couldn't win. I am so happy for the defendant bc this plaintiff doesn't understand that people count of these jobs to make a living. You don't get to cancel last minute and get off Scott free. The defendant was too nice willing to let the lady off with just a restocking fee.
The intro and defendants face at the beginning was absolutely hilarious. 🤣🤣🤣 I know we had the same thought, like what, who comes up with this stuff🤣🤣🤣
Omg, this plaintiff is so freaking clueless! She's wrong, plain and simple. It's just shocking she felt so entitled. Glad the defendant won.
Hopefully, she won't go car shopping alone because those guys would leave her in debt for life. I get the feeling that her friends kept telling her that she should take him to court. People who don't use common sense generally listen to other people who don't use common sense.
That backfired badly.
Seems like a very honest and fair guy. Not many of those kind of people left in this world. That’s what she gets for being greedy!
I'll hire him
There are plenty of honest people. You are just a very negative person.
👍🏿
She signed on the dotted line, she lost the deposit 📝
What a good case ! Welcome to planet earth lady
Judge nailed this one. She seems slippery. She said she was there to educate people? No- she was there to win and get her money back. Big ego and entitled pride. SHE WAS WRONG. She plays a really good victim but she seems to be a shark. She was out to throw this guy under the bus big time but it backfired on her. I think they call this Karma. These traits are probably why her credit wasn't good enough to get that small loan.
That’s what she gets
It's hilarious and sad when clueless people wrongfully sue someone.
This is one of those "leave well enough alone" situations lolololol
"Thats why Im here" okay girl you just paid a lot of money to tell us to read what we sign lmfAOOOOOO
This lady was delusional. You cant stiff a company that you signed a contract with 3-4 days before the job is due to start and expect to get out of that without as a minimum being responsible for costs already accrued. As the judge stated he was being insanely generous to have offered her that cheap way out. I bet he updated his contract template after this palaver even though he did not strictly need to.
That’s what she’s gets!!! Wasted that man’s time then took him to court just sick!!!
Justice was served!!! Pay the man!
Ah, this classic case. That woman was clueless.
Her attorney didn’t tell her she had a good case. I don’t believe her. What a silly woman. Smh.
👍🏿
I don’t think she went to one lol
I love it when a plaintiff not only loses but then has to pay the defendant, $3520 + $1480 = $5000 A contract is binding and a deposit will be lost if you pull out, that's what a contract is and that's what a deposit is for, how on earth did she possibly think that she would win anything?...
The balls on this woman, unbelievable
It's the audacity for me. Stop living a champagne lifestyle on a beer budget. She was ALLLL the way wrong.. Dude seems like a humble honest guy.. I'm glad he won.
So.....is her nail salon still in business in outer space? Cuz her logic is waaaaay out there. 🙄
This man is very smart, he looks disarming but I knew she was losing because usually litigants come in and are sloppy, messy with their paperwork. He was so organized the judge had all the paperwork and evidence before he even came. This lady messed with the wrong one.
I am still gobsmacked by how many people show up to a court without being prepared. Even in real court I have seen this, but it usually happens infrequently because people have solicitors whose whole job is to be prepared.
I wish I could've seen a photo of the $17K deck
I work in construction and I knew the plaintiff was going to lose before the case started! The plaintiff did everything right and everything he said is exactly right!
Ppl watch the show enough to come on and settle a case, but obviously haven’t learned much from previous cases lol
She is quintessential definition of “entitled.” All the people involved were many who lost work and she didn’t give a rat’s butt.
I disagree. She's not self-absorbed or entitled. She's just ignorant and doesn't understand the effects of her actions. Totally clueless.
@@sunnyscott4876- I think she's both.
This contractor had his stuff together. 👏👏 I love that.
I’m sure that woman didn’t quite understand the lesson because of the way she presented herself and the final decision of the judge towards that case. She was clearly the victim in her mind.
She was in over her head. She breached the agreement, Pay this man his money!
No accountability at all. Blaming him for your mistake…and he was nice as hell and very decent for trying to work with her
I wonder what attorney told her she could get out of a contract, an attorney from a cereal box?
That ruling makes me soooo happy! Dumb people make me chuckle
I guarantee she uses and has used that line her whole life.."I didn't know, I wasn't told"🤷♀️🤷♀️
She admits she did not read the contract before she signed it.
Once you sign a contract that's it! You cannot change your mind and expect your money back. The plaintiff is ridiculous.
Her face this whole time is priceless.
It was so easy to verify what he was saying, and the plaintiff didn't even try. It's hard to find a good, honest contractor. Im glad he won.
The moral of this story is the age old truth - DONT SPEND MONEY YOU DONT HAVE lady!
I thought he had knocked the old lady out
😆
Me too. 💯
🤦♀️ I talk to customers like her EVERYDAY she had tunnel vision. She only cared about one thing and one thing only and that was how much SHE was out. She doesn’t care about anyone but numero uno, that’s herself. She’s an idiot for not clearly thinking this lawsuit through and deserves ever single penny she has to pay the man. 💯
One of the best cases EVER! Hahahahahaha
Her lawyer was right next to her quiet and ashamed 😂😂😂
she's got no case 🤦🏻♀️
She left there just as ignorant as she was when she arrived, I wish it had cost her more!
She’s living in a fantasy land.
Her mission is to let people know don't sign something you don't read. Her mission should have been to get financing before signing a purchase contract, or sometimes compromise with people and work things out.
Hahahaha I can see this plaintiff calling the defendant after the court & saying “okay I’ll take the offer of you keeping $200, $400 for restocking then send me the rest” like she’s just not getting it 😂
i think the plaintiff's main mistake is that she did not realize or know that she could be counter sued . alot of people out there think that if they lose a lawsuit against somebody then they just dont get any money but they never think about the chance that they may have to pay money or pay more money if they lose .
I'm own a small construction business and a lady wanted her roof done so I wrote up a contract for $8500 with $4250 upon starting.. She gave me a deposit of $1250 the day of the signing leaving a $3000 balance on a starting date the next week..I ordered the materials for a deivery the next week..I always check weather and start tearing off 2 days prior than delivery.. The morning of I go there and we get the tarps out, tear off shovels, my dump truck setup, ect. The homeowner comes pulling up @7am & says don't start that she has a problem.. Well long story short she couldn't get the $ wanted $750 of the $1250 back.. I told her no way that I'm gonna be out over $2200 so we ended up going to court she tried to sue and I countersued & won a judgement for $$4500🤷
Even if she did just postpone the job until September, the job would cost even more. Prices of material goes up all the time.
now you know lady..
Hahaha. She expected the contractor to eat her bill. She won’t make that mistake again. Hahaha 🤣
She should have told her contractor - ok I am interested. let me line up my finances and I will reach back out to you when I have everything setup. She did a BIG NONO and signed a LEGAL BNDING CONTRACT without having her ducks in a row! Kudos to HIM for having a contract!
The plaintiff is lucky Doug wasn’t outside waiting to interview her 😆😆😆😆😆
She pretends to not understand but she really does.
You ever notice the people that actually have decks never use them
🤣🤣 yep!
Really? I don't know who your friends are but we wear ours out. BBQ's, drinks, just sitting and talking and enjoying the outdoors. Were getting ready to build a new one because the old one just isn't big enough for the whole family anymore.
I love this verdict!
Once you sign that contract, you're obligated to follow through. Unless stated otherwise, but there will be consequences.
Great Video!
One of the profoundly unfair aspects of our society, as it applies to contracts and the law, in general, is that you are supposed to know absolutely everything, if/when (but especially BEFORE) something bad happens. You can't ever use "I didn't know!" as a legitimate excuse (even if it 100% truthful) because, under the eyes of the law, you are supposed to be omniscient. "Ignorance is no defense." is complete BS. No one can know everything, about everything, all the time. If you receive stolen property, for example, but didn't know it was stolen, it is still your problem and you can (and likely will) be punished...for doing absolutely nothing wrong...at least not intentionally. Law pays little to no ATTention to INtention.
She knew the contract because she signed it. There was no cancelation fee because she wasn't allowed to cancel.
After signing a contract I schedule the work and don't bid other jobs for that block of time. When customers back out my employees and I don't make any money. I try to work with people as much as possible.
X amount of time to cancel Yep many States do offer that. It's 2 days
He was such a good man about this, perfectly reasonable despite her nonsense and lack of awareness of the situation she put him and others in
A contract generally stipulates what is expected to be done, how it is to be done, when it is to be completed, and how much it costs. There doesn’t need to be a cancellation stipulation in a contract. The consensus is that the one who cancels faces the appropriate penalties as the US law deems.
True, but I bet this guy went right out and had a lawyer amend his contract to put in cancelation clauses. Its great to win, but if you have to go to court it still costs you something. Better to take any question off the table.
Was it really a finance issue or did she hear Larry, his brother Darryl and his other brother Darryl would do the job for half price. The woman just doesn't get it and she never will.
She has bad business practices. That’s why she’s a business owner that can’t get financing for a deck.
When you sign your name to a legal document, it's binding. You don't get to just change your mind later and say "Oh, I changed my mind, let's pretend like I never signed it." Plaintiff simply doesn't seem to understand that signing a contract is a COMMITMENT to follow through. If you breach the contract, you are in violation and you have to pay. Defendant offered her an absolutely amazing deal to get out of the contract, and she called him a bastard? She cost a LOT of people a LOT of money by cancelling like she did; that's money they may depend on to pay their rent and feed their families. She was completely unreasonable (plus she's an idiot; who commits to spending a bunch of money they don't have on the HOPE that they might be able to get it?) and I'm glad he won his countersuit.
I think that get it, they just be trying to see "if they can get over".😂😂
I would hire this guy…could not have been more reasonable!!! Some people never learn!!
People flake on contracts all the time, but the most shocking part here is that she thinks she can sue him for it! He offered her $653 for him to F off and rather than take that, or even just flake again and pay him nothing, she sues him! Outrageous behavior.
Especially after he gave her a good deal the first time, cuz she had no right to cancel at all, and then it doesn't look like he was going to sue her for the money he was out, so she had a chance again. Fool. She deserved everything she got.
How do you wanna enforce or use loopholes on a contract you’re in breach of? Then was nasty/ snarky about it cus she felt she was in the right. She got what she deserved. It’s not abt READING (although you always should) it’s abt being held accountable. I enjoyed this one.
The title when it first came on I’m like i know this man did not punch this lady 😂
The plaintiff is one of those people because of whom we have all these "no duh!" kind of warning labels on EVERYTHING!!!
If she is business person god help her clients
"I didn't know" isn't an excuse in an attempt to collect money. I'm so glad the defendant won. Judge MM's father was a contractor, sooooo don't think you can get away with trying to play the ignorance card and win....
JM's family are contractors. She knows what she's talking about.
Her attorney must work next to those late night lumber yards.
