Melissa Lucio is the only Hispanic woman to ever be sentenced to death in the state of Texas. She is currently facing her last appeal, having spent 13 years on death row.
Her case, as well as the problems with the American justice system and the death penalty, are captured in the documentary The State of Texas vs. Melissa (2020).
Having made its festival debut, the film has received great reviews and won multiple audience choice awards. Joining us is French-American journalist and filmmaker Sabrina Van Tassel, who directed, wrote and produced the film.

  • In 2007, Lucio had fourteen children, and nine of them lived with Lucio and her boyfriend, Robert Alvarez. On February 17, 2007, paramedics were called to the Lucio residence because the youngest child, two-year-old Mariah Alvarez, was unresponsive and not breathing. According to the Cameron County District Attorney's Office, Mariah was found at the home with signs of abuse on her body. She reportedly had scattered bruising, bite marks on her back, patches of hair that had been pulled out, and a broken arm. According to Lucio, two days earlier Mariah had fallen down a set of stairs, leading to her injuries.[2] Mariah was pronounced dead upon arrival at a local hospital. It was later determined that Mariah's arm had been broken two to seven weeks before her death, and an autopsy also showed a head injury and bruising of the kidneys, lungs and spinal cord.[3] You people are fucking brain dead to even question her guilt!

  • That child was murdered. Not only were there a ton of bruises in different stages of healing, hair had been ripped out, bite marks were visible on the back and one arm had been broken 2-7 weeks prior to her death.

  • People need to stop making excuses for these kind of sick people . Its obvious she has some very messed up psychological issues going on with her . She's responsible for that baby's death whether it was an accident or not she's responsible.. She needs to be held accountable !! People need to stop having pity and making excuses for these very sick individuals !!! I do not support the death penalty but I believe that child abusers and child murderers do not belong outside prison walls.

  • On February 17, 2007 paramedics found Mariah Alvarez unattended and lying on her back in the middle of the floor unresponsive, not breathing and with no pulse. Her father Robert Alvarez told police and paramedics at the scene that Mariah had fallen down some stairs. Mariah was transported to the emergency room at Valley Baptist Medical Center in Harlingen, Texas where she was pronounced dead. The condition of Mariah's body indicated that she had been severely abused. Her body was covered with new and old bruises, contusions and bite marks on her back. One of her arms had been broken probably about two to seven weeks before her death, and she was missing portions of her hair where it had been pulled out by the roots. She was dehydrated and small for her age. Mariah indicated no apparent signs of a head injury. An autopsy showed two year old Mariah died of blunt force head trauma, which would have occurred within 24 hours prior to her death, and it would have been immediately apparent that Mariah was in distress and in need of medical attention. She also had cocaine in her system at the time of her death. Mariah suffered "multiple contusions" to her head area and that "blunt force head trauma . . . basically means, beat about the head with something-an object, a hand, a fist, or slammed." Farley testified that these injuries would not have been caused by falling down some stairs and that this was the most severe case of child abuse she had ever seen. Lucio was arrested the next day for the capital murder of her daughter, Mariah Alvarez. Lucio was sentenced to death by lethal injection. Lucio's husband, Robert Alvarez, was only charged with injury to a child. I wish more child abuses were sentenced to death by lethal injection like Lucio or at least sentenced to life in prison for their crime. It's not fair that they can take an innocent life and still have theirs even if it is behind bars. The previous documentary was about her getting released. The whole family is guilty! 14 kids none of them reported this. Come on! Jesus Christ Lady you know the system well. More Children more money! RIP SWEET ANGEL Mariah justice will be served. 👼💜🕊✝️ (Edited for grammar)

    • Was the child or family ever tested for Ehlers Danlos Syndrome? The sister admitted to the lawyer that she would punch her little sister and she was her main care giver not the mother. Another child abuse case where the same woman doctor lied about when the injuries of the child occurred was already dismissed. The man was out of state at work when the injuries actually happened. The pathologist is a lying witch. CPS experts are caught lying all the time. They get paid to lie. Do you think they would still receive their check if their testimony was to clear the accused? Their hospitals make lots of money off of CPS. You can see how much CPS pays these hospitals by looking at their budget on their website. If this pathologist lied in another case what was to stop her from lying on the stand in the case of Mrs.Lucio? Absolutely nothing. Was the little girl ever tested for genetic illnesses, metabolic bone diseases, vitamin or mineral deficiencies? New out of state experts with more experience concluded that the daughter died from injuries she incurred by falling down the stairs. These new experts have not ever been caught lying in court. These out of state experts concluded that the little girls arm was not broken weeks prior to her death. The little girl was very prone to falls and had an in turned foot. This can be common with may genetic illnesses. Some people with EDS have an in turned foot.

Something is definitely off about this whole case and I would think if it were my sister and I believed in her innocence then aside from being sad about her being there ...why would it be so difficult to write her letters ; why would you want to block it out instead of standing up for her, supporting her, encouraging her to stay strong with a "were going to fight this " ✊🏼💪🏼 type of mentality.   • Question for the lady who made this…. WHY did you not include the siblings who were interviewed for YOUR documentary and talked about Melissa ABUSING the poor baby?   • I've seen other commenters mention the bite marks, old bruises, and previously broken arm. But it can't be repeated enough. The physical evidence contradicts Melissa's story. You don't need eye witnesses to confirm she had abused the child. It's possible to conclude that she either inflicted those wounds herself, or lied to cover them up. Either way, she's not innocent. I don't support the death penalty. But she should never, ever leave prison. She's poses a special danger to other people.

    • I am kind of half and half on the issue of death penalty, one half of me is against, I grew up knowing and believing that is wrong to kill another human being. My other half is that, why do we have to keep feeding and clothing a child murderer, plus paying for all the medical expenses until she dies of old age. She didn't want to live following the rules of law, no illegal drugs, working, maybe up to two jobs at a time to support 14 kids. Life is hard, but to many of us, even working as mules, double shifts we do not break the law.

    • I'm sure her daughter was abusive to the child as well; her psychopathic smirk when she is denying being rough says it all. But, at the end of the day, Melissa has no genuine remorse for what happened. She deliberately chose to have children she could not begin to care for nor support, and neglected them while she used drugs; conceiving/delivering more babies that are drug affected. (That alone should be worthy of the death penalty). Child Services also failed all of the children; they knew there was no way there was proper supervision, nor enough food, etc., for the children much earlier and they all should have been taken from her. They have no skills for a profitable career and yet they have 10 or more kids??? The lack of concern/sense of entitlement is insidious. Melissa sees nothing wrong with her actions. You would think being abused herself she would want to avoid having children of her own entirely as long as she was living in poverty, and want to ensure if she gave birth, she was able to give that child all the attention he/she would need. The minimization of her actions, the idiocy in not recognizing the death occurred b/c of her direct actions or direct complicity makes it difficult to watch. Liberals go too far trying to push for criminals to escape the penalties they rightly deserve. If they don't kill her by lethal injection in April, she should at least remain in prison without parole.

  • Im a the Daugther of a Latin mother who was so abusive!!! Left me with her sisters who were the same, my grandmother wasn’t as bad as they were but the abuse was nasty! I see a lot of latinos hitting their kids, calling them names, rapping them etc! And thus woman is telling a story about a woman who couldn’t even be responsible for her own! She fail her kids terribly and I’m not saying she deserves to be put dawn but I hope this teaches latinos to educate themselves about child abuse! A lot of people are defending this woman for the fact that she is a woman but most of this people forget that her little one had no one defending her when she was been violated but the very same person who was supposed to protect her!

A good mother pays extra attention to the one that needs her the most.   • 14 children. Drugs. A dead child. All I will say is that although I enjoyed the documentary. Well done. It seems that in most of these cases in today’s movements they seem to focus on the details that can get the defendant off. Found not guilty. But yet in this documentary there was no focus on a dead child. Barely mentioned her name. Barely showed the photos. Somebody in that home neglected that child enough that it “fell” down the stairs. I’m sorry for the child who passed away. Not Melissa. I’m sure the legal system made some mistakes but with that amount of bruises from one fall down the stairs is very suspicious. And now that so many criminals are being set free and the law abiding citizens are now carrying guns too , we might as well say goodbye to civilization and the earth. Maybe you should change the title to “Who speaks for Mariah and why is there no one to blame”. Why in God’s name can no-one accept responsibility for anything any longer. Every case seems to be overturned by some form of social justice or appeal on a technicality. Maybe if that hour spent in the bathroom getting high could have been the 14 minutes that could have saved the child’s life. Because it’s just odd that no one knows or saw who did it. Drug use, 14 children , no supervision and sexual abuse of a mother and a dead child. Justice for who ??? Not Mariah.

    • The daughter had an in turned foot and she was prone to falls. Did you know that? Did you know that some people who have Ehlers Danlos Syndrome have an in turned foot? Ehlers Danlos Syndrome can cause bruises. The family and the little girl were not tested for EDS. Matter of fact the little girl wasn't tested for metabolic bone diseases, vitamin and mineral deficiencies, or genetic disorders. Read about Farley she's a lying witch. CPS experts are caught lying all the time. Manuel Velez is only free because 10 different out of state experts with more experience disagree with Farley. The injuries actually happened when Mr. Velez was out of the state at work. Farley straight lied in the case of Mr. Velez and she could have just as easily lied in the case of Mrs.Lucio. Out of State experts with more experience concluded that the daughter died from injuries she incurred by falling down the stairs. You can't charge and arrest a staircase for murder. Is she and other people involved guilty of neglect absolutely. Murder beyond a reasonable doubt, I don't think so.

Check out Kimberly flower video on her she got a ton of evidence not shown in the documentary. So much stuff was not even in the documentary. The documentary makes her out to be innocent but the real information makes her guilty. She doesn’t deserve to die but definitely deserves to serve her time in prison. No matter what she abused that child which resulted in her death. I thought she was sooooo innocent after watching the documentary but then I started researching and listened to people who got police reports dcfs reports and then hearing one of the kids Selina speak the truth and her screen shots from the journalist that wanted to do the documentary. Just review everything.

The doctors who gave them the medicine should be held responsible. Some people who have bad reactions to those drugs cannot control themselves and become very homicidal. The wife of Phil Hartman was on that kind of medication when she murdered him.

  • I just finished watching her documentary on Hulu.... what a mess .... How come she didn't know how Mariah got all those bruises????????? How??????? I don't understand..... i will NEVER take the blame for anyone .... if one of my kids committed a crime she will have to pay for it..!!!!   • I watched the Gabriel Fernandez documentary. Those people were monsters. The lady let and encouraged her boyfriend to abuse her son. It is infuriating that only the man ended on death row and not the woman. I don't understand how she got the death penalty and Pearl Fernandez didn't. This poor woman had an incompetent defense team, a crooked D.A. and a poor famial support system.

  • I definitely feel as though the daughter was abusing her sister. Melissa said she resented her because they had different fathers. When they interviewed the daughter she appeared very off almost like she thought it was all funny. Could the daughter possibly have had issues with Mariahs father( mother’s boyfriend) and that’s why she took it out on her little sister. Either way Melissa was not a great parent or a victim, as they tried to paint things . If she was covering for her daughter that was completely idiotic and she has no one to blame but herself.

  • Just because the child did fall down the stairs doesn’t mean the child wasn’t getting abused plus falling down the stairs is also neglect and the child could have fallen from being weak from the pain and bruises the mom caused.   • The victim was the baby , all the reports from CPS not only from the baby who passed away but the abuse on the other children, explain to us how that baby had a broken arm and the mother didn’t know . She had to be in severe pain , and was never taken to the hospital for her injuries , you can go talk to a drug addict when they have been sober for a while in jail and yes they appear to be great people , but you’ve never seen her while see was using , they are like Jeckke and hide, yes the other two children probably did abuse the baby , that’s because they were treated that way by the mother and they we’re taught to abuse by their mother and all were victims , you feel sorry for the wrong person , the children were the victims and the baby paid the price , speak out for her she was the greater injustice at the hands of her mother !

  • I am a retired Michigan lawyer who tried many many criminal cases. Let me tell you when the Texas Ranger said he knew she was guilty the first time he saw her, that is a classic example of prejudice. His judgment was before he got the facts, i.e. pre judgment. If that came in at trial it completely invalidated due process. Also a statement without a lawyer is always suspect. Was a lawyer available and did they tell her she had a right to a lawyer. Obviously if this woman had 14 children, those were children she did not abort. Also no witnesses were called on her behalf and the prosecutor is so corrupt that he ends up long term in prison and none of his cases were reviewed? As far as the prosecutor always winning, that was not the case with me. I tried cases for ten years before I ever lost a case. I had a murder case with a prosecutor that had never lost a case, the jury was out 14 minutes and declared not guilty. I had two more capital cases with this same prosecutor and won both of them as well. But I saw a lot of lawyers that were just incompetent and couldn't really try a case if the defendant's life depended on it. By the way I must admit my prejudice for this woman who had 14 children because my mother had 15 children and in my experience a woman with that many children has to have a deep love for children or she would have aborted them.

    • @@notfromhere6839 don’t know what you’re reading but it’s in the court transcripts where she admitted to pinching the child’s vagina numerous times, biting the baby in the back more than once, signs of a broken arm weeks previous to death, patches of hair pulled out by the roots on her head. This documentary is very one sided and edits the extreme cruelty this woman inflicted on the poor child. Also the 9 children still living at home along with Mariah were all removed from Melissa’s home by CPS because of neglect and Mariah’s father who was living with them was smoking crack plus Melissa had tested positive for cocaine so many times CPS was afraid they were going to get indicted for returning the children to such terrible circumstances. I don’t understand why this woman wanted to create a whole documentary on such an extreme case and leaving so much crucial information out.

  • I enjoy the documentary however I feel it was very focussed on the Family TODAY but not as much as the FACTS and trial and evidence of when it happened. I would have liked more in-depth info. However I feel something not right with this case. Look at her lawyer and the team around this...very fishy for sure. Also interesting that ONE of the dr said ALL the bruises occurred AFTER death with handling of the body because the body cannot clog itself and baby.Makes sense but never heard that b4 and if that is the case wouldn't that be the first thing they would have understood? At same time no one ever said they saw mother hitting her kids including her children. Interviews back then showed SOME of her kids saying they were JUST put in the corner. With some saying it was alex( sister) that abused and ALEX admit it to PUSHING the baby (2 1/2 year old) downstairs. Alex DID say she did hit and didnt like her sister but " forgets" if she pushed her?!! This was also said when it first happened as well in the lawyer's files and ca. But at the time was kept quiet. This mother wasn't the best mother but from my understanding and all of the discrepancy and Fishy Stuff in and around this case...I strongly feel they NEED to look into this again BEFORE they put this lady, who COULD be innocent of murdering her child. She MIGHT ONLY be guilty of being a poor mother who didn't have the support that she needed and neglect but physical abuse is completely different. There is so much more that i could say about the weird shit about the team involved( D.A her lawyer then) in putting this lady behind bars but not enough room. At first i really thought she killed her child until now knowing all of the other important information that was in this doc. I hope that people watch this doc with an open mind. I hope that they reopen this case and look at the justice system. It needs fixings. I wish everyone so much love and respect

  • Thee kid had a tremendous fall and she does not take her to the hospital. I take my dog to the vet for anything and this woman did not take her daughter to the hospital to check her up. Her arm was broken seven weeks before her death. It is obvious that she was abused. She admitted to detectives that she beat the girl. She has 14 kids...really? Comen people !

    • CPS never recorded any abuse. Another child abuse case where the same woman doctor lied about when the injuries of the child occurred was already dismissed. CPS experts are caught lying all the time. If the pathologist was caught lying on the stand in another case then what was to stop her from lying when she testified against Mrs. Lucio? Absolutely nothing. The man was out of state at work when the injuries actually happened. The pathologist is a lying witch. The teenage daughter admitted to the lawyer that she would punch her little sister and she was her main care giver not the mother. At the least she should be charged with injury to a child and a teenager should know better than to punch a two-year-old child. New out of state experts with more experience concluded that the daughter died from injuries she incurred by falling down the stairs. Sometimes experts are full of 💩.   • how difficult it is to judge something so horrifying to believe that a mother can kill a child is very difficult but it is possible I have a mother who hit me very hard one day she hung me by the neck I tightened the rope while she hit me I assumed she would kill me so it is possible and i only ask that if melissa lucio is guilty god forgive her and if she is not god forgive her executioners

  • I just watched the whole documentary of melissa on hulu. It's unbelievable how our whole system is broken. This woman was protecting her daughter. Big mistake from her part. But i get it. I do believe it will not help her daughter Alexandra. Because she knows she beat up her little sister up. It was a little kids thing. But she was violent towards her little sister, which ended up causing her death. It scares me that Alexandra has a daughter now. She a mother, and that doesn't go away. She will hurt her daughter. That patern doesn't go away.

  • Child was def abused, but not by her mother...she was abused by her sister, Alex. Who admitted to abusing her sister on camera. Melissa is innocent and was forced to admit to a crime she didn't commit.
