@JoJo-ie8sl Right. I've gotten out of probably three or four tickets for speeding and having a headlight out by just being polite and apologetic. Also helps a lot if you have your s*** together and can pull out your license, registration and insurance super quick.

I once had a "lapse of insurance" because I changed insurances. I didn't notify the DMV, but my old insurance did, so it looked like I had no insurance. I never got a letter in the mail telling me my license was suspended.. drove like that for 2 years without knowing. It happens

Why does every single person think “record this” with their super sophisticated iPhone they fumble for a minute to find the camera app to record in portrait mode like each police car doesn’t have proper recording equipment that cost 20x what their phone costs? And their footage would be allowed into evidence when they can’t use 75% of the encounter cause you only see 10 seconds of what took place? I've watched dozens of videos where drivers are rude, belligerent and disrespectful to traffic cops. Interesting how the results are always the same. The strong willed, bullying tactic NEVER works. I recently blew past an unmarked cruiser, via the median, and was promptly pulled over...of course. I had all my information ready and the first thing I said was, "I really messed up this time, didn't I?" Officer checked my info, told me to chill out and slow down and let me go with a verbal warning.

Conditional threats are not considered threats. She specifically said “IF YOU break my arm, I WILL punch you.” That’s not considered a true threat so no prosecutor would ever go through with that charge. He would’ve had a better chance charging her with battery on a LEO.

Threatening a cop is assault. Actually to do it is aggravated assault.
It was a conditional threat, not a true threat. That charge would never stick.

In this case, the prosecutor would have a good argument that she fully intended on punching the cop if he broke her arm or if she perceived he was hurting her arm too much. The best way to avoid this legal question, and to avoid charges of threatening a police officer, is to not make any kind of threats in the first place. Side note, “true threat” is a poor term for it, as conditional threats can very easily be carried out. It would actually become battery in most jurisdictions. Nowadays, assault is a term used for threatening violence or attempting violence, while battery is a term used when physical contact actually occurs.
That's not true at all. I myself, have an assault on an LEO charge from when I was younger. All I did was threaten to headbutt an officer. 🤷♂️ ~~ And in jail before I bonded out I met someone with the exact same charge, except that he literally kicked an officer in the nuts. We both had the exact same charge. ~~ Aggravated Assault would be like, spitting in the officer's face, putting body fluid on an officer, or repeatedly punching or kicking an officer.

According to federal law if a Police officer orders you out of the car you DO have to obey that order even if your a passenger. However IF your a passenger you not have to ID unless your suspected of a crime!. In this case officers had a right to search due to the arrest and since they found an illegal substance they could claim reasonable suspicion to ask Id from all occupants.
If the driver's license is suspended, then insurance is no longer active. If you look at your insurance policy, it states that the driver must have a VALID license in order for the insurance to be in effect.
Not knowing is no excuse. It’s your responsibility to make sure your license is valid and your car is insured. Adorable dogs, by the way.

I've never had my license suspended, driven without insurance or been ordered to take any kind of driving classes. How can you not know all of these things???? Does the State not notify you of a suspension and that you've been ordered to take classes? I swear, the disrespect among so many of her age group is unbelievable to me. If a cop had told me to get out of my car at that age, he wouldn't have to tell me a 2nd time. Even now at 68, I'm getting out of the car!
The fact that a 21 year-old ignores what a lawful order is proves they simply should not be behind the wheel. Simple as that. She is acting entitled, misbehaving, I perfectly understand why the officer would want her out of the car in case she tries to go. At least this even will teach her some humility.
