Honestly, I'm always perplexed when companies are found at fault or sued for a child asphyxiating on their toys. Like, what, are we just going to ban all toys smaller than a child's mouth? As a parent it's your responsibility to watch your children around these toys and not give them toys/leave them alone with toys they'll suffocate on. As sad as those children's deaths are, I see them as parental neglect rather than something wrong with the company for just... daring to make a small toy? Maybe even sadder, the whole Pokemon Kills website just seems like a way for grieving parents to not have to face their responsibility and complicity in their child's death. :/

The Anime killed Latios from it getting very weakened but that's not really consistent with the games on multiple levels so I'm going with old age.

I remember that story when it happened and it still makes my head hurt every time I hear it. The Pokemon Go app tells you when you start it to pay attention to your surroundings when playing. If there is a Pokemon in an abandoned building or on private property, you don't go there because of some Pokemon you want, you use your head and look for something else to get. If you get mugged because you go into an alley, guess what? Your fault! If you get hit over by a car because you weren't paying attention that the "Don't Walk" sign is flashing/on it is your fault not Pokemon's. What morons!

America has its share of idiots, and people have been fooled into believing they can sue someone for anything they want. The kid was 13 months old. It can't be at fault, because at that young age, you don't know what you're doing yet. You can barely crawl around. It was, however, the parent's fault for not paying enough attention to their child and the toys he/she was playing with. Can't blame a 13 month old kid for playing with a toy, but you can blame the parents for giving it a toy that can be a potential hazard if you aren't going to be watching your kid actively.

7:34 oof. Now there's a fallacy. Trading cards and collectable toys are not gambling because you receive a physical item with payment. As long as that item is in production, you have a set chance to find said product. But with loot boxes and "surprise mechanics" the chances are not set and can be rigged. There also is no guarantee that the game won't remove your product or item, rendering your payment for no service.

I love it!!! I never see this kind of content being made. It’s great. This kind of research would be a lot harder without being able to read Japanese but I wonder if there were lawsuits in Japan as well, like with Electric Soldier Porygon.
I’m nearly positive there was one in regards to that episode. Hence why it’s never been made available in any collections of the first season, never aired again, etc.

Still sucks they can't/won't find another creative way to work Porygon into the series, though

Regarding the argument of Pokemon cards being gambling, and the somewhat connected loot boxes as gambling, here's why I think Pokemon cards weren't ruled as gambling and why loot boxes (mostly) should be. While Pokemon cards do encourage spending money for random cards... Its not quite the same. Pokemon did have the advantage of other TCGs setting the precedence for this, but TCG packs come with several cards and are typically guaranteed to have one card of a higher rarity. Maybe not what you want, but still. On top of that, a rare card is not necessarily a good card and vice versa, so getting a rare card does not give a player an advantage over another player. Finally, at least based on distributor pricing, cards have a set value by their rarity, with players able to sell or trade amongst themselves and setting their own values by use as well, which in turn allows players to purchase rare but useless cards for less and common but useful cards for more. Finally, though this may not have been a factor during the original lawsuit, the Pokemon TCG goes by set rotation, meaning that after a given period, old cards are not allowed in tournament play, making them more collectible than anything. Since they do not necessarily give an advantage in game, they can be purchased and traded outside of their original distribution at prices set by players, and a rare card is guaranteed every pack, they do not count as gambling. As a bonus, I believe its even possible to order specific cards from Pokemon (or then WotC), getting what you want at a slightly higher price than in a random pack, but possibly cheaper than fan values. No guarantees there, but I have heard of it happening. As for loot boxes, however, it is completely random. You aren't guaranteed a rare item in a pack (though sometimes with single draw versions they claim a guaranteed rare every X number of pulls). Rare drops often include better items, giving an advantage to those that spend more on getting more loot boxes. There's little to no trading or fan values on things. You usually can't buy a specific drop except for ones that can be reused (eg. Temporary power boosts). When you can, its a single, set price that's far above the loot box value. So there's the main differences. You are guaranteed a rare card every pack, but not a rare drop every box. Rare cards don't always give an advantage in the game (even when its a better card, it might not work in your deck) while rare drops are usually better items or equipment. And you can sell or trade cards for actual currency, with values determined by fans, while you cannot sell your drops, can't always trade them, and when you can get rid of them, its for another virtual currency that just slowly builds to creating more drops.

Most of these I knew about besides the third one. I knew Wizards used to deal with Pokemon but I never knew they tried to sue Pokemon.

Regarding trading cards and lootboxes being "gambling." According to Extra Credits, the key reason why these things are not gambling under current legal definitions is because you can't "cash out." If you could cash in your Pokemon cards and turn them back into real money, like you do with chips at a casino, then THAT would make it gambling; but you can't, so it's not.
