Judge should see what plea he submitted and accordingly answer to that question..no to release him on bail, court should have asked him to submit a bail application rather to go for a suo moto.. Supreme Court's order is not Constitutional . It is a political order because Kejriwal had not applied for bail.

So Mr. Sibal is saying that any undertrail should be allowed to go about his business as usual, never mind the severity of his crime. Or is it a privilege to be given to a corrupt politician only.
It appears that Jaka as well as viewers of this episode all are satisfied to hear the explanation of Mr Sundaram about the cause of interim bail which otherwise remained unclear even after hearing Mr Sibbal.
Bail order must be challenged in SC itself.

Mr Sibbal obviously has his private agenda. He has represented the opposition parties and its leaders in many cases. His comments are totally one sided aligning towards the opposition. Nobody whether the chief minister or VVIP or top professional or an ordinary layman is above the law. Can an arrest be made only after a conviction sir?

In this matter, the Supreme Court had the option to either grant the interim bail or reject it. The common perception based on the law of precedents, was that it should have DENIED the interim bail. Yet, the Court has granted the bail, just because it has the power to so. If the power exists, then it must be exercised, otherwise, there is no purpose of creating or granting the power. The bottom line is there is no certainty about the law on any topic or issue. The law of precedents is only cosmetics, judgments are delivered on face value depending upon who you are. Bench was asked to decide whether arrest was legal or illegal ? It was not about bail ? NIA should investigate Judges and Kejru also.
The point is SC has to grant interim bail to all politicians under a “ exceptional case “ , depending upon the the mood / bias of judges.
One more point, Kejeriwal didn't apply for bail, SC suo moto granted, this was unprecedent, he might have influenced. If that be the case they could have released Sahara Subit Roy, unnecessary kept in Jail not allowing to perform his business duties, made a big loss..

To file a bond of Rs 50000/- with the jail superintendent. I feel it's Parole. Can SC grant a bail or lower courts to act upon SC bail verdict is to be dwelt upon. If anything is in the interim it has to be final one day or the other. Does it mean final bail shall be granted suo moto by SC even when the victim is not demanding the same? Interesting.
In India if you have a senior and money to spend lawyer who sleeps in the SC office can do anything for the accused..

What is the use of interviewing lawyers they will never speak against the judges after all they have to fight their cases in front of them. It is shocking that he ignored the summons of ED. He continues to be CM while still being in jail. Sad state of affairs! Is our judiciary compromised? I simply can’t understand why was he granted bail. Supreme Court is not supreme after all. A lawyer has very special privilege of Arguing a case both ways,for and against. Common voter is bereft of intricacies of law and more so orders of court. Funny situation: Kejriwasl was not asking or bail. He went to SC to challenge his very arrest and the judges didn't or could not get him satified in that regards in view of the High Court's remarks that his arrest was logal and because of its nature, he cannot be ganted bail. They put the word bail in Kejriwal's mouth. Without him making any request for bail, he was given bail. I cannot say whether it is a question of creating a precident or not.
