Welcome back to another episode where man and machine attempt to do battle with Haulover Inlet!

    • There is no such thing as "right of way" when on the water. You are trying to apply traffic laws to a marine situation. Specifically "the overtaking vessel is technically the, give-way vessel ." Do please take a Power Squadron course so you actually "know" and don't "think" something when you are wrong.

  • Playing in the streets. It's every Captain's job to do everything that can to avoid a accident, no matter who has the right of way. This is how both vessels avoid collision. Slowing down is best in a inlet. Direction and or speed works in open water. What's the whistle being blown to tell the other captain witch side you plan on overtaking. Nobody uses a whistle. I am a Coast Guard vet btw. Worked the Mississippi River lighthouse. Stay safe out there and plan every trip you take.

    • There is no right of way on the water honey. You are either the stand on vessel or the give way vessel and you can go look up which is which and if you are a bright little star you will figure it out. Hint: check out "an overtaking situation."

  • The larger vessel has the right of way since they cannot manuver or slow fast enough to avoid a collision, and in this case the PWC operators didn’t even try to move out of the way of the incoming boat. For example, who has the right of way…. the aircraft carrier or the 50’ Fountain?

  • Jet ski was on the starboard side ish of the pilot lane, heading inbound, sort of. So the Sea Ray was obliged to pass port side or radio for verification to pass starboard side. Right? Maybe directory inquiry didn’t patch him through on time 😂

  • If you look there are THREE skis going every which way. Yes, the bigger boat should have slowed down, but the skis also need some common sense by not semi-blocking the inlet and probably not holding any steady course.

    • There in some inlets but not at Haulover however there are rules that pertain to safe navigation and the bigger vessel is not observing them. The first of which is Rule Three which says you must do everything you can including breaking the rules to avoid a collision. If you have a collision on the water there is no wrong or right you both are wrong.

  • Any vessel that is approaching your boat from the stern doesn’t have the right of way. Maintain your speed and course. Whenever a boat is overtaking another, the vessel in front always has the right of way and should be allowed to continue their original course unhindered. This is the case even if the vessel behind has a higher level of right-of-way priority, such as a sailboat.

  • The jet ski needs to get out of the way of larger vessel, such a dangerous inlet requires that the operator of sea ray pass through as safe and efficiently as possible. Maybe jet skis shouldn't be playing in such adverse conditions. 👍

  • It's hard to access who is at fault when the video only shows the interaction of the two vessels at the point of collision. I'd like to see both of their actions in the 30-45 seconds prior to the collision. Using only what is in the video, the large vessel appears to be at fault for not keeping a proper lookout (Rule 5) and/or not proceeding at a safe speed (Rule 6). But my guess is the jet skis previously broke other COLREGS prior the collision point that makes assessing the situation difficult. But the truth is all vessels are required to avoid all collisions, so both are at fault to some degree.

    • You're right on all the rules but the ones that actually count. But in an overtaking situation the vessel being overtaken is the stand-on vessel and the one overtaking is the gave way. Study better so you can pass your 6-pack test.

    • @@superbmediacontentcreator From the video, I have no proof or evidence that it is an overtaking situation. Jet ski #1 was a head to head encounter. Jet ski #2 (the one in the collision) appears to be in an overtaking situation, but we're only seeing the video long after that should have been determined, literally less than 1 second before the collision. It also appears he turned in towards the boat, which a stand-on vessel should not do in an overtaking encounter.

  • It's everyone's responsibility to maintain a good forward watch, but it seems to me that the larger vessel was at fault; if for no other reason than plain courtesy. Probably a bit of fault on both parties, but mores so on the larger SeaRay.

    • You are correct but the specific rule that applies is the one of overtaking. and the overtaking vessel is the give-way vessel while the jetski is the stand-on vessel. Slowing down is just part of the mix.

    • Nope and wrong. You can overtake on either side however if you are overtaking then you are what is called the give-way vessel meaning it is your obligation to maneuver or alter your speed to avoid a collision. The vessel being overtaken is called the stand-on vessel and it is his obligation to "hold his course and speed."

  • I don't think you can criss cross willy nilly like those jet skis do. There was no over taken since it was head on. I would think the Police would try to keep the jet skis from playing in the channel. No way the big boat could have avoided them and you can't always slow down instantly.

  • The overtaken vessel (ski) needs to maintain course and speed. He did not. The overtaking vessel (boat) needs to be able to rely on the overtaken vessel maintaining course and speed. In the event that the overtaken vessel does not maintain course and speed, or, it changes to course and speed are needed due to other constraints (traffic, conditions, depth, etc) without providing proper notice to the overtaking vessel, he is in the wrong. The ski is in the wrong. The boat successfully avoided a catastrophic collision and is in the right.

  • Too complicated to answer without more context. I am not a captain but I know some of the points. Apparently if you are overtaking you do have a duty to give enough room to pass safely, but how consistent and predictable were the jet skis? Both have a duty to safety and to avoid a collision, and there is probably a point about the duty of the more maneuverable craft but I am not sure it's a simple as the larger craft having the right of way. There could also be a point about passage, whereas the jet skis are just there goofing off and the boat is making passage. Can't wait for BroncosGuru to provide the actual answer.

  • It is all boats responsibility to avoid collisions. There is no such thing as right of way on the water. You have stand on vessel and give way vessels. So because the boat was over taking another vessel, regardless if you like it or not, he is the give way vessel. However, I do believe that the jet ski should also be sighted under Florida section 33, Reckless or careless operation of vessel, for operating this way due to sea state and traffic conditions. At the end of the day both captains operated foolishly and put lives and property in danger.

  • The jet skis should not be playing around in an entrance waterway. Large vessels need room and the jet skis were circling at the mouth of entrance. The jet skis since they were playing should have given way to the larger returning boat. I can tell you the jet skis play a lot jumping yacht waves and getting too close to large vessels. The skis needed to get out of the way because they were blocking the return entrance.

  • The jet ski turned and struck the boat. The boat was actually actively trying to avoid the jet ski and the jetski was having none of it. This was a deliberate act by the jetski. Whatever the rules of the road, the jetski is in the wrong. The operator acted with malicious intent, striking the boat and the boat was unable to avoid the strike. I’d personally say the less maneuverable vessel should have right of way. The jetskis could easily maneuver to clear the boat, the boat could not maneuver to stay clear of the jetskis constantly changing course and speed playing in and blocking the mouth of the inlet. Then there is the deliberate course change into the side of the boat.

    • ​@superbmediacontentcreator Port to port passing within channels and inlets, fixed headings out of inlets, and the law of gross tonnage. First jetski is at fault. Furthermore, port side jetski preformed a course correction directly in front of another, much larger, vessel; there is no overtaking if a boat 180's directly into your path(overtaking implies consistant similar heading of less then 22.5° abaft the starboard beam during the pass). Both jetskis were exiting the inlet, first ski crossed the larger vessels heading and passed on the wrong side, the other tried to turn off to avoid the large craft(large vessel could be liable as long as the vessel being overtaken or passed maintains her course and speed as required under the rules; port side jetski changed course), putting himself in the path of the boat who changed heading to avoid hitting the first jetski. First jetski fucked this whole pack up for everyone. Not saying the large craft shouldn't have come in slower, but those skis should never have been on the entrance side of the inlet when there is other traffic present.

  • On the water no vessel has the right of way... It's up to every Captain to do everything possible to avoid a collision. That being said the boat is the stand on vessel and the seadoos are the give way and should be staying out of the way of the larger vessel. The boat should maintain a steady and consistent course and if the seadoos do not move he is obligated to

  • The Sea Ray coming into the inlet was under way from a larger body of water into a smaller, therefore, had the right of way. Other vessels need to make the massage clear for those incoming boats.... Yes/no/maybe?

  • The jet ski is at fault several reasons for this 1 the boat running thr inlet is constrained by hee draft also 2cswne vessel is restricted in her ability to maneuver . I doubt he saw the jet ski and if. He had a hard turn to port or starboard may have averted impact iif done in time. However that hard turn would have needed to be counrerdd immediately to avoid his own demise ,it may have avoided impact if time perfectly. .,moreover it could also have put his propellers on the jet ski instead. Itts a sad event . The courts will find the jet ski at fault ..common sense is out the window here jetskuis have no business in that inlet to begin with and also is a poster child for big boats have the right of way. It's just most people don't know now the specifics of why that is ..thee ae even more issues than I mentioned as re overtaking vedal he ad some responsibilities .however in this case I believe the main law of ruling factors will be a vessel restricted in her ability to maneuver and has the right if way therefore het ski at fault.   • Assuming the jet skis were heading out to sea the Jetski had the right away because the current was at their Stern. This is obvious, because when the boat captain comes off of the throttle, his boat starts drifting backwards

  • Hard to see the whole thing on video, and ideally you should be using horns to communicate. Those details aside, the boat should have overtaken with caution giving plenty of space to the jet-ski. The jet-ski should have stayed on course while being overtaken. From a pure rules standpoint, the boat is at fault. Being realistic, both acted like morons and both are at fault. Edit: I can try to think of a street scenario which is analogous. Let's say a car runs a red light and hits a pedestrian. However, the pedestrian started sprinting at full speed the instant the walk sign turned on without looking for oncoming traffic. Yes the car is technically at fault, but the pedestrian is also a moron for not looking before crossing and sprinting immediately after the light turned green.

  • Big boat is at fault. Same as while driving with a car, if you see kids playing on the street, you slow down. They should be playing on the road? no, but you are the one carrying the weight... If you see idiots on the inlet, using their jetskis in an unsafe way... YOU as the captain should slow down to avoid collision. Smaller vehicles might be held as the "stupid ones" but you are the one who can cause the damage.
