Kaveh Solhekol reacts after Nottingham Forest lose appeal against four-point deduction

Chief reporter Kaveh Solhekol explains the reasons why Nottingham Forest have lost their appeal against a four-point deduction for breaching the Premier League's Profit and Sustainability Rules (PSR).
The club were charged in January after breaching Profitability and Sustainability Rules (PSR) by £34.5m above their permitted threshold of £61m for the assessment period ending 2022/23.
The outcome of their appeal means Forest remain in 17th position, just three points clear of the relegation zone with two games remaining.

Scandalous that a promoted club gets deducted 4 points for breaking so called sustainability rules that would’ve forced us to sell a player 1 month earlier for less than his real worth. Sustainability? Yeah right! These are rules that protect the self interests of the current established ‘top’ clubs in the league.
What is this? Why do we have a relegation system and a spending limit at the same time? So, if you don't spend money, you get demoted, and even if you spend money, you get demoted?
It's quite simple. Stay within the limit and they cannot touch you. Other clubs managed to built teams capable of surviving in the league without overspending.

@@CollideWithTheSlope Well you see Man City's billionaire (prince of the UAE) owner created many fake businesses to give "sponsorship" money to City without technically breaching the rules since it's difficult to prove that these entities are illegitimate. Although they seem to have enough evidence, City is just throwing everything at them to a point where the ruling could take years to finish.

My team Luton Town had a 30 point deduction many years ago it almost finished my favourite club.

So just like the officiating of matches which has been woefully inconsistent the appeals panel has essentially pointed out that the process and subsequent rulings for each case will also be inconsistent. Sport is rules based both in and out of the sports arena, it is not unreasonable for sportsman/women, clubs and fans, not forgetting the associated businesses to expect/demand and need consistency. The rules around PSR and subsequent penalties are not set out, this could be argued that they weren’t well thought out, eg lack of inflation proofing along with the accounting period not aligned to the transfer window. A cynic might suggest the woollyness allows the PL and Masters to administer as they prefer. The likelihood of 115 being addressed transparently and fairly diminished on the wording released today by the PL. The wording also provides clarity that the 30th June accounting deadline will mean clubs will need to accept less than market value should PSR be tight, putting more power in the hands of wealthiest clubs who can circle like vultures. Stacking the advantages even more in the hands of the big six. This wording alone should lead all clubs to demand that the accounting period and the window be aligned. The promotion relegation merry-go-round is heavily influenced by parachute payments heaven for bid a Forest, Luton or an Ipswich gain promotion and want to be competitive. This needs to be looked at and clubs promoted not receiving parachute payments should have higher losses permissible than the straight 2-1 at the end of the first PL season, which can be tapered in the 2nd season etc. The appeal outcome doesn’t really matter but the wording has far reaching implications. The lack of transparency and consistency fuels fan accusations of corruption.

The four-point deduction sanction Forest received was fair and consistent compared to both of the points deduction sanctions Everton received. Forest's PSR breach amount was sizeable and bigger than Everton's ones*. Forest were already granted a reduction in sanction at the original hearing, of two points -- from six points reduced to four points -- for mitigating factors (early plea and cooperation). Forest's other arguments/grounds were rubbish. So no complaints from me. I say this as a Forest fan. Forest knowingly broke the PSR rules last season . PSR breaches due to overspending on players (transfer fees and wages) warrant a sporting penalty (i.e. a points deduction). Forest's transfer activity in January 2023 was all beyond the PSR constraints, and it helped up stay up last season. We therefore derived a sporting advantage by breaking the spending rules. * Everton's six-point penalty was that high due to aggravating factors.

City's charges are exaggerated. Not guilty without evidence Most of the 115 charges involved not cooperating and not providing data. To be honest, I think there are about 10 important things, and the FFP violation is not guilty, right? Most of the evidence is fabricated. The CAS award emphasized that most of the alleged breaches reported by the Adjudicatory Chamber of the CFCB were either not established or time-barred. As the charges with respect to any dishonest concealment of equity funding were clearly more significant violations than obstructing the CFCB's investigations, it was not appropriate to impose a ban on participating in UEFA's club competitions for MCFC's failure to cooperate with the CFCB's investigations alone. However, considering i) the financial resources of MCFC; ii) the importance of the cooperation of clubs in investigations conducted by the CFCB, because of its limited investigative means; and iii) MCFC's disregard of such principle and its obstruction of the investigations, the CAS Panel found that a significant fine should be imposed on MCFC and considered it appropriate to reduce UEFA's initial fine by 2/3, i.e. to the amount of EUR 10 million . City's 115 charges 54 charges on: Failure to provide accurate and up-to-date financial information from 2009/10 to and including 2017/18 . 14 charges on: Failure to provide accurate financial reports for player and manager compensation from 2009/10 to and including 2017/18. 5 charges on: Failure to comply with UEFA’s regulations, including UEFA’s Club Licensing and Financial Fair Play Regulations . 7 charges on: Breaches of Premier League profitability and sustainability regulations from 2015/16 to and including 2017/18 . 35: charges on: Failure to cooperate with Premier League investigations from December 2018 - present. in any case, most of the charges are unreasonable Man City is the world's No. 1 team, but they don't admit it, right? And football has been corrupt since ancient times. During Calciopoli, Milan and Lazio ended with a point deduction despite match-fixing (Juve was relegated). Milan won the Champions League that season (2006-2007) Also, there was controversy over FFP when PSG recruited Neymar, Mbappe, and Messi, but the French league never punished PSG. Maradona did doping. Ronaldo, Messi, and Benzema are criminals, but they are not expelled. They also receive the Ballon d'Or. Why do we criticize owners who do not invest in their teams for not spending money, and why do we criticize owners who do invest for being oil money? I think it's better to spend money than not to spend it. Don't be hypocritical. What you're doing is duplicity. Just be honest and say you don't like City because they are the number one football club in the world. Man City will likely win the League again this year

Forest were upset about this and appealed, and now we have learned that the appeal failed and the deduction stands..." Is that about it?

how did they lose the appeal, but Everton get back points and the broke PSR for 2 seasons we we only broke it for one? If we got 2 points back that would have been Burley relegated. Seems strange when there is a relegation battle happening, this stinks or corruption and getting more eyes and press on the relegation battle and less stress on the PG LOL because Burnley rightly so would have kicked off because they would have been relegated. This whole season has been a joke.
