Harvey Weinstein's 2020 Rape Conviction Overturned Citing Unfair Trial

Harvey Weinstein's 2020 rape conviction has been overturned by New York's top court on the basis that the disgraced Hollywood producer didn't get a fair trial. Allegations against Weinstein first appeared in The New York Times in October 2017, detailing decades of sexual harassment. He went on trial for rape for the first time in January 2020 and was found guilty of third-degree rape and later sentenced to 23 years in prison. He will now face a retrial for the 2020 conviction.
Sarah Ann Masse and Louisette Geiss accused Weinstein of sexual harassment & say this is a 'glitch' in the system.

  • Ppl are pi$$ed that Harvey Weinstein is getting a new trial in NY- Evidence is a course in law school. Evidence is one of the few law school classes that helps you prepare for both the bar exam and for the actual practice of law. It governs fairness in a trial. Questions for the outraged re: their thought process: Questions for the outraged re: their thought process: 1.) Do lawyers/judges take an oath to uphold the constitution? a. Is it acceptable for attorneys/judges to ignore what they swore an oath to protect? 2.) Is it okay for judges/prosecutors/courts to violate evidentiary rules to gain a conviction? a. Would you want your constitutional rights if it were you or your family? 3.) Is it possible to win a case without violating the Rules of Evidence? 4.) Do the ends justify the means in your mind?

  • 1. She meets perhaps the most powerful man in Hollywood to pitch her script (very hard to get a meeting with him; how did she?) 2. She is obviously very hopeful to get her script green lit, she lands the meeting (somehow), and the first thing she does is give this super powerful man a decree about not touching her? (wasn't she worried this might terribly offend him? Wasn't she worried that this powerful man would cancel the meeting right then and there? She was basically telling him that she heard about him and he better not try anything). 3. When he responded by laughing in her face, what did she do? Did she laugh as well, or did she have a stern face? Did she read his laugh to obviously mean that he wasn't going to follow her orders? Yet, despite his laughing response, she still went up to his hotel room? This initial, simple line of questioning would poke holes in her story in just 2 minutes. It seems like these advocates want to eliminate on defense and cross examination of complainants.
