    • That's literally the only way this will ever benefit Zack. Casetify has already made $$ on the cases and it's not like they're going to issue refunds so buyers can instead purchase legitimate designs. Casetify capitalized, and the only recuperation likely is if consumers do exactly what what done here and buy another case from Zack/Debrand

    • This video kind of feels strange because normally Ludwig conglomerates a bunch of information and presents it cleanly in one place which is nice. But in this video he's just re-telling Zach's entire KZhead video but worse (as all second hand story telling usually is). Like Zach perfectly explains the situation first hand in his video, this is a second hand retelling that doesn't need to exist, just send us to the original video. I don't think he really added anything that Zach's video didn't address already...

I think we doomed ourselves to this shit when people kept supporting massive companies like Shein were pretty openly stealing smaller clothing lines' designs and selling it for dirt cheap. These companies will steal anything and everything. Only reason Castify got caught was because Jerry was smart enough put Easter eggs in the design

  • The dumbest part of this is, if instead of right-clicking and saving Zack's designs, they had done what he did and taken the original images of the phone and modified *those* instead, it would have been 100% fine because you can't copyright an idea. It would have been unethical, but it wouldn't have infringed on any copyrights. But because they took his designs and modified those, a lot of infringing elements are still there, so they're probably going to have to settle with d-brand.

  • Really hope that he sues the crap out of them and wins a huge settlement, this is blatant theft. Unfortunately, this kind of thing happens ALL THE TIME - I have had it happen to me before, where I had designs of my own stolen and then used in stores (printed on t-shirts mostly, but other products as well), and I know at least 3 other people who I'm friends with, who are also small, independent artists/product designers that have had this same thing happen to them. It's extremely, extremely common, and the worst thing is that in most cases (certainly was this way with my situation as well as my friends'), 99% of the people who have their material stolen and used by a larger company have zero recourse. Sucks to see this happen to anyone, at least Zack has a large KZhead channel and was able to get the word out.

My husband uses a wheelchair full-time and that elevator video was inspiring. I've been a fan since I saw it. I hope he gets every single penny he deserves out of those creatively bankrupt asshats.

  • I think it's as simple as, some lower level designer tasked with new ideas, stealing these images and claiming he made them. Then the company just said hell ya and produced them with out knowing that their team didn't create the original. As you said they took them down, they will probably just settle out of court and make an apology for the mistake.

  • I always wondered if big corporations ever highered a graphic artist who then just stole the art instead of creating it and the company never knowing and or if they get caught is the company at fault or the artist who stole the art in the first place. I know there are some lawsuits that say art can be used if it's changed enough to make it new art, but the percentage of change would need to be drastically more than we see in the phone cases I would think? It will be interesting to see the outcome of the lawsuit.

    • Oh the company itself for sure. They have liability here. They fucked up big time. It's not just a "well an artist gave it to us it's not our fault we didn't know!" That's the same kinda response as "oh I didn't know they used child labor to create this product I'm selling!" Which sadly, isn't a bigger issue or an actual thing that would happen, but you get my point. If it came out a brand new USA made product was produced by children in the United States, but the company sold it and pretended to know nothing about how their devs made the product, they'd be liable for the issues there. Not a perfect analogy but you get my point.

  • I can't help but feel that a random employee had a deadline, and after jerking off for a month realized they needed something for tomorrow and submitted copied and photoshopped designs with no oversight or scrutiny from management. I can't imagine that higher ups in the company would have been okay with this had they known, but of course anything like this happening is still a failure of the company as a whole.

  • I’m not someone who upgrades my phone regularly, so I went to casetify to get a sturdy case that would last, loved it until the outside part the wraps around the phone started to peel away from the backing. Okay, whatever, buy a new one. Less than a year later it’s happening again and I never even drop my phone. This is the nail in the coffin to me renouncing my love for casetify

  • Ahhhh i love how much of a rollercoaster this video was. I have an LLM in Intellectual Property Law - here’s why this is such a rollercoaster: 1. We start off the video hearing about a case design being copied. Usually, designs are protected under copyright. Cool stuff! Ironically, you don’t even technically need to register your copyright! So this was protected either way. 2. We then hear its about a skin - which is ‘clear’ and shows the inside of the phone. Now this is where things get tricky. Copyright does not protect the idea, it protects the EXPRESSION of the idea. In other words, a ‘clear’ case design would not be copyright[able] subject matter, because this is just an idea. Potentially, one could argue (depending on the judge, but likely effectively), that the copyright ownership would actually lie with the owner of the phone’s design. (Ideas are protected by patents, but this is kinda outside the scope of this video and my reply). 3. Now we get to the fun part - the Easter eggs. The Easter eggs clearly identify this as the original skin creator’s expression, and clearly identify that the copyist did in fact copy the design. These Easter eggs are like little bits of gold dust to IP lawyers, and I’m sure they’ll have a fun time dealing with this! (There is a lot more that goes into it but i omitted it for the sake of brevity, the gist of my comment is the legal background!)

  • Chinese culture (in my *_very_* limited experience) is super different from Western culture in terms of ownership and credit and stuff like that, i marked code for uni students for a few years and there was a noticeable trend of people copying code and not doing their own work, same kinda vibe here with using others work without credit... Intellectual property is a very American concept in my experience

    • Most countries have copyright laws. The concept of creators being legally protected for their work is shockingly, *not* an American only concept. That being said, the problem comes in cross country jurisdiction. A Chinese company is not necessarily liable to American copyright law and there are many cases of other countries simply ignoring these kind of lawsuits. It's not like the Chinese government will extradite the leadership of a large company in their country. However, sanctions sometimes do work and the reciprocal nature of other countries not wanting their intellectual property to be copied in the US and sold is what generally keeps the system working. This is especially the case for multi-national companies that do business in many countries. If you do business in the US you have to adhere to US law, otherwise Castify wouldn't be allowed to do business here and is the US market worth losing over a dumb decision somebody made?

    • I mean its pretty common for people in that field to copy code from somewhere (stackoverflow etc) also in workplaces. But I get what you're saying. The Chinese are notorious for yoinking Western things and slapping a "made in China" on it.

Do you think artists in other countries don't care about their copyright or bother legally fighting people who steal their work to make bootlegs? This isn't an all or none kind of thing. Yes, the US has a robust copyright, trademark, and trade secret legal framework. Other countries have similar systems to varying degrees.

  • Some companies will claim your hardwork and make it theirs like it's their property. Earlier I made a series from a popular story and a company called Mango Music claimed my hardworking stories which I started from scratch and put hours editing and writing it. And the background music I used in that was copyright free music. But they claimed and removed my whole video and KZhead just keeps rejecting it without even verifying it. So, it's all about money nowadays. You throw some money and nobody gives a shit about hardworking small creators. Big companies always does these, they steal from small people whom they know can't defend so they misuses and take advantage of that.

  • My favourite 'easter egg' in Casetify's cloned product is the dbrand logo itself. It's slightly obscured due to the terrible quality of the image after they've copied it, but it's still clearly visible.

  • We make dressing instead stuffing for the turkey...which is basically stuffing but not IN the turkey if I understand correctly. We spatchcock the turkey, so there is no place to stuff. Also stuffing makes it so it takes longer for the turkey to cook...more chances for dry turkey. And I am not a good enough cook so start with disadvantage...lol

  • I love the dbrand teardown skin I got and their customer support is amazing. My skin was off by a bit because of a sizing issue, they straight up sent me the right size and told me I could keep the one I had. I hope they win the lawsuit because they put so much passion and genuine love in their product and service.

  • I gotta say, these “Easter eggs” built into their design are an insanely smart product design for such a replicable product. Not only are they hidden in the design, they’re meant to replicate normal product details about their design while also being meaningless towards the actual product in a vacuum. It leaves no room for error. If you have these same string of characters on your product then there’s no denying you stole it from them. Bravo.

  • i can personally vouch for the dbrand stuff, i have a grip case for my s21+ and a skin for my macbook pro (just on the lid) and theyve held up great. theyve gotten a bit scratched up because of wear and tear but thats to be expected and with the grip case i can just buy a new skin, the case itself is perfectly fine. i had a casetify case before they did the big marketing spiel with basically everyone and that felt cheap for the price and looked crap after a year which dbrands stuff hasnt
