Summer and Kyle have joint custody. This was mentioned multiple times during the show. Tara's sentence made her suseptible to the "child abandonment" law. Because she will be away from Harrison for years, it's considered child abandonment because by committing the crimes(Violation of Federal and Local Rico statutes) , she knew it was possible she'd get jail time if caught. As Harrison's only living parent, it would have been up to Kyle to petition the court to have Tara's parental rights terminated. Tara's sentence provided grounds for this to be granted. That being said, Kyle would then have the complete authority to allow Summer to legally adopt Harrison.
