A lot of young lawyers-to-be complimenting Mike here. As an old retired lawyer who often grimaces about some of the crap lawyers put on KZhead, I have to say Mike is one of the ones I'd refer someone to. He knows his stuff and he's careful to clearly explain himself.

To answer some questions: Police ONLY have to read you miranda rights when you are 1) In Custody AND 2) Being Questioned! So, if you're in custody and they're not questioning you, they don't have to say them. If you decide to volunteer information in that situation, then it's not a violation of Miranda. Also, custody means a reasonable person would understand they are not free to leave. So, if you're free to leave, then they don't need to read you your Miranda rights.

The best advice about citizens' arrests is just don't do it. And that failure to read Miranda rights - if they don't ask you questions, Miranda does not apply. So they arrest you, and knowing you didn't get your rights read, you go bragging to the police about what you did. That's admissible, because they didn't ask any questions.

So that last one sounds like it's difficult to actually use what you say against you in court (rights read or not), but anything you say can help them to find that other evidence that they CAN use against you in court.

2 questions: 1.A follow-up to the confidentiality: Say you were trying to understand a law and used a hypothetical talking to your lawyer, is that protected by confidentiality, or could the lawyer report them to the cops? 2. At what time, how, and to whom should you identify any disabilities that would hinder a case?
Hypotheticals are generally protected but when your lawyer stops you to say "uncool and illegal, don't do that" then you can't expect any more "hypothetical" advice.
@@jordanrodrigues1279 I can understand that. I was more aiming to understand terms like "reasonable force" to avoid anything that might be deemed excessive. Such as "if someone dug their nails in my shoulder and pulled me back, would it be reasonable if my hand were to hit her in the spin? What if my hand was closed?" (Currently listening to entitled people stories). Or, for contract law, "would replying👍mean I got the contract, or I agree with its unlawful terms?"

Most police officers seem to like to have the citizen who observed the actual crime to sign a citizen's arrest form. It protects the officer if a claim of improper detainment arises...

How many people have actually preformed a citizen’s arrest? I’ve never heard of one being preformed successfully or at all really.
I think people have restrained violent people who have assaulted or robbed them or someone else. They then keep them restrained until the police arrive. I would call that a citizen’s arrest.
I mostly hear that karens use citizens arrest but good thing you can always resist them
Ironically, in NY there is no citizen's arrest, but (at least as far as the WRITTEN law is considered) you can shoot the perpetrator of a violent crime as they run away. Might not hold up under case law, though.

it also aint that great of a thing to do you are putting yourself in harms way without the level of protection a cop has so unless you are sure you can detain the person dont do it
Another thing about citizen's arrest: How does that work with self defence? If some random guy comes at me and grabs me, I usually have every right to defend myself.

I was kicked off of a video project I was working on with someone just after I came out as trans. He cited the reason for doing so is that a trans person on the project could damage the viewer base apparently and we worked with each other virtually. So what laws would have held up at this time if any? I'm in New York and I'm not sure if he was in Washington State, Montana or Idaho at this time

I saw on TV where a current property owner(a grown man plaintiff) on a DESERT property sued the previous owner for being bitten by a rattlesnake(when he BLINDLY stuck his hand in a bush)?! Didn't he know and shouldn't he have known that there was a reasonable possibility that he might get bitten or scratched by a DESERT animal?! Snakes, Rabid animals, Scorpions, Spiders?! Why should he be able to sue and win for 6 figures?! I live in an area where 3 of those animals and more exist(not including scorpions) and I know not to stick my hand blindly into vegetation?! Even if I did, I would feel that it's my fault! Sounds frivolous and crazy!

Yes it could, the police need to have you in custody AND be questioning you. If you volunteer information like that, then they didn’t question you and didn’t need to read you your rights
Thank you for answering my question. I dated a police officer once, and he told me to just remain silent if I was arrested and call a lawyer. Another quick question, if you remain silent and don’t tell the police you’re exercising you right to remain silent, do the have to do anything to verify you’re competent or do they just assume you’re exercising your rights?

Well according to the Miranda rights, If you can’t afford a lawyer, the state will provide you with one.
Can you call a family member to get a referral to a good lawyer? I have a cousin who is a lawyer, so asking her would be okay, I imagine, but what if the family member wasn’t a lawyer, but knew some?

You also can be arrested without ever being told what for. Police dont have to say why you are under arrest, even up to the point you are walking into the court room to be sat in front of a judge.
