🔴 NOT LEGAL ADVICE
Always love when your Dad is on. He is knowledgeable and well spoken. His historical context adds so much
I love it when your dad joins in!!. So smart, I could listen all day....
Yes he explains so much that we would never know or understand
Same here. He is intelligent, well-spoken and seems very kind. I enjoy his explanations a lot
I love the integrity of Papa T. Many people in law school could learn from him. He needs to write some legal books. He is a Law Gem✝️
Thank you Peter and Papa T. for the coverage on this case! Definitely a blow to victims that were impacted by Harvey Weinstein bad acts and their healing!
Did you watch the trial and hear the details? These women made choices. They tried to use their bodies to get ahead in Hollywood. Harvey is a pig but not a criminal. If you were forcefully assaulted would you date the man and beg him to be with you and offer sexual favors to him for six months after the “event”? I don’t think so
Peter set your Dad up a mic for times like this. Hearing him explains things helps us future jurors. You Dad is a legal History book ✝️
Agreed he could even use a little clip on I believe Bluetooth mic.
Yea, i only watched half the video because I could hear him, & these two r my fav to watch together!❤❤
Agreed
I’m so glad you’re doing this one. I was so disappointed to hear about the overturn. 😵💫😑😵💫
Fellow trial attorney here (PA & NJ). Great discussion. I agree with Papa T, especially at 41:52 in the video. It is not likely that to prevail at trial, the prosecution needed the additional Molineux witnesses. I’m curious as to why the court or the prosecution would take a chance and potentially create a reversible error by allowing “irrelevant, prejudicial, and untested allegations of prior bad acts”. This was a very close case. Excellent analysis.
You know why... it was set up this way on purpose.... too many powerful people are on the list..
He's glossing over the inconsistencies in the victims' stories. Each alleged victim also maintained an ongoing relationship with Harvey and benefitted from being friends/lovers with him. So to come back and cite some random encounter as being rape is questionable. Had it not been for the Molineux witnesses it likely would've been a not guilty verdict across the board. Remember: that's the ONLY evidence they had (the SCONY said as much in their decision).
That was my thought
Thank you for addressing this much missed reversal. It didn't get much media attention that I saw anyway. I am gobsmacked by this decision. ❤
Thank you Papa Tragos and Peter for discussing this case being overturned. 💗 I really value both of your insights and expertise.
Papa T needs his own KZhead channel! Lots of good knowledge there.
Joined the chat halfway through but finished on rewatch crew. That's good to know that New York state will probably enact a law that keeps these type of cases from getting pulled back on the conviction. It's really a terrible thing for SA survivors and this type of thing should not happen. Just like Bill Cosby should not be walking the streets of Los Angeles or Hollywood. It's a travesty of justice. These men need to be held accountable. And the system needs to work to protect not only the interests of the defendant but also the interests of victims.
Half of these women bringing these charges years and years after they happen are more often than not liars looking for money. If a woman is legit being raped, why would you wait years to report. Sorry not buying it.
That's not a reason to ignore an accused rights. There are countless examples of people lying about being victims. There's nothing more frightening than being sent to jail when you're innocent. Railroading every man who gets accused is the surest way to make every accusation seem like a lie. That's not fair to victims or accussed. Every woman I know has at some point told me about another woman who lied about her to ruin her reputation or to bully her. For some reason, if the story is about a woman doing something wrong, we don't take it as gospel, but if it's a man doing something wrong, we do. The jury is allowed to hear about everything he ever lied about, but nothing she has lied about? Maybe that's fair, but maybe it isn't.
It sounds good in theory but we cannot trample on rights, even for the cosby's and harvey's.... its on the judge here. Should those men be walking the streets? No... but rights are rights are rights are right...
The problem is there's a trend of women being willing to trade sex for favors and then when the public finds out about it they act like they're innocent victims. There are countless examples of women saying they desire men who have money. You take men like Weinstein and Cosby who are worth hundreds of millions of dollars and you really think they made it a habit of "forcing" women to have sex with them? SA victims should be heard and deserve justice but you shouldn't be able to call yourself a victim after seeking out and cozying up to men just because they have money.
Everyone should have the right to an appeal. No matter how heinous the crime. Innocent people get sent to prison too.
I loved your goofy smile when you started talking to your dad.
Sound is up and down but able to hear without too much difficulty. Thanks for your dedication and hard work in bringing us the important content you do! It is much appreciated!
@10:57 the way you (Peter) explained the "bad acts" rules, I finally get the nuance argument. I love this college course you gentlemen instruct.
If that's considered bickering, its the most respectful bickering I've ever heard lol
He will remain incarcerated on a different SA conviction. That is what I heard.
I feel like the problem with "consent" in a trial like this is the vastly unbalanced power dynamic. My understanding is that he would imply "non consent" would lead to the actresses being blackballed from consideration for roles not just in his films, but also with anyone he had influence. There needs to be a difference made between actual consent and coercion.
I'm not saying he never said that, but the flip side of that coin is these women were receptive to his advances because they knew he had money, power, and influence. Being able to call someone like Weinstein for favors or to get you into certain parties or events because you know his name carries weight is how Hollywood works. They can act grossed out and disgusted by him now because his reputation is tarnished, but it was established during the trial that all of the alleged victims benefitted from knowing him.
Love the shows collaborating with Papa Tragos. You both are so talented. 👏
He is prickly curt and short with his dad Arguing is one thing but rudeness is another
Interesting. Was keen to hear Dads POV.
He is the best and is always calm and considered .
I appreciate you applying the feedback about cutting Papa Tragos off in the past. So much easier to absorb the info I find.
You Dad is so knowledgeable and interesting to listen to!
Peter you’ll have to get your Dad a clip on mic for future collabs 😊
Busy day! Rewatch crew & always enjoy when Pappa T is on. Thank you Peter 🎉
It’s very hard when it’s a technicality and not the belief he was actually guilty that overturned this. Disappointed but I would say it shocked no one. Men in power always win. No need arguing. Nothing’s changed.
He was convicted of the most serious charges and will spend the rest of his life in prison… that is not him always winning.
@@travispratt6327 He won on appeal. That’s a win. I don’t know how else to express it really. Every victim deserves justice and to win, not because they believed he was innocent, but on a technicality… makes it a bitter pill for some of us to swallow.
Glad to see you and dad today. I’m getting a lot of information it helps so much in many cases. Thank you from California
Power is power whether, strength, influence, or intimidation.
Thank you for covering this
As much as i Hate this for his Victims/Survivors, if this was a loophole in the law at least it's been uncovered on a Huge case that will get noticed Nationwide and hopefully fixed so it NEVER happens again? This is how we find out about loopholes in the law so they can be corrected, sadly! I do feel for these people that are going to have to go through this all over again! 💜🙏🏻💛🙏🏻💜
The “loophole” seems to be they didn’t prove the case and instead used evidence and tactics known to elicit overturning of cases.
@@travispratt6327 I was going based on what LYK and his Dad were saying which appeared to be something in the law that needs to fixed? 💜🥰💛
😳 I feel sick, what is going on?
Rape is now legal in ny according to the appellate court
Really enjoyed this. I would have interpreted this in the most negative precedent setting way without your insights. I feel much better now. 💛💛💛
♥️♥️♥️ the discussion and explanation and listening to father and son discussing the merits of the descension
Missed the live- North Carolina has a similar “consent” wording. My 21 yr old daughter was drugged and raped, he said she consented, when she couldn’t possibly have given consent given the drugs- he got 5 years probation and left the state for Virginia. Interestingly a woman from Maryland came forward with the exact same story from 8 years before and was ready to testify when he pled guilty to a lesser charge which included kidnapping as they wanted the felony and sexual assault of a female instead of the rape
Always a treat to have Dads experience and opinions. Thank him for spending his time with us😊❤
Papa T awesome as always. Thank you both!
Great stream. I always like it when you both stream together.
How a panel of 7 judges could overturned this conviction is mind-boggling.
it just proves, if your rich you can buy your way out of jail.
And if you're poor and want to be rich, you can lie your way into court.
@@fridaytiedayThat’s the strangest way to “richness” 🙄🤣
@@em8302 😆😁
He hasn’t bought his way out of jail, he was convicted of the most serious charges and will spend the rest of his life in prison still.
Great info. Thanks Peter and Papa George
Peter be nicer to your Dad. We like hearing him explain everything. We learn a lot from detail. Just my thoughts not trying to be rude or disrespectful.
I agree . Peter needs to calm down and not be like a hyperactive puppy .
Peter is all aboutclicks ,money ect. When he showed his young kids and wife on comm page in bathing suits ,I knew he was one of them .sold his soul .
Remember Peter and his dad work together, I’m sure they banter back and forth,,, from past conversations I’ve heard they are super close so they are just goofing around!! No one’s disrespectful or a puppy at all!!!
@blackstump172 & @terid3569 were we watching the same thing? They are bringing valuable information to us all for free- and taking the time to explain what happened and their opinions. I just don't understand the point of making negative comments in this type of forum. You have 2 successful professionals that have more self awareness then all of us combined ❤
@@karenstricker I was saying what I felt. I’ve been on this channel from the beginning and I love Peter and I wasn’t being disrespectful I was being honest. His Dad really gives great detail and I’m a grandmother and as a grandmother I speak from respect, which Peter appreciates on here so everyone stop being so touchy about my comment. Have a blessed day ✝️
Rewatch crew here. I love listening to Papa T.
Great conversation!
Almost always they bring up anything bad about the women. Should be free to do in kind. So disappointed and disgusted with this whole thing. Protect the men who do this and see what happens.
Love your Dad. ❤
Great discussion! Loved it!
Gentlemen, this was an absolutely educational fascinating and informative discussion. A topic very well handled by both of you. I appreciate your approach to discussing this more than I can express. I am a proud feminist. And you both explained this from a legal position with the goal to inform so that we could make sense of this; and achieve you did. Thank you so much for this stream. Very well done. 🙏🏼
Love your dad’s perspective!!
But after hearing your dad, explain that the judge allowed prior bad ax in so many different areas i.e. lying etc ECT
Peter, wanted to start off by saying I love your coverage on different trials. I've followed you for a few years now. Something I've noticed, when your father is on the episode, you seem to be so annoyed sometimes. I can understand certain frustrations from different approaches but, I can't help but feel you're so annoyed by him sometimes. I mean to give grace (this channel has helped me do that in so many ways!) and don't mean to poke but, please give your dad a hug for me man. All love. Thank you for all you and your team do! ❤
20:50. Be respectful. He was embarrassed.
Great discussions
Great show!
2:29 It didn't sound like you were addressing anyone and it sounded rhetorical. I would have been confused as well had I been your father.
Love Papa Tragos ❤❤
Every video should be the two of you. Without a doubt the most informative and entertaining - the interaction between ya'll, not so much the crimes you discuss - videos all feature George.
Hi Papa Tragos!
this is a big deal!!! Exceptional Pete and Dad Tragos- Bravo🙏💪🌟 please bring Dad on the show again soon!!!
Got To keep an eye on the new York supreme Court justices to see if they are buying expensive cars and boats
Oh we can probably guess which ones did it.
You guys are the best! Love watching you and Papa T!!!xoxoxo
If our system can’t be fair for the worst then it sure won’t work for the rest. It’s not easy or fun to say that but it’s true
KZheadr pat brown also did a fantastic video about this i really appreciated .
❤ the break down with pops!
Great episode.
Peter seems annoyed with his dad 😂
I think he is annoyed with the electronics.
CAN TOU GET EDBAKER TO COME ON AND EXPLAIN THE Differences between New York and California law.
Hey Peter, love seeing papa!
If they had good cases they would not have been tempted to pile on. I am still highly suspicious of the whole thing.
Thanks for explaining this ruling.
I love you guys!💙
48:45 What Mr. Tragos, Sr. said here is just what I was hoping to hear, and I'm sure I'm not alone.
I love the respect between this father and son !
I think dad needs to tell his son he’s doing a great job in life and he is proud of him. Come on dad, you can you it.
He absolutely has
Why don't you do Trump trial in NYC ? I'd love to hear what dad thinks
Id imagine he's afraid that bringing politics onto his channel will make many of his subscribers leave. It's hard for people to not be biased when it comes to Trump
This is why women don’t bother reporting SA😞
It's disappointing and I can't imagine what the victims are going through. However, I understand why the case was overturned. The women who testified could have done as victim impact statements.
Will you be covering the Gerardi case?
Check the bank accounts to see who was paid off!!!
Is it public knowledge what judges were in the 4 VS 3? And just because the female judge was chosen to write it - does it mean she agreed with the appeal?
So is he still guilty in cali
really interesting legalities!
Thanks for not doing politics!
Question: since Weinstein's lawyers claim he couldn't testify because of all the facts allowed in cross - does he now have to testify? (I'm sure he doesn't, but it's so weird to let him use that card and then throw it away...) Another question: can the Molineaux witnesses be used again just to prove he might have felt entitlement to sex due to his position of power? He was used to women saying "yes" to him due to his position. It would make him mad to suddenly hear "no".
Isn’t Karen Read attorney Jackson also on Weinstein case?
Thanks for the explanation. So many people are just going off over this decision without understanding.✌🏾
So it’s just that he’s super creepy and seems gross and evil. But so many people kept going back to him and even praised him because they wanted something from him. He sent gifts, established long term relationship, and all the while he was hoping to have sexual relations - but the most important thing in the case is that he assaulted them and they physically fought him off.
Sometimes you feel like it and sometimes you don’t. Consent is important. Always.
Introducing prior bad act convictions are a good idea only if you don't care about appeals. Prior bad act allegations are even worse. Even if there is tangent probative value, it can still be argued that the prejudicial aspect poisoned the case.
How much more do you like the LYK now 😊
not surprising watching whats happening in NY
Couldn't that argument be made in the exact opposite way too? That the judge took into consideration his 25 years in New York and maybe didn't sentence him as strictly in California as he would have if he didn't have the 25 years in New York? Like that man is going to be alive in 25yrs
46:00 all good points but I also Camille is a freakin fire breathing dragon! (In all the best ways) I think Amber would have gotten off easier with Mr Chu 😂
There was a trial in Spain where a woman was gang raped, they wouldn't say rape in the trial, the victim was devastated, she later went to trial again and forced that they say rape instead of sexual abuse, it's a documentary on Netflix this gang rape happened during one of Spains festivals of sorts, deplorable call it was it is.
Pamplona San Fermines Fiesta . There were a lot of women ( and men) from Pamplona protesting. There have been some efforts to clarify the law and ' no means no'. 4 men videoing and still the consequences were not enough.
Yes, the cruelties and definitions of Rape and Consent must not be diluted or Normalized in any way.
What!????!!!!
your dad is great🎉
I would love to see you and your Dad's opinion on President Trump's hearing! 🙏😇❤️
Respect, Consigliere.
Glad to hear this guy is no longer a judge.
Love your dad!
@paulsorenson. I would be very pushed if I had taken the day off and didn’t $ to attend the trial today! Ridiculous !!!
Sexual assault cases are tough, if not impossible. He said, she said. She felt, he felt. Intent. Consent, no consent, what is consent. Without hard evidence, injury, video, etc, it basically is just pick a side.
Yeah thats why I was surprised this was overturned. Law and Order Special Victim Unit is a good example of this.
@LawyerYouKnow what’s your thoughts on R Kelly’s bad acts that you discussed a few years ago
