The Brighton man armed with a gun while confronting a snowboarder in a viral video is now facing criminal charges. But his attorney says he had the right to protect his property.

    • @@kiimmig2293 I worked at the top of little cottonwood canyon and lived there when working at Alta and it's a privilege to live in the national forest and the fact is that you must be a pervert if you think people are going skiing to look in windows because normal people don't think that is a motivation but it's the thing you thought was happening. It's the right of the property owners to build fences or draw the window shades. When you are out looking in people's windows from the sidewalk like I'm hearing you say you do you can't be charged with a crime when you look into open windows. The fact that you think that there's many people like you is concerning, I would urge you to get professional help.

    • @@kiimmig2293 Signs don't give you the right to point guns at people who trespass but are no threat. I am more pro gun than anyone you know but snowboarders are not a threat and if they are moving fast the signs would not be visible and therefore don't establish boundaries and the resident needs fences and should not brandish weapons where he is not threatened. I have never pointed a gun at anyone and have been the victim of all kinds of criminals. If you see my gun you're about to be shot. This guy is so scared even when armed that I doubt he is competent to have firearms.

  • Wonder what would happen if a skier, snowboarder ended up on his property, tripped over a log or garden fencing and broke say their leg. Homeowner was inside had no interaction with skier/snowboarder but... OH I KNOW THE ANSWER, THE HOMEOWNER would be responsible! ! Resort should pay for Fences.

    • @@keithshaw1780 agree & also the antiquated squatter laws need to be changed. As it stands now, if squatters somehow get into your property (even if they've been there mere HOURS) & the homeowner calls the police, the police will tell homeowner that's a "civil matter" & that they (police) cannot get involved with. And...the police will do absolutely nothing to help. Squatter laws were originally created for people that actually took care of abandoned properties that owners just ignored or neglected, leading them to be run down. If a squatter moved in & IMPROVED the property, then in a matter of years later they could claim adverse possession & legally get the property. Nowadays homeless people & migrants have learned police won't get involved if they can somehow get inside your house & are exploiting those laws. Something needs to be done about this & also boundary issues like in this clip.

    • No he wasn't. It is not legal for you to threaten the life of someone for accidentally going on your property. You can't do it for them purposely going on your property. People have reasons to go on someone's property all the time. If someone is lost and stops to ask for directions or a Jehovah's Witness knocks on your door or something you're not allowed to threaten them

Also, property owners are liable if people get injured on their property regardless of signage. Perhaps as ps the state would like to accept that responsibility.

    • Actually, I completely agree with omegaz3393 because it's obvious the snowboarder KNEW he was trespassing. It was in his reaction and the fact that he straight away says "I'm sorry" and not "Whoa, what's going on? Why are you pointing a gun at me?". The snowboarder EVEN says, "I thought I was heading in the direction of my B&B and then sarcastically adds "Sorry I walked across your driveway". So, he KNEW it was somebody's driveway, probably DID see the no trespassing signs and ignored them and for all we know, had probably been told to get off the property already. I think the home owner has every right to point an UNLOADED shotgun at the people who are constantly walking through his property and invading his right to privacy. The resort should have to pay a large fine to the home owners in the area any time one of their guests gets caught trespassing, even if only lost, on the private property of the resort's neighbours. Then I'm sure the resort would fix the problem real quick.

If you have signs posting no trespassing private property and a reasonable person would have been able to see the sign then you can absolutely threaten someone for being on your property. In some states you would even be able to take it further.

    • He claims he thought the trail LED to his neighborhood, but ended up on this long driveway. If you're in an unfamiliar area on a big property, a long driveway could look like a narrow road. It's not entirely implausible.

    • Snowboarder didn't know it was private property. The resort should put up clearer markings for the edge of the property to make it crystal clear. Even if the boarder is lying and he knew, it's not legal to threaten or point your gun at people on your property simply for being there, unless they pose an immediate threat. Hands up while verbally saying "sorry" isn't going to meet the criteria of a threat, bud. I feel bad for the property owner for the repeated instances of trespassing, but this really seems like it's between him and the resort and he's taking it out on unsuspecting/lost ski and snowboarders.

  • Not a ski area but I had a place in a remote mountain community, 13 miles up a 2 lane road from the highway. It had a beautiful creek running inside the back fence and amazing berry bushes. There were no sidewalks, and no street parking. I would come home to find 2-3 cars parked on my private drive, and up to 10 people on the property well inside my gate and fence picking berries! They left trash, including soiled diapers scattered about, on the property, and in the drive. The property was posted "No Trespassing", and "No Parking". I even put up 2 signs that read "No Picking Berries", as I would pick them for family and friends and even neighbors who made wine and jams. People even stole my firewood for their campfires. The sense of entitlement was nothing short of breathtaking. I'm sure it's gotten much, much worse. One ray of light in the neighborhood was a Vietnam Veteran, he was firm but polite, until he was disrespected, then he'd think nothing of breaking a windshield, or slashing a few tires. (Think "Burt Gummer" from the film Tremors.) One of those FAFO fellas, bless his soul, he's gone now, R.I.P.

Instead of going out with his gun he could have hooked up some video and if the problem is as persistent as he claims take video to local authorities. 2 posts and a chain or gate across his driveway might work too. Check out the old man in upstate NY who shot the carload of kids who got lost going to their friend's house and were Trespassing. He's spending his golden years in prison.

I don't buy his people looking through his windows bs. That's a fallacy to swing the case his way. Just like putting up brand new signs before taking pictures to show the court as justification. People skiing through a section obviously going from point A to point B where it's obvious that they are only going through and not stopping is NOT justification to use deadly force or the appearance of. That's like me pulling a gun on someone cutting across my open lawn with no signs while i live on the corner and people just cut from one sidewalk to the next instead of going to the corner and turning. And i lived in Utah for half my life and can say that they are not Texas. They don't have gun laws anywhere close to that.

  • Resort should enforce property lines especially ski ones because traditional property lines markers are harder to make visible with all the snow. To make a fence high enough to show the boarder it would have to be 20 feet at least and cost them fifty percent plus of the property value.

  • People keep referring to the trespasser as a snow boarder. He is a potential home invader on a snowboard. A potential burglar on a snowboard. When someone enters private property illegally you do not know why they are there. Maybe the "snowboarder" was there to do harm but was deterred when he saw the gun. If you don't own the land stay off of it.

  • The city/county/resort should help the property owner put up signage to keep everyone safe. The property owner needs progressively aggressive signage installed at various spots along the private road: ▪︎ "Do Not Enter. Private Property" ▪︎ "Turn Around Now. This Is Private Property" ▪︎ "Turn Around Now. We Already Told You" ▪︎ "Why Are You Still On Private Property" ▪︎ "Beware. You Are Entering A Target Range"

  • It’s because people who live in rural areas get tired of tourists who just drive all over the place and don’t give a crap about signs we deal with that here all the time I had to put my car up to block people from coming through my road. Because I’m in a small community ranch, we are not allowed to put up fences across our property because deer and elk are supposed to be able to use the highways to get around, it doesn’t always apply to people driving. I’ve had people drive onto my land and onto my property. I live rural next to a forest and nobody is supposed to come back here. I’m with the homeowner!! When you go on a vacation in a rural environment, be careful where you go because people take this very very, very seriously. I have tried to tell people this. Anytime I’m hiking or walking. I don’t go near private property not even an inch!!

    • @earthangel8596 Obviously, the snowboarder is oblivious to the home owner being upset bc the snowboarder thinks he's the "only one" who showed up in the driveway. Otherwise, he would have understood why the home owner went off on him. Wait until he has a home and uninvited people show up in his yard. If the snowboarder had any empathy, he would take it up with the resort, not the frazzled home owner.

  • Lots of comments about the resort not having signs. I am not sure where people are getting that information from; maybe I missed it in the video. Its been forty years since I skied. I don't remember going to any location that did not have a sign at the lift, either at the bottom or the top, telling people to stay on the trail. Even the sky patrol would tell you that if they spotted you off the trail. The best argument I was ever given is that if I hurt myself off the trail, how would they know? That got through my teenage brain.

  • This is so backwards. Look...if it was me, I wouldn't care. But I grew up surfing and skating... and eventually infrequently snowboarding. Wouldn't have been happy about people looking in my house... But overall I wouldn't care. BUT I'm not the property owner. That's HIS place and as evidenced by the many signs he DID have a problem with it. I don't think the homeowner did anything wrong and the DA should go see a shrink, the homeowner isn't the problem here... The many people going on to his private property are the problem.

    • First off, he's saying it's unloaded. The shotgun very well could have been loaded, and at the time, that snowboarder had No way of knowing it was Not loaded. So put yourself in that position. Also I watch this video over again, and as they walk out of the driveway, I'm not seeing any signage saying private property. There is skis and parked cars as they exit the tunnel drive.. if you truly want to FIX the problem .. a simple gate or sign stuck into the snow would remedy the situation.
