I'm probably wrong, and I apologize if I am, yet I find myself wondering if SCOTUS is simply using this case to answer all of these questions here and now. Absurd and otherwise, to prevent future SCOTUS from having to adjudicate with potentially less clearly defined violations. Since the court uses the text, history, and tradition of the laws to try to remain consistent then it behooves the office to rule out and decide these matters as much as they can, so this isn't brought to them 50 more times with simple variations of the claims. Hammer them out now and he will be facing the trial clear and clean. Maybe I am way off base though? (sincerely)

History has shown us very few cases of acting or former presidents questioning their actions , intent & motivation to defend our constitution. Therefore such rare occasions must be presented to the people on case by case basis & treated without delay .. Presidential Immunity questions are important enough to be treated case by case & expeditiously . "Any action by an acting or former president commited with malicious intent will disqualify him instantly from presidential immunity." All acting and former presidents should be held accountable to fulfilling their oath of office. Given the concessions that Sauer made, why could Judge Chutkan not just move ahead with the case and allow appeals to sort out the final outcome?
