  • Let’s get this straight.. Possession of meth can get you 20yrs in prison.. Putting zip ties around a child’s throat and wrists, with a charge of attempted murder only get you 10 yrs in prison.. REALLY? WTF is wrong with our country?!?!? Absolutely disgusting!!

    • Domestic violence is only a misdemeanor with a cap of 93 day sentence in Michigan. Yet, if you spit on a stranger, that’s a felony. The only reason this defendant’s DV charge is a felony is because he’s already had three convictions for it. God only knows how many times he’s been charged or committed the crime. It’s disgusting.

    • Our justice system certainly needs to be changed. The same applies to simple marijuana charges compared to meth, heroine, fentanyl and firearms. I’ve seen bonds set extremely high for marijuana and PR bonds set for others, absolutely outrageous

  • Judge Middleton must have been one bad-ass prosecutor. He gives more powerful summary arguments than any of the ADAs that present cases in his court.

    • Middleton terms out due to Michigan's rules that those who are 70 or older may not run as a judge. Maybe he'll put in at the prosecution's office.

    • @@AlPapa Retired judges are allowed to serve as fill-ins for elected judges that do not make it to work that day and are allowed to do this statewide. Years ago Muskegon County had an old guy from Detroit come over to do fill-in and judicial recusal work (and with eight judges he was in court most days of the week). Maybe Judge Middleton will start doing fill-in work for different courts after he retires. I am sure the guys in Muskegon would like him.

  • I would 100% agree with Judge Middleton when he stated “ the doctor was not very powerful” as well as his statement in regard to nobody bothering to go inside and looking for the zip ties and evidence of the cruel treatment of this young child!     • This is only the preliminary hearing. There will be more extensive testimony and evidence later. The zip ties were not collected by this officer (that does not mean they were not collected).

I try to give ER doctors credit, they see such a massive number of people in such horrible conditions, remembering each one and getting attached or emotionally invested could quite literally be fatal, but I agree he didn't sound like he wanted to be there. A feeling only confirmed by the fact that he no-showed without a word to the prosecutor at the first hearing.

  • The Dr didnt impress me at all!! Busted blood vessels due to a lack of Oxygen and almost passing out is terrifying (trust me) but expecially to a 9 yr old boy is beyond terrifying😢

    • It's really unfortunate. Most times you don't even see an actual Dr. In the ER. He was probably pulled from another department due to the abuse allegations. I know my local, rural hospital uses everything but MDs in the ER and then takes them from ICU, Cardiology, Orthopedics etc, for the ER when absolutely necessary...

Long enough so when the boy becomes a man he can at least defend himself !!!

  • Defense Attorney conveniently IGNORING asking any questions ( to the Physician) about how ZIP TIES around a neck constricts the CAROTID ARTERIES on each side of the neck, thereby restricting arterial blood from reaching the BRAIN !!! This 9 year old child miraculously escaped 1. DEATH, 2. or potential permanent brain damage leaving him in a vegetative state for the remainder of his life . This seems to me to be "attempted murder" at the very least. This monster evil man deserves LIFE IN PRISON without parole.

    • They really just needed him to confirm there were injuries consistent with strangulation in the manner described, which he did. He's not an expert witness he's an ER doctor who likely sees even more heinous shit than this on a daily basis, sad as that is to consider. He wasn't a strong witness but he covered the facts they needed. They probably didn't need him at all for this as the standard is easily met just by the victim's testimony. If the victim had decided not to testify he would have been more important.

  • I live in Australia and I have no idea why I watch a lot of USA court proceedings. Some presenters insert clips from dumb movies and some have a video insert of themselves making comments. I see the latter as 20 minute long selfies because they usually offer "nothing" to the presentation itself. I LOVE the Wolf! It seems to be concentrating so hard and it's expressions obviously convey your feelings without you shoving them down our throats. The short written comments offered by the Wolf are useful. Well done! I've subscribed and given you a thumbs up.

    • @@martyreynolds6790 The child is 9. As Glynn stated a plea avoids the need for the child to testify against their abuser which in itself can add further trauma. Especially with it being his father. With the meth and the one count they kept he was looking at up to 30 years s those would run consecutively. As counts 2,3 & 4 would almost certainly run concurrently as they are effectively different charges for the same actions, the only count that would have given him longer would have been the DV due to being habitual, but it's unlikely he would have actually been given more than 10 years on that. Overall, the deal was of little benefit to the defendant which is probably why he was advised not to take it.

    • @@mollymaciulla1917 Bond laws vary by state. You should research what color states allow people, even with violent crimes, to bond out or even go free without bond and see how that goes. In sane states, a Judge sets bond based on how strong the prelim evidence is against the defendant and how likely it is they did it and their risk of flight. A bond simply ensures that person will show up for court. Take a look at Darrell Brooks in WI. Because of WI's WEAK laws, he was arrested over and over - skipped court MANY times and was still allowed to go back onto the street until he took out 6 people and injured like 70 others in a parade.

  • I have two advance degrees and RN in nursing ,and I was married to a doctor . We both worked in Prisons and jails ; we saw many victims and perpetrators of these types of crimes . Both the Doctor that examined the child and the Cops that investigated the scene did a very poor job if their testimony is any indication .

    • I think the sentencing ranges should be reversed. 20 yrs for strangulation and 1 yr for the meth. Unfortunately that is part of the fall out from the war on drugs.

    • The offer was just to try and avoid having the victim testify against his own father adding further trauma. He refused it because it really didn't add any advantage as the 2 counts he would have pled to would run consecutively while counts 2,3 & 4 would run concurrently if convicted. The bond amount wasn't mentioned in this hearing but Judge Middleton mentioned it was significant and I would bet there are significant conditions attached. As everyone is considered innocent until proven otherwise he is entitled to a bond, plus you can't just keep everyone accused of heinous shit locked up as the jails wouldn't cope. This one doesn't seem too complicated at this point but some of these cases can take years to bring to trial.

    • @@bradcamillo1966Judge Middleton isn’t weak. He also won’t be the trial judge. There isn’t a single judge for all of a defendant’s appearances between the bond hearing to sentencing. Judge Middleton was a prosecutor. Due to minimum mandatory sentencing guidelines for illegal substances, he absolutely put defendants in prison on marijuana charges who had longer sentences than CSA, SA, and murder. Statistically, he put people behind bars who were innocent. That has to have a brutal effect on a person’s conscience (if they have one).

    • I had to testify when I was 5 yrs old against beast that r*ped and s*domized me when I was 4 yrs old. This was 1980. Regardless of forensic evidence the jury decided not to believe me that any of these things happened so they let the guy go maybe they didn't like that even though he rearranged my guts I could still have future children. Maybe they would have felt better if he had actually disemboweled me instead of remaining intact. He went on to impregnate his daughter and rape countless other toddlers in onesies just like me. People talk a big talk on the streets and in comment sections like this being horrified over these hideous crimes towards children but when it comes down to when it really matters nothing's done. I was left with a life sentence and I hatred and distrust for the justice system I have a deep love for law enforcement as the two detectives in my case resembled angels. And my dad that ended up adopting me was a State Trooper so that certainly helped LOL💙🖤

I heard Crystal referenced and I'm wondering if this is the couple we've seen repeatedly regarding DV. Sometimes she will testify against him..but more often than not she won't cooperate.     • It's not a trial, just a preliminary exam. They had 4 witnesses if you include the victim, who wasn't shown for obvious reasons. They only need to show probable cause which was easily met by the victim's testimony. It's very rare these are not met so they didn't need to drag every possible witness in, they had more than enough to accomplish the goal. They had enough from the cops and doctor that even if the victim had decided not to cooperate by testifying against his father they would still have met their burden. It sounds like the mother got home and found him, freed him and called CPS/police. I would agree it sounds like the police dropped the ball by not looking in the house for evidence regarding the abuse but we don't know the full story - it's possible the mother can explain that, maybe she gave them to someone other than these 2 cops, maybe one of their colleagues or CPS collected it, who knows. That would all come out at trial.

  • Yes, the ER doctor was a disappointing witness, but, to the average person who (hopefully) does not see much like this case, ER staff see a great deal more of this than you can imagine. I was an ER nurse and NP. It all can start to run together, and in order to be able to continue to serve you have to ruthlessly compartmentalize your memories and emotions. If not, it chips away at your soul. Add to that the hectic pace of most ER’s with overcrowding and understaffing and the fatigue of long shifts….anyway, many things can cause certain injuries, and the doctor may have thought he was doing right trying to be objective. Nothing, nothing in our medical training prepares us for being a trial witness! I agree this case is horrible, and I wish his testimony was stronger, but I understand how this can happen without poor intent.

And we can’t testify about how sick this makes us and how we’d like to beat the abusers senseless but we can’t. Nor can we testify emotionally.     • Based on what? Real question: I skipped through some of this, but I didn't hear anything that would indicate guilt on her part. She was the one who discovered the meth in front of the cop, and my strong guess is that she was the one who called the cops. On the other hand, he had prior DV convictions, and (I assume) she was still with him. But that doesn't mean she should be charged. She's likely a victim, too.

They pass the laws that handcuffs the justice system for parole and sentencing. These same politicians also handcuff law enforcement by labeling criminals victims of society of history or whatever other bs. Our 1st family dog, when sons were quite young, was puppy from my friend's dog. Her family dog was 1/2 timber wolf, 1/4 malamute & 1;4 husky (from what I recall -- maybe dog was only 1/4 timber wolf -- but no less). Jubilee was not spayed. She got out, & a small litter of puppies followed. Our dog, named "Princess" by the daughters in my friend's family, was the MOST WONDERFUL companion. NEVER aggressive with ANYONE. Lots of kids around, & our youngest was under 2 years old. I was the alpha, since I was Mom & made sure Princess was well cared for, trained & lived. She was the best.

  • For everyone upset about the 20 years for meth vs 10 years for child abuse - remember, the judge said second offence. In some states, most actually, the more you commit a crime, the penalty grows exponentially- this was not his first time being charged with possession of meth. Prosecutors are able to enhance the range of punishment based on criminal history. If someone someday gets caught for the first time with meth here, they don’t go to jail for 20 years right off the bat.

  • Putting a zip tie on someone’s neck and screwing it down is attempted murder. A reasonable person should know that it will tighten and strangle the person. Don’t know if they need to prove intent (meaning I don’t think “attempted depraved indifference homicide” is a thing) but if that kid had died it would be felony murder or murder 1 and that was a reasonably likely outcome. Guy should’ve taken the hefty plea cause I can tell already that Judge M is going to throw the book at him for sentencing. Like he’s generally the most compassionate judge ever, but you can tell he’s deeply disturbed by this and ready to see this guy locked up for life with a chance in 20. And the meth charge is the easiest to prove so if the judge gives him the max it’s a guaranteed 20 year stretch. I agree it’s egregious that a possession 2nd is a worse sentence than the horrific violence against a child, but they’re not focusing on the meth in this case because they think it’s worse, they’re focusing on it because they know it will get him put away.

  • I’m glad I read the comments before watching. What ridiculous, lenient treatment of this monster! Meth possession = twice as bad as what he did to that child??! I can’t watch it.

  • 20 years for a second offense of having meth and only 10 for abusing/torturing a child…. Wtf is wrong with the justice system.
