The Constitution mandates the Election Commission (EC) to conduct free and fair elections in India, the backbone of India’s democracy. But how free and fair are our elections today? Serious questions have been raised over the functioning of the Election Commission (EC) in recent years particularly after the Supreme Court’s Order in May, 2023 about appointments to the EC. As a young student during my college days i had admired the guts of CEC Seshan who single handedly would stand up to his responsibilities as CEC. I have yet to come across a person like him whom no one dared to question or go against since he worked as per the constitution.

Well done good job and debate as well regarding EC on conducting or implementing of model code of conduct. Though I personally feel that EC in India is very neutral but coming to the ground realities the EC on the whole is some thing is very different and where the EC shows some sort of favour to the ruling dispensation of the day . Kapil sibal sir where and when this act of EC is going to end. And in long run in my view the voter will ignore voting because why should we vote where the system is eventually not fair.
No discussion speaks about intimidation of top officials by Modi and Shah. They have forgotten Gujarat, Haren Pandya, judge Loya etc. etc.? Lavasa himself was intimidated and resigned from his job. The ED and CBI are acting as a private agency or the Gestapo of the government. When a beaurucrat and his family are brought under pressure he will succumb. This is hitting at the core of our democracy. Even the SBI chairman was prepared to face contempt of court and face prosecution. Why? Because he may have been worried about his job and personal safety.
EC must apply its mind & act proactively & not merely to wait to react on the basis of a complaint.It must act upfront.

During his tenure as the Chief Election Commissioner N Gopalaswami on 31 January 2009 sent his recommendation for removal of Election Commissioner Navin Chawla to the President of India.[3] He alleged that Chawla had discharged his duties as Election Commissioner in a partisan manner, seeking to further the interests of "one party." The CEC report contended that Chawla would take breaks during crucial meetings and secretly talk to functionaries of the Congress party and leak confidential details of the Election Commission.[4] Chawla is also reported to have opposed the Election Commission's notice to Sonia Gandhi for her accepting foreign honours from Belgium.[
Truly T S Seshan was the only CEC person who had stood as a strong pillar for fair conduct of elections. Why are the bureaucrats of various departments/ministries intimidated by the politicians.

Give notice to the govt that the basic principles and requirements are not met as per democracy and hence if elections are conducted then it will be null and void. For this the prominent lawyers and professionals form a valid committee to safeguard democracy and give legal notices. Are the rules for a nation not same?. Yes it is. Regarding the ED and CBI these are govt bodies and not connected with political party. In fact govt DG SG and EDs are there reporting to AG or chief secretary and need to prevent political leaders pm and ministers not to bring projects or policies effecting the govt. under these circumstances public can sue ED and CBI for taking instructions directly or indirectly from pm or ministers. AG or chief secretary are responsible to give standing orders and if.Violated need to dismiss. Pl examine and find a way to curb the nonsense affecting the gdp of the country and human rights. Election commission should not shouldered its responsibilities to political parties to confirm the names in electrol rolls. Instead they should establish a full proof system to addition/deletion of the name, in addition to fixation of responsibility.

If ballot boxes destroyed then same can be applicable to EVM also with same logic. Use ballot paper with party symbol along with barcode to help count similar to currency notes. Only manual count need to be done if there is any doubt.

In Manipur, recruitment processes for various government departments are going on without any disturbance from the ECI. Almost all state government departments issued recruitment notification of various posts and process is going on till this date i.e. 17/04/2024. That of election is on 19/04/2024.

Yes, because he is an administrator and an officer. While politicians come and go, the administrators are the ones who deliver the laws of the land to the public through their lives. Its a job that they picked, and signed up for. They swore an oath to safeguard the constitutional values enshrined in the constitution. The Preamble, that enunciates 'We the people of India ... ' is also the value they swore to safeguard with utmost integrity. Indeed, this is an important political moment in India's history, wherein the incumbent party's authoritarian ways could starkly change the imagination that is enshrined in 'we the people of India ...' In theory and practice, invariably, executive or civic bodies are the points of contact from the state's perspective towards the citizenry of the country. They are the ones who have been trained in law by state bodies like the DoPT. This is how the executive was imagined in the constitution, a clear attempt to balance different power centres , as an important safeguard to the constitution, and particularly this vague idea of nation-hood we all imagine. The executive has to show responsibility, especially when the government postures as authoritarian. IAS for instance, shouldn't mean 'I am Safe'. The job comes with onus and responsibility.

I think ECI is more concerned about free and fair elections, but not about democracy.The interpretation of free and fair should also weigh whether democracy is being harmed. And this concern would give more weightage to the powers conferred by Art 324, than the MCC
