    • @taco trader this is where you need to play off of what the prosecutor says to your advantage as well as trying to get access to any security tapes for your defence. Although, being honest most courts wouldn't even take this case

    • @taco trader take it from a police officer hitting first can be self defence preemptive strikes are used loads, yes you’ll have to prove it was self defence but if you’re honestly in fear for your or someone else’s safety it’s fine to hit first eg if you see someone arguing with your mate and from behind you see the other guy holding some sort of weapon if you hit the guy you’re doing it in self defence of your friend.

    • That’s true but it’s extremely hard to prove, and in this case I get the strong sense that they were both drunk and being aggressive to each other which resulted in jack hitting him after he insulted him. That’s not self defence at all. Insults and arguments are not defences against assault unless in very very specific circumstances. If someone insults you or is aggressive towards you just walk away, it’s not worth getting beaten up or being charged with assault.

I photoshopped my headteacher as adolf hitler and a teacher overheard me talking about it. I got randomly called to his office and he had the photo printed out alongside about 5 other photoshops I’d done of him... was quite awkward but his secretary on the way out whispered to me that he thought they were quite good lol

  • Actually, you can still claim self-defence if you hit first. It's reasonable foresight. As long as you generally believed that you were in danger and the actions that you took (including use of weapons I.E beer bottle) were representative to the danger then you can use it as a defence in court Edit - This is not legal advice

    • This is good but it is actually reasonable belief and not general belief. However, that's besides the point. Be careful of what you say. I assume you are in the field of law and therefore you should understand that wherever you give free legal advice, whoever takes up the advice becomes your client immediately. You are therefore responsible for that individual and you could be sued if anything goes wrong. Which is why you see online lawyers and youtubers who are in the law field always emphasizing that "this is not legal advice".

  • Actually a preemptive strike is legal if you feel you are under threat of being attacked which he said he did. Especially since he only hit him once and nothing else. He should've never been in trouble if he's not lying about it.
