Toronto drivers can expect mandatory breathalyzers for every GTA traffic stop

Ontario Provincial Police (OPP) are taking steps to combat what they say is a spike in impaired driving charges in the Toronto-area.
The OPP says it will now demand a mandatory breath sample from drivers for every traffic stop in the Greater Toronto Area (GTA).
Data shows impaired driving charges are up almost 30 per cent from five years ago in the GTA, meaning 11,000 impaired driving charges last year compared to more than 8,000 in 2019.
There has also been a dramatic increase in collisions so far this year - around 50 per cent more - compared with the same time frame five years ago, police say.
Caryn Lieberman has more on the move by Ontario’s provincial police force.

    • It isnt. you need cause or a warrant to search in canada. (Or violate phippa for that matter) And courts have determined that even using a sniffer dog without cause constitutes an illegal searc, and any evidence gathered would be inadmissible in court. at a traffic stop you would need justified suspicions that the driver is intoxicated before searching them in such a manner. if the charter was properly applied, this wouldnt hold up in court (it would depend on the political temperament of judges at the time though obviously) Would be nice if global did its job as news and provided context in this report though, instead of just shilling for the establishment as is their preference

    • @jumbome7420 no it isnt. This is in flux currently legally, like c46 related to this issue and many legal experts expressed charter concerns. So far the surpreme court in 2023 has just determined that it is expressly illegal for the police to do so on private property but beyond that is kind of still in a legal grey area (wouldnt be surprising if the courts end up firmly ruling against the charter as the courts are kinda stacked by trudeau at this point and highly politicized (not to say harpers appointees are all titans of liberty. Brown was probably the best one but resigned in 2023 and is replaced by another shill)

  • That's just a small part. If you drive anywhere, up to 2 hours after you drive, the pigs can come and take a breath test, and if you have been drinking, you will be charged with drunk driving. So if you drive home ,say after work and have a couple of beers. You can be charged with drinking and driving! So instead, just smoke crack!!

  • How about impaired due to drugs, is there screening for that as well? People could be impaired because they are high on drugs like marijuana etc....There should be mandatory test and screening for drugs as well to deter people from driving high.

  • Alright then test ALL emergency personnel before and after their shift and release to the public then. I don't get how pulling me over for a blown tail light would necessitate a breathalyzer without probable cause.

    • Forget a blown tail light. I was pulled over for being out after midnight. No infractions or tickets or asking for my license ... just a random breathalyzer (but not at a check stop).

  • Ahhh..the age old question from what I read in comments, "where do my rights end and yours begin"? From what I know(maybe someone with a legal background can weigh in?) There always were laws to address drunk driving in the criminal code and highway traffic act. The question really becomes one of entrapment. In the US you're not required to submit to a checkstop, in canada we made it manatory, but as far as i know, the original laws were still on the books, as were the laws governing entrapment. From what this news story suggests, the OPP has either found a way to circumvent, or even ignore, what is required of a driver when stopped according to the HTA. All other provinces, as far as I am aware, if not a checkstop, breathalyzer is required based upon a probable suspicion of the officer. So again, entrapment? Or where do my rights end and yours begin becomes the question.

  • If pulled over for no reason and requested a breath test, is it within your right to ask police officer to prove to you that the mouth piece was just freshly unpacked and not previously used or contaminated. This is to assure objectivity of the test and prevent transfer of infectional diseases

  • so public safety ministers know where people start drinking and driving from pubs and bars . let them get behind wheel go crash ? . or stop them somewhere else ? why not check drivers out side pubs and bars before they get behind the wheel and drive off . hire more police . there will be more police jobs .one police officer out side every pub and bar ? to prevent ''DEATH ''. and there is no procedure of law that is keeping an eye on off duty police officers going to pubs and bars get caught and letting each other go . who watch the watchers ?
