Not sure, but I think it might be a crime even if he had used his own money, but it would be much harder to proof that the silencing was done because of campaign related reasons.

Daniels provides the sizzle, but the steak is something else entirely. He could have paid her $130K right out of his pocket, which probably would have been the end of the story. Instead, he had Cohen pay her, then reimbursed Cohen, calling it "legal fees." $130K got grossed up for taxes and a bonus for "a job well done." (how does THAT fit with the Defense's characterization of the transaction?) He spread the payments out over a year to make them look like monthly billing. HE SIGNED THE CHECKS. In sum, Trump has been caught mischaracterizing payments to commit an election violation. Trump is f**ked. For 15 seconds with a porn star. In a sense, it's kind of like he got a dose of the Clap.
