Fisker Ocean - Steps to Get Your Money Back
Here is the NCDS link to start your arbitration process:
www.ncdsusa.org/consumers/aut...
Keep in mind, this is a formal proceeding, so be professional and be prepared. Make sure your case addresses the following:
1. The existence of the vehicle problems listed on your claim form.
2. Why you believe the problems represent a manufacturing defect in materials and/or workmanship and are covered by the applicable warranty period.
3. The automotive manufacturer and its authorized servicing dealer and/or representatives have had a reasonable opportunity to repair your vehicle.
4. The number of repairs and days out of service associated with the defect(s) or problems.
5. The defect(s) or problems represent a substantial impairment to USE, VALUE, or SAFETY of your vehicle.
My Fisker works really well, and love the car. Sorry to hear about your experience
Yes, it’s unfortunate. I would much rather Fisker be in great shape and everyone have vehicles that worked. The car is functional, could really be a great vehicle.
I'm so glad they decided in your favor. Fisker has taken advantage of so many people by releasing a vehicle that was incomplete and full of safety problems.
It’s so sad when I think about. This car could have been great.
I have my teleconference scheduled for Monday. The regenerative braking hasn't worked since delivery. I opened my initial case on November 9th and despite multiple promises to send out a tech no one has even contacted me for service. Car has been sitting unused in the driveway for months except to take it around the block to keep the 12v charged. We'll see what happens. Congrats on winning your case. I hope you actually get paid.
Good luck on Monday. Lean into the safety aspect of the regenerative braking not working.
@@EV-365 For sure. The mechanical brakes squeak like crazy now because they were never designed to stop a car that heavy with out regen. A tech told me on the phone it wasn't safe but there's just no way to prove that.
@@justinbukoski1 focus on the main issues and avoid to mention the smaller ones cause people have to listen to you on the phone and their attention span is quite limited. Big points are convincing and as EV 365 pointed out focus on street safety . Avoid to mention you have had used the car cause if you tell such circumstances you shoot yourself in the foot. The counter argument would be instantly : how could you drive on a public street with a car that was not safe Your credibility will be shattered or at least damaged. You have 1 chance only cause time is running up.
@@typxxilps great advice. Stick to the issues that impact usability and safety first and foremost.
How did you case go?
Happy for you! I went through arbitration against BMW and unfortunately lost and I was with an attorney to kudos to you for doing it by yourself and winning
Thanks! Sorry to hear about the BMW. Did you end up selling it?
@@EV-365 No I went through some financial difficulties around the same time so I ended up voluntary repo it but before that I got a 2018 clarity plug-in, hybrid It did ruin my credit, but it was ruined anyways from some other issues, but that was in 2021. My credit is now back to prime I plan on trading in my Clarity for either an ID4 or polestar 2
Hey Raj, Thanks for sharing your story and CONGRATS on your win at arbitration!! Our FOO is fully operational so we don’t seem to have a buyback case to make, but I would if I could despite loving our FOO. Maybe we can do it for a partial buyback on features not delivered…?🤔
EV OG....I've watched all your videos and you have been very reticent to address the myriad of problems many owners are having with Oceans. Sooner or later your vehicle will develop a 12volt problem or FOB doesn't work or bricking, then I'll be waiting to have you tell us again how good customer service is or how special the vehicle makes you feel.
Thanks OG. I don't think this would work for partial buy back due to features not delivered. But one of their three items is value (usability, safety, and value), but it would have to be tied to actual warranty related issues that Fisker has had a chance to repair. If you can do that, it could be worth a shot. Worst case they will not offer an arbitration hearing. But this may be more for small claims court, which is also what folks will need to do if they do not like the result of their arbitration.
@@melvinholland9656someone’s a little emotional
thanks a lot Raj, super helpful. I think I may need to reach out to you to better understand the difference btw your process and Lemon law. I ve been facing issues, mainly the center screen which has been completely dysfunctional for the last 2 weeks, and on and off prior to that
The main difference I can tell is that the NCDS process is governed by the warranty, and the 5 points I mention in the video. Each state has their own lemon law rules. NCDS does take those into consideration with their cases, but it is more about warranty issues that impact driving, safety, value that the company has not been able to resolve after being given ample opportunity.
@@EV-365 thanks Raj.
This is a get in line solution for Fisker creditors. Good luck ...
Thank you for the information. What if Fisker offers to replace your car? They have quite a few, as they sign up new dealerships.
I was wondering the same.
i believe its your choice to get a refund OR a replacement, and i doubt Raj wants a replacement
When you submit the case, you have a few options to choose from...Repurchase, replacement, reimbursement of repairs/expenses. I opted for Repurchase.
Realistically we ALL don’t have features that we paid for. They should at least be looking at the packages that were offered and refunding buyers, but the note holder is liquidating all they can as quick as they can to wipe things clean.
Thanks, showing other Fisker owners the path to at least fight back against a fraudulent company. I'm very pleased you won and hope you get your funds before Fisker disappears.
Thanks! Definitely not out of the woods until Fisker cuts that check!
Raj can you clarify something? Around the 10 minute mark in your video you mention that some owners cars have ceased to function after the claim was filed by the owners. Is Fisker bricking the car intentionally once a claim in ongoing?
No. I think people are either having issues with their 12-volt battery, or software 2.0 was causing an issue with the 12-volt causing it to drain quickly.
so this only applies if your car is bricked and/or has significant issues with drivability? As in, if we're just having minor software issues this would not be the avenue for us right?
Correct, software issues alone would likely not be enough. Unless you can connect those to not being able to drive the car or safety related issues.
Did you get a repurchase yet? They suspended the arbitration program indefinitely. Not sure what the next step is……
Remember that winning an arbitration and getting funds out of an insolvent company are 2 very different things.....
Have to take step 1, to get to step 2. Can't wait for them to go bankrupt before making an effort.
Are you going to post the videos where you documented your issues with this car since delivery? Your other Fisker videos are really positive up until about 3 weeks ago.
The videos with issues are up there. Definitely much further out than 3 weeks ago.
Where? I only see a few videos on your page about the car.
@@EV-365 I'm genuinely curious - where are the videos documenting your issues?
@@mrking58 I sent those into the NCDS. Short 15 - 30 seconds clips. I spoke about those in the last several videos. I had to balance working with Fisker with hopes of repair and piling on Fisker while the rest of KZhead was. Wanted Fisker to succeed and gave them benefit of the doubt so did not want to highlight issues that I was told would be fixed. Unfortunately did not happen so had to go arbitration route. Figure I would help people through the process that have legit issues. The seat sensor issue which kept the vehicle from driving and affecting rear seat air bags and the car being bricked are the main ones I had.
So you aren’t going to post the videos or your actual arbitration award? Seems you’re upset with being left with a depreciated vehicle and you’re looking for a bail out.
What were your list of issues that you argued?
I listed out everything I had in the original case but the main ones were the car not going into gear, automatically shifting into park, seat sensors in the back seat not working, and it ultimately being bricked and completely unusable. But I notes all of the other greatest hits as well: key fob, AC vents, software updates, alerts, cruise control, etc.
@EV-365 Thanks for the info Raj. I have had a long list of problems with my Ocean since delivery. So far only 2 things have truly been addressed. I did have my AC vents replaced and I do have the 2.0 software update. Everything else is sitting in a black hole of non-response with Fisker. Because they addressed the vents and provided 2.0...will it hinder my claim with NCDS? Will the arbitrator say: ….”Fisker has made some efforts” or something like that? I have significant issues still remaining with multiple tickets that touch on driveability, safety and value. Also, my car is not totally dead. It turns on and technically it can be driven. Although I'm hesitant to do so because of other issues that make me feel like safety is a concern or I will be left stranded by the car. It seems like your case was successful because you had no service and the car is bricked. Whereas my car has has some service and it's still driveable. Is it still worth pushing for NCDS or would my situation still have merit and a chance to stand up?
Yes, I think you should take the first step and submit and NCDS will let you know if it qualifies. Yours sounds very similar to me other than you had a couple of successful repairs. Each issue is unique though so if there are issues that keep you from driving safely and Fisker has had ample opportunity to repair, then you atleast have a case worth considering.
Thanks for your update. I am awaiting the arbiters decision. Too bad it has to come to this cause the Ocean could have been a wonderful EV! To this date I am still waiting for a tech to come out and address the various issues with our vehicle.
Raj, Thank you for a very informative presentation. Given that I have not started the process, that Fisker has stated that it does not have sufficient cash to operate thru month end and that the few Fisker employees I have dealt with (trying unsuccessfully to address the problems I have had) have been released, I cannot expect a resolution prior to the lights being turned off. One question: how did you get replacement A/C vents. Mine have been broken for months and Fisker has never responded to my calls, emails, etc. If you are interested in selling, please contact me. Reply
Yes, I will let know once I’m through with the process and know for sure I will not need them or Fisker does not try to claim them.
I really hope they actually pay you for the vehicle. That seems like battle #2.
100%. Fisker is legally bound by the decision so fingers crossed for 30 days.
@@EV-365 Raj any chance we can speak? I sent an email to you on the email for your yt page
@@EV-365 Thank you for your video, very helpful
@@EV-365 not really. They can go bankrupt and you won't get anything 🥰
So have you collected on the decision?
They have 30 days. We’ll see.
So, what's your next car if/when you get your money back?
Hi Raj! Is there a way I could connect to you? I have some specific questions about my case and I will sincerely appreciate any assistance. If you Google my name we should also be able to connect without you having to disclose your contact details.
My Twitter is in my bio. DM from there.
@@EV-365 hey Raj! Thanks. I dm'ed you there
You won't get anything if they go bankrupt. If they don't have money in there bank account or some assets it's impossible to get your money back. The decisions of the court are meaningless.
Have to take step 1, to get to step 2. Can't wait for them to go bankrupt before making an effort.
Would you recommend anyone buy one even with the severe discounts they are offering?
I would not recommend at this point. Unfortunately with the lack of service that Fisker is able to offer at the moment, and their financial struggles it would be a huge risk.
What happens to the buy back should Fisker file for Chapter 7 or 11? Just an honest question as we have no idea how much longer Fisker Inc will exist as a business. Congrats on winning arbitration.
I actually am not sure on this. I do know companies are required to have funds set aside to honor warranty claims even if they go bankrupt. I would assume this would fall under that since it is driven by the warranty.
@@EV-365 Nope! You will be recognized as a creditor. You will be in a better position than shareholders, but still very little chance to get anything.
Sorry for your experience with something you actually wanted. I still THINK the majority will quit early and FISKER FSRN is the biggest financial squeeze since GME CVNA
good luck to all of you getting Henrik to actually pay you! I think you're going to the end of the line with all of the other creditors that haven't gotten paid. From what I read it's a long line.
I’ll buy it off you AS IS for $20k. LMK.
Hit up their "dealers". I'm sure they will start selling them for $20K at some point. They are close already. Scrap the car and sell the parts. People are definitely going to need them. The batteries alone are worth more than what they are selling the cars for.
@@EV-365 nah. They are still $36k. I’m a series buyer. Can wire over $20k.
You won't get anything from Fisker. Did you buy on finance? You might be better chasing the finance company.
All avenues are being pursued at once, which I recommend to anyone dealing with this.
How are you pursuing the finance company at the same time?
@@ryanboyd6192 I’ve just reached out to chase. They were also curious to see how arbitration went before being able to take any next steps. I have a feeling they may be building up their own case as I received a separate call from them as well unrelated to me reaching out.
@@EV-365 I reached out to Chase a while ago and the person I spoke with was pretty clueless and not very helpful. Sounds like I should try again. I’ve had numerous safety issues with the brakes (both regen and the petal itself) and the accelerator when trying to move forward on a slope before and after 2.0 and had some serious scares. Definitely going to pursue the route you did but worry it’s too late at this point. Hope you get payment from Fisker before it’s too late. Are they taking the car back?
@@ryanboyd6192 Im hoping they take it! They are legally obligated to do so at this point but if they go under who knows. It sounds like you have some legitimate issues. Can’t hurt to atleast submit the initial request and let the NCDS make the initial call. They usually make that first decision on if you even have a case or not within a couple of days.
Maybe is just Karma?
Well played!
Nice, I hope you get your money before they file for bankruptcy!
I hope so too!
hope they have the money to repurchase.
Me too!!! We’ll see.
you're a ? (let's say a person with a lot of free time), you don't buy a startup's first car if you can't hold your own against the risks involved.
