As a former member of an independent Christian band, I experienced this first hand. That's why years later I went to music production school to learn how to do all of the things so that I could build a music production company and hopefully label that can stick a giant middle finger to the mainstream music industry! Courts won't care. Private company, no contract between the parties. At best he could try filing a deceptive advertising complaint with the FTC, but as he isn't actually their customer it probably won't have much weight. The most effective course of action would be a social media crusade naming and shaming the company or pressuring Billboard to cut ties with them if they don't change.

The “data collection company” doesn’t really work for Billboard (even if they are getting paid by Billboard). They are working for the record companies, distribution companies, etc. Independent artists are a threat to that business model.

Can tell you now that courts won't care. It's a private business and there was no contract between the parties, it's not the place of the government to step in on this. Best course of action is to name and shame the data collection company so the public applies pressure on them to change.

I was in the music industry for 20 years as an artist and I can tell you from experience: literally EVERYTHING in the industry benefits empty suits and talentless hacks and screws over the creative class. It's not just as bad as you've heard: it's MUCH worse.

I agree 100%. I was a security specialist for several major labels over my career they contracted a company that I had created that took SWAT team Trained officers and ex military including special forces members and integrated them into positions not only to secure individual entertainers but assets for these corporations I seen some extremely shady s*** to the point that they were my largest contract about 60% of my business and I canceled all ties and pulled out of the contract because the things that they were requesting of us and of other contractors and people that worked within their corporations was not only unethical but underhanded and just plain evil. One of these corporations was having us escort literally a ton of art and gold every month and at first it threw me off I couldn't figure out why a music industry corporation would own that much art and gold and then it dawned on me they were using us and that to hide their assets so they didn't have to go into bank accounts.

As an ecommerce guy, let me explain why logging into store backend should provide verification of Tom's numbers... Every transaction will have a transaction ID along with payment verification from the credit card processor....this cannot be faked or scammed in on the backend. I’m 7 minutes in and this is interesting, but I want to know which data collection agency you were in contact with. I report physical sales to billboard independently every album and initially I had to give them access to the website’s backend, which I did. They’ve never asked about publishing or anything of that nature. They did count the physical sales though, which were in the thousands. I’m sure I can help.

At best he could try filing a deceptive advertising complaint with the FTC, but as he isn't actually their customer it probably won't have much weight. The “data collection company” doesn’t really work for Billboard (even if they are getting paid by Billboard). They are working for the record companies, distribution companies, etc. Independent artists are a threat to that business model.

As a International DJ or 30 years, I have watched ghost writers leak information on artists making the charts and never made a track ever! It's all pay for play. I stepped back from the music industry after being canceled in 2018. Fck it! The industry is disgusting, shady, and abusive! Good on you for exposing just one of the dark sides of the industry.

I was in the music industry for 20 years as an artist and I can tell you from experience: literally EVERYTHING in the industry benefits empty suits and talentless hacks and screws over the creative class. It's not just as bad as you've heard: it's MUCH worse.

I was a security specialist for several major labels over my career they contracted a company that I had created that took SWAT team Trained officers and ex military including special forces members and integrated them into positions not only to secure individual entertainers but assets for these corporations I seen some extremely shady s*** to the point that they were my largest contract about 60% of my business and I canceled all ties and pulled out of the contract because the things that they were requesting of us and of other contractors and people that worked within their corporations was not only unethical but underhanded and just plain evil. One of these corporations was having us escort literally a ton of art and gold every month and at first it threw me off I couldn't figure out why a music industry corporation would own that much art and gold and then it dawned on me they were using us and that to hide their assets so they didn't have to go into bank accounts.
Oh, amen to the last part. The shit is beyond wicked.

I don't think it was validation at all. It was to get their message out to the entire world. By putting your name on the chart, you're getting people to look you up and see your message. The validation comes as a cherry on top.

As an ecommerce guy, let me explain why logging into store backend should provide verification of Tom's numbers... Every transaction will have a transaction ID along with payment verification from the credit card processor....this cannot be faked or scammed in on the backend. Billboard clearly does not want to accept information Tom & crew.

I’m 7 minutes in and this is interesting, but I want to know which data collection agency you were in contact with. I report physical sales to billboard independently every album and initially I had to give them access to the website’s backend, which I did. They’ve never asked about publishing or anything of that nature. They did count the physical sales though, which were in the thousands. I’m sure I can help.

I sold 54,000 albums mixed physical and digital, via distrokid and my own hand to hand sales, which would have put me in the top 100 for indie artists and they gave me the run around over and over til the year was over then told me im not eligible for the 2021 charts... they dont want us to shine
