The prison kind of lets Mega Mind escape, because he is a little more of a misguided menace than a real threat to society and his main hostage is the only one (besides Metro-Man) that sees him as a fairly predictable individual that would never actually kill anybody, so he is kind of a talking Wily Cayote in alien form, without the actual purpose for obsessing himself over a lifetime adversary, which he deludes himself into thinking that he does. Metro man planned to make everyone think that he was dead, and Mega Mind never actual expected to make a killing blow to his opponent, so this is more accidental on Mega Mind's part than readily intentional, especially since he thought that he was going to play the Villain vs Hero trope forever and because he got so used to it, he never really have revenge on his mind, even if it appeared to be the case to everyone in the audience, so that murder charge does not really count.
This is how they can make Megamind they should make a Metro man show maybe that can be good

Megamind may have been a supergenius terrorist, but he showed that he can change. And he did. I say, as a member of the jury, for saving Metro City, that he be pardoned. And he planned for his battle to end in his defeat, perhaps a sign that he was bored of villainy and was just giving up. Hal, however, deserves death. He definitely took many lives with the rolling copper ball and the laser signature. I never thought that you'd watch the apparent trainwreck that is Megamind vs the Doom Syndicate.
