It is also to be noted that LG appointed by Modi ji, who sanctioned and made amendments in the liquor policy, which were duly accepted by Delhi government, has neither been arrested nor issued any notices or included in inquiry in any manner. It's first time happening in India and against all the set principles of jurisprudence where the inquiry begins with the officers who notify the policy and allot tenders.

Hardly an expert, she omits a very very important fact, the change of the tax on the liquor sales and flow back!!
She is not aware about the laws even... section 45 of the pmla sets two conditions to be satisfied before granting bail and second condition is that court have to see whether an offence has been committed or not?? And the same question is of trial. Thats why it is most difficult to get bail. There is no quastion of evading the summon raised by any court till the date. Read judgement titled as Arvind kejriwal Vs. ED. And the truth is kejriwal is arrested just because of witness statements nothing more then that. And main thing is the allegations of favoritism were leveled by an ex IAS officer after getting retired. Tell this mam when we talk about complaint filed by ed under section 44 is equivalent to chargesheet in normal case.

Whatever she said is right. But she didn't mention a few other things. Such as, the Delhi chief secretary had raised concerns and discrepancies in the policy. After multiple flaggings to the government, he sent the report to Lt. Governor. He had also mentioned in the report that taxation rates were altered AFTER giving out tenders, which is an unfair policy. The vigilance secretary of Delhi government also raised red flags in excise department decisions. After the complaint file was sent to Lt. Governor, the office of vigilance secretary was opened at night and searches were conducted without his knowledge. The vigilance secretary was also transferred overnight without assigning any reasons. Delhi government ministers refused to debate the issue in Delhi legislative assembly. Then there was a sting operation in which two people close to Manish Sisodia were heard speaking about commissions given to AAP leaders. After all these things, Lt. Governor demanded a probe. The PMLA court allowed the case to be registered only after going through the documents, reports and preliminary notes.

Correcting facts: If Kejriwal would have gone in any single summon by ED, he would have been arrested back then. . Kejriwal did not apply for bail yet. He said: Keep me jailed as long as ED wish to, but people should know that it's all dirty politics. . She did not mention that electoral bond purchased by Reddy (whose stated against kejriwal) got bail after donating 55 crore to BJP.

The wrong doing i.e. loss to Delhi treasury was mentioned in a report submitted by the Delhi chief secretary to the LG, after which LG odered CBI to investigate the matter. Further, it was alleged that the new liquor policy gave huge benefits to the liquor sellers at the cost of Delhi treasury and the liquor lobby paid bribes to AAP party for formulating such policy which gave them such huge benefits. It is alleged that AAP party used this bribe money in Goa and Punjab elections.

She is misleading PMLA is not un-bailable - According to Section 45 of the PMLA, bail can be granted to an accused in a money laundering case only if twin conditions are satisfied - there should be prima facie satisfaction that the accused has not committed the offence and that he is not likely to commit any offence while on bail.
