Northumbria Police has concluded that the allegations made by trans woman and broadcaster India Willoughby against author JK Rowling, accusing her of misgendering, do not reach the threshold for criminal prosecution.
The incident unfolded when Willoughby reported Rowling to the police earlier this week, asserting that the renowned Harry Potter author had referred to her as a man in a post on X/Twitter. Rowling had expressed her critique of the inclusion of trans women in women's changing rooms, referencing Willoughby in her comments.
In a controversial statement, Rowling remarked, "India didn't become a woman. India is cosplaying a misogynistic male fantasy of what a woman is."
During an interview with Byline TV, the 58-year-old Willoughby insisted that Rowling's actions constituted a criminal offense. She said that her legal status as a woman and claimed that Rowling's deliberate use of male pronouns constituted an infringement on her protected characteristic.

I hope you save the same lack of acceptance for anyone who is religious, as by definition it's even more based in delusions with no basis in biology, physics, chemistry. Truth is not only a scientific statement but one that has been philosophically debated for centuries. At least with the transgender debate we are discovering that hormones have a driver in the issue and think we will find out more with time. Religion will never have any scientific backing as like Trans it is all about deep routed feelings and beliefs. I am happy to accept both as people's truth's are accepted every day, and science cannot yet fully explain human feelings and emotions. You could counter and say 'it's dangerous', and I agree it does have potential negatives, particularly for hard won women's rights, but these can be delt with by cooperation and understanding. If you want to see real danger based in belief not science, just look at what is going on in the middle east right now. For societies to stop accepting religion would be far more beneficial to humanity that a marginal trans denial. I personally believe in live and let live however.

Because he is talking about the hate crime framework not the equality act. In the hate crime framework it is transgender identity in the equality act (civil law) it is gender reassignment. Disappointed that nobody took on the ridiculous situation where the hate crime framework allows anybody to ‘perceive’ anything to be ‘hostile’ and have the police record a NCHI against someone which is very clearly open to abuse.

Being ‘kind’ by addressing people by their preferred pronouns when that pronoun does not align with their biological sex is good if that is as far as it went. The problem is that it goes beyond just addressing them by their preferred pronouns. These people think that because they are addressed by their preferred pronouns it gives them rights to enter safe spaces or partake in sports in the gender they identify as, not as their biological sex. For that reason I will not ‘be kind’ by addressing people by their preferred pronouns until it is made clear that trans women cannot enter women’s safe spaces or trans men cannot enter men’s spaces.

For something to be a hate crime it must be a crime & aggravated by the victim or someone else’s ‘perception’ that it was motivated by hostility towards one of the protected characteristics (which are different to the EA ones). Further a ‘non-crime hate incident’ can be recorded if a person perceives someone has said or done something motivated by hostility towards a PC but the thing they said or did is not a criminal offence. This is extremely worrying because a NCHI can be disclosed to future employers where a criminal records check is required. There is no right for this to be forgotten unlike if you were convicted of a crime a while ago meaning NCHI are actually worse than actual crimes in their potential impacts. The police are not supposed to record NCHI if they aren’t likely to be useful data re potential later criminal offences but the whole thing is ridiculously vague, open to abuse and unnecessary since judges have always been able to consider aggravating factors in sentencing convicted criminals. It allows someone who has one of the hate crime PC to use the police force vexatiously in order to achieve political or other aims & is an extraordinary waste of time. Beware any reporting about U.K. ‘hate crime/incidents’ since they are entirely based on whether someone perceives hostility - something that is completely subjective & vulnerable to activism.

That barrister Paul is just plain wrong (MD of "LGBT Lawyers"...). The wording is clear "Any CRIME can be prosecuted as a hate crime if the offender has either:demonstrated hostility based on race, religion, disability, sexual orientation or transgender identity" - there needs to be a CRIME first - something that is criminally illigal in its own right. Can hostility be a crime in its own right? - Yes but people are hostile online all day, every day. So the bar for criminal hostility cannot just be "I was upset by it". Otherwise there would be literally millions of prosecutions a week. We simply don't need these laws. We're not undergoing some new worsening of crimes motivated by hatred of these protected classes. If anything, society is more tolerant than it has ever been. If we didn't need these laws 50 years ago, we sure don't need them now. And the fact that people are trying to abuse them to shut others up is a strong sign we need to get rid of them. As for "non crime hate incidents" - the police should not be making records of citizens who have specifically NOT committed crimes, by the police's own standards. List-keeping is the sort of thing totalitarian states do to put fear into the populace.

I take hormone treatment every day because of cancer. It’s insane to me we just fuck with kids hormones and even with adults it’s a huge thing imo. My own doctor told me we don’t fully understand how hormones affect the body. When my levels dropped I had a complete breakdown and nearly attempted suicide. I wasn’t myself at all. It totally fucked my head.

India & apparently the police were considering malicious communications - another terrible law. Apparently it ‘did not meet the threshold’ which is what they were discussing above. If they had considered it to ‘meet the threshold’ then it would have been a hate crime since all that is required is that the ‘victim’ or another considers it motivated by hostility against a hate crime PC. Another ridiculous situation/corruption of justice. JKR should do a SAR to see if the police have recorded a NCHI against her despite them not considering her to have committed a crime.

@@mariannehavisham8323 I doubt he is a legal "expert" in gender ideology. I doubt any lawyer is. He may well deal with divorces & wills & only be an expert in that. Just because you are a lawyer doesn't make you an expert in all things legal. In a court room it would be better to have medical, biologists, physiologists as the "experts" of what a man is & what a woman is. The lawyer & Christo both are going with their "feelings" Law is about facts.
