A California father's outrage is on full view as he's told his entire family is to be booted from an overbooked Delta flight. A flight attendant actually told the Orange County couple that their kids could be taken away if they didn't surrender their seats. "You'll be committing a federal offense," the attendant said in cell phone video of the incident. "You and your wife will be in jail and your kids will be put in foster care." It happened aboard a flight from Hawaii to Los Angeles last month. #InsideEdition

    • They have to to operate successfully. Only booking to 100% capacity then no shows could result in the plane being too empty to make it worth travelling. Large Hotels tend to do the same thing around Xmas and big local graduations, they can't risk running at anything less than virtually full capacity. It doesn't make business sense as you leave yourself open to being unprofitable. If they oversell to 120% capacity and 20% miss the flight or cancel for whatever reason, they can still fly full. Sounds odd but most big venues/travel companies all oversell. It's a very common business model.

They should’ve politely offered to try and get them another flight and at least offer to pay for their hotel. Jeez.

  • I remember this story. Back then, we were planning a trip to Hawaii. Our kids weren't infants, but THIS story convinced us not to fly Delta. We never flew Delta for any of our family vacations. The gall of that flight attendant to threaten the family like that. Unbelievable.

    • convinced you not to fly delta? it shouldn't. the airline industry in general is riddled with bad pr, you'll find similar incidents (and even worse ones) with any airline. what happened here sucks, but you can get that treatment on any airline

  • This is the RUDEST FLIGHT ATTENDANT I've ever seen! She literally makes a whole family with infants go off the plane because of FOUR OTHER PASSGENGERS?! She shouldn't even be a flight attendant after threatening them to ''Get off the plane or else we will both put you in jail and take your children to a foster home!'' Like what the hell ask somebody else to leave their seat. This is the worst flight attendant I've ever seen.

    • They took a seat they didn't have a ticket for to put their baby, they weren't asked to leave until they refused to surrender a seat they didn't have a right to...overbooking was not the reason, stolen seat was, the family is 100% at fault

  • If a person buys a seat on a flight , and that person doesn’t show up, the reservation is canceled and the seat goes back into inventory. This couldn’t have been handled any worse by the airline though. Threatening them with jail, and taking their kids was ridiculous.

    • No amount of apologizing or free 1st class seats to any destination would rectify the gross injustice that was handed down to this family by that single flight attendant. I do hope however they did seek Justice by suing her for the the threat of taking their children away and putting them in and Foster care and the airline themselves for harassment and abandoning them in an empty Airport with nothing open at 12am.

And what we’ve gotten so far, yes that seems to be the case. They still had the right to the ticket, they just happened to use it on someone else (their infant). The airline just didn’t check that and immediately thought it was their right to deboard them

    • @@AOTheKidd Was the name of the teenager and the name of the child in the seat First and Last the same?: If not the passanger on that ticket DID NOT show up for the flight the ticket is VOID as it is only good for the EXACT passanger it was booked for. Who said the airline DID NOT check it the infant was booked as a LAP child that is how they got on board.

    • @@q2-d247 the seat wasn't used for an earlier flight. The son got on an earlier flight which was payed for separately and said ticket was used for the two year old. I imagine as the names didn't align, and common sense was chucked out the window...that was the reasoning behind the airlines decision to remove them all unfairly. It doesn't defeat the point in anyway that the family had been horrifically treated and threatened.

    • Techhniquelly you did not pay for the seat unless you reserved it which cost extra. The normal flight ticket is you pay to board the plane but that's it rather it's the same flight or next. Also, the reservation of the seat is reserved under the person's name that the seat was purchased for.

    • They didn’t pay for the seat. They paid for a ticket for their kid who then moved to a different flight, which means that the “seat” that was paid for also was moved to that other flight. They had not paid for this seat. It was an infant in arms, which is free because they don’t take a seat. So if they wanted the seat, they would pay another fair for the seat.

  • After we purchased our tickets 6 months inadvance of our vacation from Delta Airlines our daughters seat was overbooked on our flight home. Being a minor we had an issue with this until another passenger who happened to overhere the concern and offered to give up his seat for her, then the Delta Airlines rep in Atlanta had an issue with him offering to help. Our family had been flying with Delta Airlines for over 30 years without issue however we will never fly with them again. Please take your Sky Miles back we will never use them. ❤ Sincerely B.   • When I was a student my flight from Bern to the UK was overbooked. The flight attendants looked for volunteers to get into another flight. I got a few £$€100 equivalent in franc Suisse in compensation and a coupon to eat at a restaurant. I only had to wait like 2-3H extra for it. Since I was a student, I had plenty of time to waste so I took the deal Not of a bad deal.

    • I mean yes technically she's right, flight attendants have fairly broad leeway in what they can lawfully demand and failing to heed lawful demands from flight crew can be a federal crime. And yes, they have every right to take that seat, read the fine print the ticket only applies to the name on the ticket. Hence Joe Smith, Sally smith, Jerry smith individually rather then a single ticket for x seats under the familial name. Just don't fly unless you have to honestly, it's horrible for the environment and has been a crooked industry since it's inception.

  • When boarding, who checked the boarding passes and allocated each passenger to their assigned seat? If the person whose name was on the ticket did not board the flight the ticket cannot be transferred to a sibling. This should have been sorted out during boarding and not by threatening with jail! Things shouldn't have ended up like this!

  • The flight attendant absolutely shouldn't have threatened jail, putting herself and the airline in the wrong. Instead she should have explained that a seat allocation can't be transferred by the person paying for it, to another passenger - this is well established law. The man had plainly booked two seats between his three children; the youngest child must have been booked as a lap passenger. When the teenage son managed to get a separate booking on another flight, the father mistakenly thought that this seat could be transferred, by himself, to his youngest child. I think the man backed down in the end because he knew he'd tried to pull a bit of a fast one. He'd certainly have lost in court if he'd sued over the seat allocation. But he'd probably have won compensation because of the flight attendant making threats about jail and foster care.

  • Ive never seen that happen before. I came back from Hawaii to Minnesota and my husband and I almost got bumped off for overboarding. But we never were forced like that. They at least asked volunteers with a 1000 gift card and a stay at a hotel. Unfortunately i heard if you dont volunteer they wont give you anything. Thats insane.

    • They do tell em. But if that standby passenger didn't get onto their flight because of a delay or a late flight, it's not the passengers fault, so Delta would have to accommodate them. But i do agree that the issue in the video is wrong.

    • Airlines will always overbook seats, but usually when this happens, they usually offer things for someone on the flight to give up their seats. Usually they offer cash, higher and higher until someone gives up their seat.
