Gay Marriage in India
The Supreme Court of India is currently deliberating on a case that could change the course of history for crores of people. The case, which seeks to legalize same-sex marriages in the country, is being hailed as a "seminal issue", and it's clear why. The petitioners argue that denying same-sex couples the right to marry is a violation of their fundamental human rights and dignity. On the other hand, the government believes that legalizing such marriages could lead to a breakdown in societal values. This debate raises important questions about our society and what we stand for. Should everyone have the right to marry the person they love, regardless of their gender? Should we prioritize societal values over human rights and dignity? These are questions that we try to answer in this video.

If legalizing LGBTQ marriages mean that more orphaned children are going to be adopted then I will definitely support this legislation. Edit: Some people pointed out that I am supporting legalizing same sex marriages for the sole cause that they're going to adopt children, and I wouldn't support them otherwise. To them, I just want to say that homosexuality is already decriminalized in India, and marriages in India are mostly important for the sake of building a family, so those who aren't going to adopt can always stay in a live in relationship... Also for those comments who are against this decision, I believe in the concept of live and let live, legalizing it won't affect me, you or anyone in any way, then why be against it? Those who are a part of LGBT community will always be a part of LGBT community, their sexual orientation can't be changed, that's how it works.
I too support this, and this will also help in Population Control as increasing adoption will reduce birth rates to have good control.

A Classical Example of JS Mills harm principle, "Two Consenting" Adults having a choice to be with each other is not a problem- by following that logic, A 16 Year old By law in some countries is a Classified Adult, so if he/she wants to be in a relationship with an 40 year old that, will that be okay? What I find is the hypocrisy of this harm principle, the people advocating for this, "two consenting" crap, will loath around if a situation will be proposed to them on the same tenet of this principle. Why is it that societies that have their values and customs are obliged to surrender before the white man's values?
The thing is, why is this even a concern? Let people live however they want, as long as they're not harming anyone else in the process. But then again, we live in a country where hugging in public or going out on valentine's day is unacceptable whereas the public won't even look twice when a girl gets stabbed to death in public.

In Hinduism, marriage is only described as a union between two souls, not between a man and a woman. The criminalization of homosexuality by British laws is what changed our societies views about the topic. Ancient Hindu societies were more accepting of all different kinds of people.

I'm Nepali, Same-s*x marriage is legal but it is not properly registered, we have a "temporary" register of same-s*x couples. Its like they are "seen" but not recognised if that makes scene. We legalised it in 2008 but there is still some controversy but i think it someday it will be fully legal.(i not sure whether same s*x couples get marrage documents but if not hopefully they will)
I am proud of my Hindu culture and my religion the treats everyone equally. Hinduism always supported homosexuality and considered it very normal. There are several Hindu temples which have carvings that depict both men and women engaging in homosexual acts. Same-sex relations and gender variance have been represented within Hinduism from the vedic times. Even Kama Sutra, a Hindu text detailing the pleasures of sexuality, states that same-sex experience is "to be engaged in and enjoyed for its own sake as one of the arts." My religion gives equal opportunities for everyone to lead their lives happily and respectfully. Hindu religious Scriptures have many such characters and references too. Examples: 1. Agni, the god of fire is married both to the goddess Svaha and the male Moon god Soma with Agni having a receptive role in this relationship 2. Lord Shiva who is the ultimate embodiment of masculinity has also been depicted as Ardha Nareeshwara 3. Lord Vishnu, the protector of the world is clearly depicted as gender-fluid. Lord Vishnu even procreated with Lord Shiva in the Mohini form, resulting in the birth of Lord Ayyappa (The Hari-Hara Putra : Son of Hari and Hara) 4. Lord Krishna also took the form of Mohini in order to marry Aravan to satisfy one of the hero's last requests, according to the Mahabharata. After Aravan's passing, Krishna stayed in the form as the hero's widow for a significant period of mourning 5. Shikhandini, met a yaksha and exchanged genders and remained a man until his death at the battle of Mahabharatha. 6. In Holy book Ramayana, Sri Rama grants hijras the ability to confer certain blessings, the beginning of the badhai tradition 7. Ancient texts of the Brahmana depicts Mitra and Varuna as alternate phases of the moon who join in same-sex relations. On nights of the new moon, Mitra injects his semen into Varuna to start the moon cycle, with the favor returned upon the full moon 8. Bhagavati-devi is considered today to be the goddess of cross-dressing, and more than 5,000 male worshippers dress as women each year for the ritual Chamayavilakku festival in Kollam. So stop disrespecting Hindu culture and religion by making Homophobic comments. anybody who goes against that is a disgrace to Hinduism - A proud Hindu.

In a country where more than 90% population doesn't knows the difference between Gender, Sex and Sexuality its hard to expect the acceptance from society. For Indian Society if anything that crosses the limit of religion and their understanding is unacceptable. Edit:- For those people who really want to know the difference between these 3. Sex:- Assigned by birth(Genitals) Male, Female, Intersex. Gender:- Social Classification, how an individual perceive themselves through their behaviour/sexual expression like CisGender Male/Female and Transgender (Male/Female) Sexuality:- Your sexual attraction. It can be CisGender Male/Female with heterosexual, bisexual, homosexual, pansexual attractions and completely asexual or Transgender with their preferred sexual attractions.
There is no difference between gender and biological sex. Gender is umbrella for human species. Sex is for all species. Gender: Man, woman. Sex- Male and Female. Females include human females (women) and females of other species. Same goes with male being umbrella term including men. Do not fall a pray to woke western liberalism.

Do you think that people should have right to marry person of other caste? Did social acceptance for inter-caste marriage came before law allowed it? Should people marry a person of other caste only after Indian society whole-heatedly accepts inter-caste marriage?
I support intercaste marriage and love marriage But that doesn't means any loafer can marry my sis 😑 Decent person with morden ideology needed

I think it should be legalized. You cannot leave this for society to accept it. Society may take 20,50,100 years to accept same sex marriage because not recognising same sex marriage doesn't affect rights of heterosexual couple at all so they may never think about what same sex couples experience in society whether it is not enjoying rights comes with recognition of marriage or day to day discrimination LGBTQ people face. And not every person belong to LGBTQ community can afford to move abroad so most of them will have to live here only. Legal recognition will lead to social acceptance.

Such Videos are great to expand ones knowledge over a topic. The first part only explains why. It helps us think from various perspectives, not only ours. I hope more people understand that just because they don't see anything doesn't mean there is nothing. Only because your preference is different that doesn't mean your preference is the only one. Let people live the way they want to. It is literally 2023 and people still pretend to get offended by someone else's choice.
As you said if the constitution and law gave them rights to live as they want, we will see rapes cause they want to rape someone, gun violence cause they want to shoot someone. Saying let them be free from these laws to do whatever they want is just stupid 😂😅.

If people think that LGBTQ+ marriages cannot be families, 1. There are couples who don't have kids due to various reasons, are they not a family? 2. There are millions of kids who have been happily living with LGBTQ+ parents in foreign countries, even Indian parents who are adopted, are they not family? 3. With IVF, surrogacy, etc, LGBTQ+ couples CAN have kids, with their own genes. Is the kid not their family? Although it is hard to make change but it doesn't mean we shouldn't.

2:50 - 2:55 Section 377 hasn't been removed from the Indian Penal Code. I urge the researchers, writers along with Mohak to be very careful of the words they are using. The section still exists. The judgment of Navtej Singh Johar v Union of India (2018) only declared that consensual, homosexual sex would not constitute to be an unnatural offence under the said section, thereby, recognising it as a legal act. You can say, in laymen terms, that they decriminalised consensual, homosexual intercourse, i.e. it won't amount to an offence under S. 377 anymore. Also, it isn't an Article as represented in several of the visual frames.

I am from the right side of political spectrum, mostly moderate, and I do support LGBTQIA+ marriage, I believe, marriage should be a choice of two or more people who want to be together legally and have an instrument to protect it through laws. I am more liberal than I am on the right even sometimes people of the right will disown me but I believe in science more than in sociology. Also marriage is a personal choice and doesn't harm me in any way. I also know that India is not yet ready, we still have other major issues to tackle, unemployment, population, high level of competition, infrastructure and religion. We first need to eradicate poverty become a middle income country then automatically people will change. jab log bachat ke jagah comfort rakhenge tab log badlenge.

Sex is very much personal thing. So what's the fuzz about legalization of marriage? Our constitution gives us our basic rights to almost everything as long we don't cause nuisance to the society, so who the hell r we to judge people how they wanna express their sexuality?
Thanks for having this discussion in the Indian context. Lots of people don't know how to communicate about these things with their families when their parents and relatives are very conservative. Breaking off relations with your family is a tough and bitter choice. We really need awareness about gender, sexual identity and individual freedom.
Wow. Truely researched and an unbiased perspective. Such an approach is what transforms society. Your contribution is valuable Mohak. Keep it up! One point-- people think it will solve problem of orphans, but sad reality is that already there is much higher demand for adoption than authority and complex systems allow. So the argument of benefits to orphans is sadly weak.
Marriage should be legal in India... Then only awareness in society will be increased...

Honestly speaking I prioritise the moral values of care/harm and fairness/reciprocity over the other three. I am all for legalizing homosexual marriages in India. Our constitution gives us the right to equality and if homosexual people are not guaranteed the right to marry whoever they want it goes against the moral values of our constitution.
