Ya. The judge is biased. Lawyer is right on this. If the judge doesn't know hindi, he must transfer the case to another judge or have a translator assigned as per the law.

Secondly, the lawyer was clear that they can use the translator if the judge doesn't understand Hindi, he's right there as per procedure! This is just a case of ego!

There is a clear difference between Understanding language and able to communicate in that language. I understand Punjabi, bihari, and kumaoni, doesn't necessarily mean I can speak them.
I can understand English movies word by word sense by sense but everytime I have to talk to someone in English I couldn't totally express myself as I can do in Hindi.

As per article 348(1)(a), the high court proceedings should be in English. This lawyer made a joke of himself. Probably he got demoted to a district court after this nonsense.

@@yujirohanma3428 By default, it's English. Other languages only for proceedings if authorised and allowed. If someone wants to argue in Hindi before a non Hindi Speaking Judge in HC, they have to inform the court beforehand for a translator..

The lawyer is logically correct here.... Since the judge doesn't understand Hindi and the lawyer isn't good at English...he only asked for a translator... There is a proper translator provided in a lot of cases... Given the circumstances he isn't that wrong.... And at the end both of them have their egos involved.
When lawyer doesn't know rules, it will happen. He has to intimate the court before the proceedings. Lack of knowledge will result in judgement 😅.
If this was happened in Kerala count and told to speak in English and not in Malayalam, then see what malayalis will do ... That's why Kerala is safe for their own people and don't allow any outsiders nonsense in Kerala......

You go to a North state and speak in whatever language you want. See how many people care. I will tell you - no body would even look at you. They will just mind their own business, unlike the South where they make a very big deal out of it.

@@baldsoobinhair No ,you have no idea .Once irritated, a judge can dampen your chance in appeal by writing down an adverse order in detail .The Supreme Court just being an appellate Court very rarely admits appeal against the order of High Court .
I am a Tamilan. All local languages should be allowed in the state courts. They must appoint translater if the judge doesn't know the local language. Similarly don't impose Hindi in any states in any forms.
That's why we need one language.. Don't you all South Indians think.. because of you we don't have our national language..we need one language so people from all states can communicate with each ... every body wants to preserve their mother tongue which is good...but please support for one national language also

Otherwise not allowed. You need special consent of both governor and president to speak other languages as medium in the court.

Not in High court or Supreme Court Article 348(1)(a) of the Constitution of India states that all proceedings in the Supreme Court and in every High Court, shall be in English language.

Judge’s name is Bajantri. He was transferred from Karnataka High Court to Patna High Court. For the uninitiated, the court language in all High courts in India is English and it’s not the local language. If the judge cannot understand Hindi, he cannot be forced to hear arguments in Hindi and expect him to pass orders based on that more so, when the court language is English.
The advocate is saying there are translators in the judiciary for 50+ years. If u don't understand then use a translator. They are getting their payment then use them. I don't understand English and u are telling me to submit my argument in English.

@@Sanbruce. Using a translator is not practically possible. The judges are already bogged down with a lot of work. Using a translator would further delay the process of justice. Later, people will end up blaming the judge for being slow.

Use English as common-language ... India is a multi-language-country,. Avoid putting Hindi people to South-India, avoid non0-hindi people to hindi-land. USE LOCAL in north/south/east/west
