At the Ghazni Court of Appeal in eastern Afghanistan, an old man sentenced to death for murder pleads for his life. The 75-year-old admits to having killed a relative. Under the strict interpretation of Islamic sharia law ordered by the Taliban's supreme leader, he faces public execution -- with the sentence carried out by a relative of his victim. AFP had rare access to a court in Ghazni to see how sharia justice is being administered since the Taliban returned to power in August 2021.

  • For the readers of this comment, I'd like to clarify a few things: - Sharia law assumes people are innocent until proven guilty by clear evidence or overwhelming testimony. The Islamic Sharia laws are fairly easy to understand, and therefore no lawyer is often needed. Lawyers are a "right" in Western societies because your laws, court systems, and justice officials are laced with corruption and contrived complexity. - Sharia court proceedings are quick and decisive to minimize anguish over looming sentences. In the United States, prisoners can be kept on death row for decades, in the perpetual anguish between life and death. What shameful narration and choice of words. Shame on your, for misrepresenting these people's wishes, desires, religion and tradition. Shame on you for expending no effort to understand the reason why these people believe what they believe and do what they do. You display clips of judges explaining their viewpoints, and immediately criticize them with no basis, nor respect for the culture in which, and for which, they operate. As long as biased media outlets such as yours exist, people and communities across the globe will fail to recognize,, understand, and ultimately respect each other.

    • Sharia actually has strict requirements for providing acceptable proof as well. It is more direct. The punishments are severe and fast-tracked/immediate relative to Western ones. However, mercy is heavily emphasized on the part of all those involved, apart from the judges who must dispense the ruling of the law once a matter is set before them, they only consider the facts. There's no concept of going past a few days or weeks at the latest.

Zakir clearly said that non muslims should not be allowed to have places of worship in shariya countries but non muslims countries should build mosque. The statement sounds hypocritical. One Muslim lawyer agreed to the life imprisonment sentence to appease the unjust ruling. The parents of the murdered students and teacher have to be traumatized for the rest of their natural life. add insult to injury one of his defense team was laughing with the mass murderer.

  • The difference between English Common Law and Shariah with respect to retributive justice is that under English Common Law a person found guilty of first degree murder has to be punished by state or forgiven by state. Under the Shariah as applied in Pakistan a person guilty of first degree murder has to be punished by state or he can also be forgiven by the legal heirs or deceased or matter can also be compromised with punishment of Diyat blood money, in Shariah applied by Taliban in Afghanistan the Taliban give an option to the legal heirs of the deceased to actually execute the guilty person under supervision or compromise or for give. Since 1800 we have been following in Pakistan English Common Law and since 1980s same has been coupled with Shariah and since introduction of Shariah there has been only one dacoit and murderer Mr. TAHIR Khan who was forgiven by mr. General Pervez Musharaf as President of Pakistan to please Mr. Tony Blair. If the narrator is talking about retributive justice to be an extreme form of Shariah than she is mistaken same doctrines exist in English Common Law, American Civil Law, Russian Criminal Code and Chinese Criminal Code. So BBC should get mature when reporting on Shariah.

Its also in Torah , Bible and off course Quran which is labeled only for shria law .   • Once a man was up in a tree plucking fruit when he slipped and fell to the ground. He fell on an An unfortunate bystander who was killed by the impact of the fall. The wife of the man who died demanded the dead penalty for the tree climber under the AN EYE FOR AN EYE CODE OF JUSTICE. The judge tried to reason with the widow that he had not intentionally murdered her husband and that it was an accident. But the lady was stubborn and demanded the tree climber’s death as was her right under muslim law. The judge thought long and hard and then gave his verdict. He sentenced the tree climber to death but he could only be killed in the same way that he had killed the widow’s husband. The only way he could be put to death was by the widow climbing up the same tree and falling on him just as he had slipped and fallen and killed the other man. Needless to say that the man was set free when the widow was unable to comply.

  • France has plenty of laws and many constitutions, it hasn't stopped their decline, has it? The truth is that laws are preceded by the people who have internalized their morals, the laws merely being an after-the-fact documentation of the sensus populum. This is why you can have French laws in places where people are not French, and those laws will just collect dust as people in power select what laws are convenient to enforce; and in France having people step on its magical dirt won't make them suddenly secular and fearful of French laws.
