Most of the time, powerful people pay off someone claiming to report a story (real or made up) about the person running for office or a celebrity rather than have the story printed. One problem with this whole trial. Confidentiality agreements AREN'T illegal.
It is illegal to not disclose campaign spending, it is illegal to falsify documents hiding the payments as legal expenses, it is illegal to not pay the proper taxes as you lied about the payments. He is going to jail.
Nobody is arguing they are. Now falsifying business records to hide reimbursement payments to their lawyer to affect an election is illegal and why Trump's in court right now.
