You’d never win it in court, the law doesn’t state the the careless operation is held to the road. Carelessly operating it in public property is enough. It’s a crap ticket, and DNR would be better servered to make friends out of this and get good PR , but it is valid.

@@franksmith8210 that's the point of taking it to court. we all know they were the only ones there and no other parties were unwillingly involved. the spirit of the law is to protect grandma and/or a van full of kids from getting t-boned by out of control road shenighans. I could see the cop having a valid point if it were summer and they were zipping around on jet skis close to other boats, but that cop was WAY out of line given the circumstances.
You can fight and win against a valid ticket. If the law contains any ambiguity or is poorly defined then you can get it thrown out because not every officer would have the same definition for it and while that officer gave a ticket another might not have.

@Duner250R No harm in driving around the same places! Here in Wisco we have races on Lake Winnebago all the time! The DNR even plows roads and puts bridges over cracks! This is a clear cut case of a DNR officer on a slow day having to flex on someone. Go to court and a Judge will dismiss quickly. Tell them its the Ice or the local Walmart parking lot!

@Duner250R if your vehicle does go through the ice up here in Minnesota there are fines every day your vehicle is in the water but it happens all the time and there are companies that specialize in pulling cars, trucks, snowmobiles, ice house you name it out of frozen lakes.
Perfect example of being officious. They obviously closed off what they were doing and being as careful as possible to not hurt anyone. That officer just got them on a technicality just because he can on a whim. People who strive to be in positions of power just to put the hammer down on trivial things don’t deserve those positions.

It's actually not even a technicality, the officer is actually wrong. They were off-roading on public water, on a temporary track of their own creation. It's not illegal to practice off-road driving maneuvers off-road or on private roadways in Canada. Furthermore, their track is a temporary track on a temporary sruface, so they have not caused any damage to any kind of public property. Their clearing of snow is analagous to clearing snow off a lake for a hockey rink and less damaging to the surface than drilling a bunch of holes for a village of ice fishing huts. But even then it's a self regenerating, temporary surface. This was the safest way for them to practice these driving techniques that they could have thought of. The officer is wrong.

It really depends on the state, I'm guessing that it applies to any area that the public can access. Since he specifically mentioned that it was a public space, and didn't necessarily refer to a road. At least it wasn't reckless driving.
your not insured soon as you touch the ice with a car so how then can inforce laws for vehicles where there is no roadway, makes no sense. its just harassment.
Its public property so the law can apply, BUT because its not on the road, the common law standards cannot be applied. So if it was actually something bad (like drifting 2 feet from a ice house) then it can apply, but how they did it here means it doesn't. You are allowed the same stuff for parking lots in the middle of the night, thats why may towns have time laws for parking lots.

This has happened to me. I was boofin around on the ice. Some ice shack karen called the cops. I was already off the ice and parked at a friend's house down the road. The cop had to drive around and look for a vehicle that fit my description and then have me a ticket for reckless driving. Took it to court, cop didn't show ofc cuz they never do and it was dropped.
cops have different dates they can schedule your court date. Some they plan on not showing up and everyone gets off. Other dates they plan on getting convictions and they show up.

Yup unless you even admitted to being on the ice he didn't witness it so that ticket wouldn't stick at all. The witness would have to show to court, in fact why did you show to court. In stuff like this call the DA's office directly and talk to them. They will usually take a look and drop the case, they too don't want more on the docket then needs to be. I just did that for a speeding citation I receive din another State, DA's office was awesome they just wanted the money and I knew it and they were like yeah just pay us now over the phone and it's done...okay. Play the game, I called and made a court date 3 months out. A week before I called and postponed it, another month out, then I called a week before again and talked to the clerk gal who was nice and gave me the DA's number and they were willing to just have me pay and drop it. Done...LOL
A road citation in the middle of a lake? I'd definitely fight that one in court. Minus being on 2 wheels, it looked to me like you guys did everything possible to ensure a safe environment to screw around on the ice.
In the UK road traffic laws apply to anywhere with public access, so places like supermarket car parks or open spaces are still covered. Land has to be private with restricted access if you want to do your thing, I suspect most first world countries have similar legislation.

Having been in Law Enforcement years ago, I think this DNR Officer is really splitting hairs. Clearly, there was no risk to other members of the public (I could not see anyone else there) & it appears to be a fairly remote location. I would much rather see you guys doing this stuff out & away from the public (ie. not doing it on the streets or parking lots). We always worked with something called "Officer Discretion" & he does not really appear to be doing so. Yes, he could cite operational violations & maybe some others for "risk to the public" - but seriously, it just is not worth it - he needs to learn to pick his battles & this should not be one. Now, if there were others in the area ice fishing, etc and it was risking their safety or disturbing them (ie. he got a complaint), that would be different. Personally, I would just tell you to watch the ice thickness & if others showed up to ice fish, I would ask you to shut it down. Until then, have fun & stay safe! By the way - I don't know how the guy in the quad didn't toss his cookies after doing that wild donut spin! Crazy (cool too lol). Wishing you all a safe & Merry Christmas!

@@Subvaries You can plow snow all day every day on public lakes. You can also operate snowmobiles on most lakes. My Grandmother lake in Michigan you could not as no motor boats also applied to snow mobiles.

Some places treat ice like roads, some don't, in Michigan you can get tickets on the ice, but they are like a boat ticket. You can get that dropped if you tell the magistrate what you were doing, and that you had the area clearly marked and there was nobody near you for 5 miles. (Ask for defective equipment as a secondary defense)

If the car crashes through the ice it creates a ton of pollution, and it will endanger any recovery team that has to now pull the wrecked car and your dead body out from under the ice that’s obviously thin enough for vehicles and recovery equipment to crash through. If they wait till it melts then it leaks a lot of oil and gas into the environment, and if they still want to pull it out they now have to use a barge and crane, or at the very least have a scuba diver recover the body… There are other reasons why it may be illegal to drive like that on the lake too. It definitely has consequences for more than just yourself if something goes wrong. Expensive, a waste of time, and dangerous for everyone involved in the situation. The officer has discretion but there are indeed a few legitimate reasons why driving on a lake like this can cause issues for more people than just yourselves. There are designated ice racing lakes for a reason, since they’re known to be thick enough to not be dangerous and they sometimes even have standby recovery equipment for sunken cars.

Even if it’s legal to drive on a lake ice racing like this can be considered illegal due to the fact that it puts much more pressure on the ice than simply driving across. Also, not every frozen lake can be driven on… again, even if the ice seems thick there can be thin spots on some lakes which is the reason why some lakes are not allowed to be driven on. I disagree that you can drive on frozen lakes in most places because that’s literally not true. Most places don’t get ice thick enough to reliably support vehicles. People illegally drive trucks on the lake where I live and there’s always a couple of them that go into the water and require very expensive and dangerous recovery, exactly as I said. Even in the coldest part of where I live only some high up lakes can legally be driven on because not all get enough ice to support a vehicle, and I live in a pretty cold place overall… definitely colder than most places in the USA

Alright man here is what I would do with that DNR officer. Get lawyer and I would have that officer charged with over policing (as he admitted to basically stalking you online) and file for a restraining order so that if he feels the urge to ticket you again he cannot come anywhere near you. There for no future tickets from him. And don't forget to tell him to hit the like button after.

Cops use social media to catch people doing all kinds of shit, from dealing drugs to selling stolen merchandise. To the law, posting on social media is no different than buying an ad in the local paper. If a cop saw an ad in the news about an illegal street racing, they would have every right to go there and bust the racers. However, this was a DNR officer not local or state PD, so he cannot issue a roadway violation anyways. They probably got some kind of park violation for misuse of the facilities without proper permits or something stupid like that. Thing's like that in my area are usually civil fines under $100, no marks on criminal or driving records.

It's general public health and safety. It's also putting a stop to something before the worst happens. This is the issue with humanity at the moment, noone thinks. What if any of them went through the ice, what if any of them did so and then were trapped? Who would be pulling the body out, his friends, or him? I've heard enough horror stories from officers and other emergency workers to know that, even if it's an extremely low chance, doesn't make it a certainty not to happen. But let's put it this way: Put yourself in his shoes. How would you feel if they weren't talked too, and then all of a sudden, they've gone under? And you KNEW you could've stopped it from happening?

That's Minnesota for ya! Here in WI, living in a heavily suburban area, they allowed a plowed track on an area lake for "casual" ice motor bike racing, spikes on the tires and all. Pretty noisy, no one seems to mind, neighbors, cops, DNR other lake users. It's just a given. On another lake in the area the city maintained an ice skating rink. After hours I'd go down and "skate around" with my little Ford Bronco. Drifting around, boot-leg turns, 360s, all kinds a stuff. Again, I was never even spoken to and this was basically right in the heart of the town. Of course that was the mid 70's so things were probably a bit different. Ice bike races still continue to my knowledge.

Crazy! We do all kinds of ice racing/drifting and we've never had DNR come visit us. Honestly, I've never even thought about if it's legal or not... There was no one else around so... I think you could easily fight that ticket. Makes for good TV though, I suppose... Keep up the great work.

Law enforcements finest, he can sit on his ass playing with Instagram, on the clock, and pretend like he is "a public servant who deserves respect for putting his life on the line everyday for his job" He really makes a big difference in our community, if he didn't keep issuing tickets to the cboys, our neighborhood would just got right down the drain.
People always talk about cops putting their life on the line but literally my uncle has been a cop for 35 years in a town of over 20000 has never pulled his service weapon but according to the news and TV every 2 seconds there in a life-and-death situation 90% of the time they're sitting in their squad car playing on their phone

Ice and water is different when I was in maine they write tickets for riding snowmobiles with cans on the trail but as soon as I was on a frozen lake I was safe dnr guy is just out to get you guys for having fun one of these days I’d love to see the cboys get him back

Couple of things: 1) In Vermont, frozen lakes are considered public highways (speed limit is 55MPH) - I believe these guys are in MN? If so, there's ice racing on lakes there, they are sanctioned but the law *likely* doesn't say the same thing as Vermont, much like New York, where it's a public roadway. 2) Cracking on thick enough ice is normal (12" are minimum for ice racing organizations), 8" (from what I heard in the video at 5:28) would supply you with enough strength for two cars and a truck no problem 2a) Cracking is the ice settling, remember it's (the lake) a giant ice cube 3) Those studs are pretty useless, as one of the guys correctly pointed out when losing the studs on the trailer. Spin those wheel at 50, 60, 70MPH and they are just going to be fender screws into your wheel well (and fender too if they keep going) 3a) Real homemade studded tires require unmounting, bolting them through the tire, remounting and checking for leaks, using a special "slime" to seal them, if necessary 4) Don't ever give up the throttle; you don't let off if you're heading for a snow bank - look where you want the car to go and drive with the throttle Otherwise, carry on, boys.
On Bear Butte Lake in SD something similar happened to me, except we had about 20 people and at least ten vehicles on the ice. No citations were issued, but after being called in by a "concerned citizen" a group of sheriff deputy's pulled up and said we cant be on the ice. We talked to the sheriff himself and after some digging, found out that nobody can issue citations for driving on the ice because you aren't actually in the water. If you break through the ice and a car sinks though, you can then get a fine
Everyone in Minnesota knows they make a big deal of the “thin” ice but there’s literally highways on the lakes up here with trucks and campers

Fun fact: that would never hold up in court 😂 next time the Game Warden cites me for “hunting without a license” as I’m doing 10 mph over the speed limit, I may fight that too.

"He's trying to be nice." No he's not. I've never had issues with law enforcement on lakes in MN. Cars, ATVs, doesn't matter. If you're not being dumb around other people there's no actual reason for them to care.
