Come with me to college! Tonight I’ll be broadcasting live as I teach a class on Law and Social Media at an unnamed university. I’m going to weave in all the cases we’ve been talking about, like Alex Murdaugh, Karen Read, Michelle Troconis and Bryan Kohberger.
I am so excited to do this talk because I have been thinking about this topic for months. I am convinced that social media is radically transforming justice as we know it, and unless lawyers and judges recognize and adapt to the changes, we are putting our justice system in peril.
We’re starting a little early - 6:45 pm Eastern. Please be gracious with me on the start time, because I don’t know exactly how this will all work. But I’m really grateful to have an opportunity to speak and excited to be allowed to bring you with me.
(The university has asked to remain unnamed. Not sure the exact reason, but I’m just going to tell myself they are worried about paparazzi. 🤣 🤣 🤣 🤣 🤣 🤣).

  • Transparency stops conspiracy theories. The public deserves the whole truth. All court proceedings should be open to the public, in person, and on social media. Even federal courts.

    • You’re so right. The popular cases with the most conspiracy theories are the ones who are limiting or have limited public access, and then had even slightly fishy things come out publicly. I don’t think many courts have figure me out how to be transparent while also protecting witnesses to the degree that it protects rights to a fair trial. They don’t have to completely hinder transparency to allow for that. It’s like many courts don’t want to change the status quo due to the effort it takes to navigate it. I’ve personally grown a lot since I’ve had the opportunity to actually see how the court systems work in the U.S. Everyone should have that opportunity.

    • ​@Rae777 Well said. Judge Jennifer Darrow (Daryl Brooks trial) had some interesting things to say about why it's important to broadcast live trials... I believe it was in her closing statements on the "eye- drop murder" trial of Jessy Kurczewski. ❤

  • When I was a new lawyer, my mentor asked if I’d watched the OJ trial. I snobbishly said NO. Big mistake he said bc juries from that point on would be evaluating the proceedings through that lens. I never made that mistake again. Good on you for teaching these would-be lawyers a most valuable lesson. Fabulous presentation 👏👏

  • Thank you for addressing this!!!! Attorneys are doing themselves a disservice if they aren’t using social media or at least assigning people to monitor what’s being said. It would be like ignoring a front page full color article in the New York Times. It’s not going away so take advantage or the other side will!

  • I am in Canada and have pretty much been aware of Alex since the boating accident, and it just got wilder from then. I am more surprised it wasn't followed more closely until the murders of Paul and Maggie.

    • it was supposed to be Alex, and pronounced as such but accordong to little brother they couldnt pronounce Alex, which is where thw ale'ich comes in. im curious, lady from Candana how did you hear about him after the boay incident? do you have a summer home out there or something? or did you maybe hear of him after the murder? sorry im not trying to bust youre chops, just curioso.

    • Sure , no chops busted here. There had been several KZhead videos that spotlighted the family. They were in regards to how Paul ( and the family) were treated regarding the boating tragedy. They felt that he was getting away with manslaughter because of his family connection. Then, a series of youtubes emerged over time talking about the housekeeper and the possible connection to Stephen's death. So, I was aware of who Alex and his family were..

  • Back when my kids were in middle and high school, the schools monitored social media. I believe the schools were hoping to identify students or others who spoke of violence against themselves, the school, other students, or personnel and avert a potential tragedy. If schools monitor the social climate via social media, it stands to reason trial attorneys could benefit from also doing so.

  • This is some really prescient stuff Lee. I’ve had thoughts about this too, and when I thought about is, I’ve noticed defence teams going to extraordinary lengths in order to combat social media, case in point, Adelson lawyer going on social media circuit and the Koberger lawyer going to extraordinary lengths to survey then influence the jury pool

    • Yes, Amber Heard and her lawyer also went on shows. I don't remember the timeline, if it was before during or after the trial. What I look for are the professional PR and the trolls (family and friends?). They are particularly noticeable in the videos about the shooting on the "Rust" movie set. There was a lot of misdirection and misinformation being promoted right from the start on that case.

  • I know there's some concern that streaming trials leads to things like the b0mb threat that was called into the courthouse during the Murdaugh trial, or the Reddit post by someone claiming to be a juror during... Gosh, was it Depp v Heard or was it Paltrow? But my perspective is that if *all* trials are streaming, no one trial is going to get the kind of public focus that is possible when only a handful of trials are streaming at any one time. Especially if the quality of most of the streams is decent.

  • I agree all trials should be televised. As far as social media, just like the news these days only watch those who you know post the facts. Having said that i have been watching murder trials for the past 2 years and im shocked the variance in procedures, what is let in as evidence and what is left out, hear say is sometimes okay and other times not, etc. However, Im thrilled when i see judges and attorneys who are professional and do a fantastic job as they should. We also see the corruption unfold before our eyes. All in all i love social media and trials for better transparency. Love you Lee! You do a fantastic job and you are my go to channel!

  • My best friend had the chance of a lifetime for a lawyer, she argued a case before the Supreme Court! Um, some of the more elderly judges clearly were nodding off...so perhaps they have many reasons for not televisng the proceedings.

  • Very interesting discussion. The thing that gave me the goosebumps is when she wonders about the rules of evidence: if she, or lawyers, cannot be sure that the rules of evidence are as they should, no more stringent, no less stringent than they should be... what are we -as a society- doing?

  • I am glad you alerted students to monitor Chat in law and crime, or Court TV. To get an idea what the Jury maybe thinking..even if lawyers gagged, I've watched say Court TV, have talking heads discuss, Prosecution effectiveness.,how good lawyer doing. But didn't bother to read chats, the soap opera group..then surprised at Jury verdict. Like 7y ago..think talking heads wised up...yes I've watched trials for 7y.. now as you say, free focus group..

  • The public public needs access to more true facts and the jury should have access to some information the public already knows. In the Scott Peterson case, for some reason the jury never heard the testimony of several witnesses that saw Lacy walking the dog. It was public information in the media (the police didn’t report all the facts). If it didn’t fit their case they left it out, in my opinion. Now, the Innocence Project took his case. They also never looked for the van that the robbers used to rob the house across the street. Ok I just watched it all over again!

  • The justice system in the south is so much like this one .He ran the 3 counties and made lots of money and power in all that was happening in that area for 4 generations .If not for the phone and car on star DATA he might have gotten away with his murders.
