  • Thanks so much man, I really appreciate you covering this. I know some people are wondering why I'm still trying to be nice about it... The reason is that even when you've not done anything wrong, lawsuits can literally take years. Its not only a massive headache but also extremely expensive. The quotes I've got for copyright lawyers in the US are around $1000 an hour. Plus, I'm not even sure if I'd be able to continue creating content until the lawsuit was resolved. So basically if I have no other choice, then yes I will go the lawsuit route. But obviously I would strongly prefer not to. 😅 Also I appreciate Ludwig being humble but creators raising awareness of this and trying to help me might be the thing that gets KZhead to intervene or Alex Edson to back down... which would literally save my entire business and the channel I've spent 5 years building. I know Lud has spoken about similar issues in the past too, so his content is definitely way more valuable than he's giving himself credit for. Since this all happened other creators have come forward to me with other allegations against Alex Edson from back when he ran PowerTV MCN. It's made me realise how lucky I am that people are speaking out in my case, as some of those creators in the past didn't have the community to support them, and some of them got badly ripped off by him. So seriously, thank you so much to everyone for the support. It means a lot.

  • The KZhead copyright policy is completely broken. They desperately need to fix this. Anyone can claim anything, and the only recourse is “send an appeal to the person who maliciously struck your channel and plead with them to change their mind.” It’s ridiculous.

  • Why not just enact a reverse three strike rule? False copyright claim with malicious intent three times and the accuser’s channel gets deleted, not the accused. That’d fix this problem in a heartbeat.

    • @@0106johnny They could implement something that kicks in before the court stuff is even considered. To use this video's issue as an example, that may not even go to court. They're in the 10 day period where BC has to decide if they want to sue, and if they don't, the strikes are dropped. You could implement a rule that says that if you file a copyright strike, and it reaches the point where the other party says, "no, you're wrong, sue me to prove it" and then you don't... then you get dinged by KZhead for it. In other words, if you're filing a copyright strike in the first place, you damn well better already know whether or not you're willing to go to court over it, instead of dragging it out, causing people's channels to be unable to upload for at least 10 days at a time, only to let it drop at the very last step with no real consequences for yourself. I mean KZhead does say they take down accounts all the time for fraudulent takedowns, but it's never publicized and I can't find any details on any criteria they use to make those judgements. Have a very impactful punishment for filing a claim you aren't willing to actually litigate would go a long ways towards curbing that behavior. The downside I think would be that it could discourage actually legitimate claims for folks who just don't have the money to go to court, since the copyright system is a pretty straightforward one. You file the strike, and the other party either complies, tries to get you to retract it, or directly files a counter notification. If they do the latter, boom, you're already in the sue me territory. I guess that's not too big of an issue though, especially if it's a strike system that wears off over time like the actual copyright strikes do. Presumably a normal person filing legitimate grievances they otherwise aren't willing to go to court over isn't going to be doing so with the kind of frequency that a copyright troll would.

    • That's the point of having a second channel though in some regards. Getting into drama on a channel that isn't as important as the main one in case something happens is a bit of a safeguard. If Mogul Mail gets taken down, he can just make a new reactionary channel since it wouldn't affect his main source of income.

  • I genuinely love Ludwig because he acknowledges what he did instead of being defensive about it (whether it was his fault or not) for example what happened with that one creator who copyright striked him. He didn't once say anything bad about CGP Grey even though that channel almost got his channel deleted. He also said he doesn't blame him and that just tells us SOOO much about his character.

  • Best case scenario is that KZhead intervenes. But the process to get KZhead to intervene is part of the problem. If the platform wasn't so easy to abuse problems like this wouldn't be as frequent.

    • The biggest issue is that copyright battles is a legal issue and youtube has created a nonlegal way to resolve it(guilty until proven innocent). If more of these cases were taken to court it would set a precedent on how they should be handled. Unfortunately they rarely make it out of youtube. So we are left with this.

  • kinda scary how these big channels can just bully people and make them delete their channels without even doing anything, like think about it, if magnates didn't have a good social media reach on twitter and wasn't able to make a big hoopla about this situation, they would've just gotten the channel deleted and couldn't be able to do anything at all. Makes me think about how many creators are out there who had like 10k-20k subs and just got 3 strikes and since they didn't have any way to get it out to the world, just had to quit

    • That is not true, being big or small does not change when or if your channel is deleted. That is still decided by the willingness of going into a lawsuit. But yes, larger creators will have an easier time footing the bill for a lawsuit.

Also the reason I say small creators have a big disadvantage is that unlike smaller creators since magnates is quite big, he was able to create a big thing about this on twitter which will prolly lead to youtube not deleting his channel while a smaller creator could never be able to do that

    • ​@@vic_710 not really. The channel will be deleted unless Magnate media wins the court case. This has nothing to do with youtube sadly. This is a real life case, youtube just adds layers so it could be resolved before going into court. The only disadvantage smaller channels have is that they might not have enough resources/money to win the case. Smaller channels can copy strike big channels and have them delete their channel.

  • It is crazy how poorly youtube manages their copyright system. They should have a third party moderator who can watch the videos and objectively decide if they are invading the copyright. Having the people who abuse the copyright button be the ones to decide if they "made the mistake". It lends itself to getting more false accusations of copyright being thrown out there and not being done properly. With all their money that they make, it would be easy for them to pay a team to sit there and ONLY respond to copyright strikes. If the system was more fair, it probably wouldn't be misused because there would be repercussions to people's actions.

    • @piplupdabest list other sites because if I was a youtuber, I could copyright someone and if they wanted to appeal it they would go through me. If I copyright them the first time, I probably believe its true and won't take it back. KZhead has no involvement except trusting the word of the person who issues it.

    • It literally would not be legal to have youtube have a team hired to sit down and review copyright strikes because they aren't the copyright owner of the content so them deciding against one side would be grounds for being sued if they are wrong which they would be at least sometimes. It would be much more logical to rework how the strike system works on youtube but the people who have the copyright are usually bigger corporations which is not in youtube's benefit to make enemies of. Bad system and I hope youtube does a rework (and i believe they will) but I just hope it is a rework people are happy with because I have a hard time seeing that be true.

  • I feel like all I ever do is send thank-you notes to your channel. But thanks again for sticking up for the little guy. Any system that is set up can be gamed. When creating a system in which people interact, one not only has to consider the good actors, but also how the bad actors will abuse the system. The one who writes the rules needs to consider both.

  • They should have actual moderators physically check copyright claims. If the claims are frivolous and/or malicious too frequently, then that person gets striked and potentially gets demonetized and/or suspended.

  • Someone should establish a KZheadr Union or a content creator union... that just lets youtubers pay a small fee (or a fee based on size and income) to receive help, support, and maybe most important legal aid in cases like these. Obviously youtubers who maliciously try to delete channels with copyright strikes would either get their membership suspended indefinitely or just not receive legal aid via the union. Could also help in negotiations with youtube itself regarding whatever. Considering how many people make a living by being content creators, and how easily that living can be removed, it's weird that there isn't something like this already. I guess the fact that most of these people could be considered as a sort freelance/ contracted artists, it would be hard to unionize, and maybe there's a "secret" line in the content creator contracts that doesn't allow for unionizing (but I assume that's illegal, so probably not). The biggest problem may be the fact that youtubers are global, and it would be hard to create one union that can help anyone in any country, but if you started by basing it in the US, or the UK since Europe is more unionfriendly, it should be possible to grow enough to help almost anyone anywhere. The financial side would require a major youtuber, or preferably several, to invest heavily in the beginning, but once the wheels started turning, it may quickly become self-sufficient based on memberfees

    • They don't and BC has enough to bleed them dry even if they tried to fight back, the reality of the situation is BC is going to get away with it because YT doesn't seem interested et all with the situation and even if they saved MagnatesMedia (doubtful) then BC will just try again later with someone else or even push the subject even more aggressively in the future.

  • I was part of powerTV with a group of friends when those contracts were happening with Alex. I remember a call where Alex started screaming at one of the largest creators in the network at the time when we had weekly calls to just talk about how our channels were doing etc and then the panic when that creator was leaving. Things started to get really weird and my group of best friends actually all left with me. We ended up getting in contact with a man by the name David at Curse Network, union for Gamers and when he was shown some of the contracts he made some comments about them and not long after contracts that were standing and in effect for us were voided and we quickly hitched with curse, I remained with them for a few years until ultimately getting a better deal with Screenwave Media which is by far the best network i've ever been part of. I remember many promises and few kept. There was always talk of a power TV Headquarters being made and we'd all be offered our own free creator spaces to record in a professional setting when it was done but we never did see any proof of where that or where the % of our revenue actually went. It wasn't all terrible, Alex was pretty motivational with us and did push us to be the best we could with KZhead, I know there were a few channels he actually invested in to get them better equipment and help them out but some of those came with a higher split contract, Then there was the outrageous ones though that lasted far too many years.

    • But the issue is not about the photos but rather about the effects done to them, the time invested in creating the parallax effect so that it could look cool, only for a "content creator" to decide to use them because indeed they look cool. Even it they are 1-2 seconds in length it is still the work from another person. What is ludicrus is that the guys who made the effects are not the ones issuing the copyright but rather the guy who bought the rights to those videos... which is how copyright works and that despicable Edson guy is entitled to it. Unfortunately he is right. Saludos.

  • I feel like maybe the (easiest?) solution at this point is to have content takedown notices stay pretty similar but have content strikes be actively moderated and checked before approval. Preferably all the strikes, but especially the third ones, as they cause complete channel deletion. While not a perfect fix, it would still let most of the content IDing be automated and not overload human resources. This way, the channel takedown penalties with actual long-term consequences of the content ID system cannot being less abused by anyone to take down channels. Because if the purpose is purely for content, keep the immediate penalties (ad revenue, muting) and such where the money is just held as they are, but channel termination is verified due to how many people keep getting screwed by the system.

    • There is a tom Scott video that explains why KZhead can't intervene in such cases. The moment they "decide" the results of a copyright issue, they will be seen as a publisher and it will be KZhead that gets sued. If I was KZhead, i'd never deal with any of this too.
