Disgraced Hollywood mogul Harvey Weinstein's 2020 rape conviction in New York has been overturned, on the basis that he did not receive a fair trial.
The New York Court of Appeals said prosecutors in the pivotal #MeToo case called witnesses whose accusations were not part of the charges against him.
The court said that meant he was unfairly tried for past behaviour, and ordered a new trial.
Weinstein, 72, will remain in prison for a separate conviction for rape. He
denies the allegations from Ashley Judd.

Yeah, I remember from what little I know about law. You can't do what the first judge allowed. I'd be looking at that judge rather than the judges who now have to overturn it.
I mean, you get tried for what you are getting tried for. You can't then bring up other crimes to try and slander the person you have on trial. Have to ask why they allowed that?
The judge knows what he did wrong and is now paying the price for putting his thumb on the scale.
Actually, the judge who overturned the ruling was following the law. Eye witness testimony is largely unreliable because it's not evidence - so it shouldn't be presented as such. Let alone cases not related to the trial itself.

All judges have certain biases, they're human after all. They're supposed to disqualify themselves in a case where he or she is biased and to hear all cases where he or she is not biased. But obviously it doesn't happen often, and it's very hard to prove actual bias. Basically a judge must be shown to be *so* committed to a particular outcome that evidence and arguments presented will _never_ alter that outcome. It's very delicate to actually prove... Everyone in jail/prison knows which judges are fair and which one are hardcore headcases, but "everyone knows" isn't proof... Precedent rulings aren't proof either, nor is a general predisposition. It's tough.
the judge there did not do everything properly, so they have to do it again. this is only one of his many convictions.
