IEC vs MK Party: Court dismisses Zuma's recusal application

The Constitutional Court is hearing the IEC appeal against an Electoral Court order, allowing MK Party leader Jacob Zuma to remain on its candidates’ list. The Court has dismissed Zuma's bid for the recusal of 6 Justices.
Legal Analyst at the Institute of Election Management Services in Africa, Nkululeko Tselane weighs in.

    • @@dineshanpillay5944 Sorry, there is something very wrong here. If I were a judge on that bench, I would have wanted the earth to open up and swallow me. It was so embarrassing. This is going to cause so much damage and will have far reaching effects. If I go to court for some reason, will the judge send me to prison based on the law or exceptional circumstances? Every legal case concerning Mr Zuma is flawed, that is clear. Regardless of dogs, gupta's and all insults you may throw, it is very DANGEROUS to make exceptions to the law. The lawyer for the IEC literally said to them: "You messed up, deal with it as I am relying on your mess to win my case."

  • Not a surprise! Absolutely expected decision! There was no ground of risk of bias as it will be just a decision on technicality! What the Court MUST decision is on whether the remission by the President implies the cancellation of a Court's sentence or not, for future similar situations!

  • Political theatrics, Zuma knew that was going to be the outcome. He went ahead with application because it provides him the cover to claim victimhood which resonates with his base who see him as a saint incapable of any wrong. Constitutional court is the apex court for goodness sake and most of them are they not his appointees? What will happen to all the other cases that he has pending? He will get his own hand picked judges and when the fire gets hot claim to be his friends and then bias?

  • These judges are taking our country into anacrhy. If democracy is in the hands of few individuals called judges who are in my opinion not impartial. Ngcukaitobi is always happy when he comes in front of the constitional court because he is jpingin hi club. As a pastor when i preside in a matter which I am somehow related I always and always swallow my pride and get another pastor or individual to preside

    • Because only the Constitutional Court, Gauteng (North and South), Supreme Court are Captured. The Western Cape High Court is being captured since the removal of Judge Hlophe as evinced by the reversal of the Bongo verdict. These courts are captured by the Broederbond that also controls the ANC, DA, VF+, Media, Banks etc. The other courts are not captured....yet
