Judge shopping scheme backfires on anti-abortion activists with 'embarrassing' case in Supreme Court

2024 ж. 25 Нау.
475 253 Рет қаралды

Arguments against abortion medication heard by the Supreme Court today bordered on the absurd, but because the activists who brought the case specifically sought out rogue judges in lower courts the Supreme Court had to endure the embarrassment of hearing them. Jessica Valenti, writer of "Abortion, every day," Dahlia Lithwick, author of "Lady Justice," and host of the Amicus podcast, and Carrie N. Baker, professor of American Studies at Smith College, discuss with Alex Wagner.

  • If your religious beliefs prevent you from giving abortive care to a woman, why would you choose to specialize in gynecology or obstetrics? There are dozens of medical specialties you can enter without worrying about being forced to give abortive care.

    • Christofascist republican conservative self-acclaimed "proud domestic terrorists," as far back as the Reagan administration, learned long ago that if they can't force their beliefs on people by winning at the ballot box, they can simply infiltrate the institutions they don't like and sabotage them from within, so that they can claim those institutions are corrupt, broken, or ineffective. Republicans campaign on "government" being corrupt, broken, _and_ ineffective, but in order for this to actually be true, republicans in office have to actively interfere with and sabotage every process of government in order to make it so. Were it not for republican obstruction, the U.S. government would not be nearly as wasteful and ineffectual as it appears to be today.

    • I don’t think it is Christians per se that are the problem. A true Christian shows compassion, love, understanding and forgiveness. The people calling themselves “Christians” have a delusion that only their god matters and they are told by their faith leaders that they have to be warriors and fight against all others to achieve their heaven on earth. Ironically, the God of the Jews, Muslims and Christians is the same god but subject to the interpretations of imperfect men who have a personal agenda. Sadly until we learn true love for our fellow man, all of these religions have lost sight of their purpose. One thing I would say is that we remove any tax exemptions from religious bodies if they participate in pursuing an influence in government. Exempt only those works and properties used for the betterment of their fellow man.

But, of course, only if it's someone needing surgical care after using mifepristone. • What you're "missing" is the fact that you're looking for logic in a place where it fundamentally can't exist. These people don't actually care about children. _“The unborn” are a convenient group of people to advocate for._ _They never make demands of you; they are morally uncomplicated, unlike the incarcerated, addicted, or the chronically poor; they don’t resent your condescension or complain that you are not politically correct; unlike widows, they don’t ask you to question patriarchy; unlike orphans, they don’t need money, education, or childcare; unlike aliens, they don’t bring all that racial, cultural, and religious baggage that you dislike; they allow you to feel good about yourself without any work at creating or maintaining relationships; and when they are born, you can forget about them, because they cease to be unborn._ _You can love the unborn and advocate for them without substantially challenging your own wealth, power, or privilege, without re-imagining social structures, apologizing, or making reparations to anyone._ _They are, in short, the perfect people to "love" if you want to claim you "love" Jesus but actually dislike people who breathe._ _Prisoners? Immigrants? The sick? The poor? Widows? Orphans? All the groups that are specifically mentioned in the Bible? They all get thrown under the bus for the unborn._ - Pastor Dave Barnhart

  • I also think the case is ridiculous both on standing grounds and on the merits. But let's be fair and accurate. The doctors' attorney wasn't saying that all people in the USA should be denied the drug because doctors "don't have time to wash their hands repeatedly". She was saying that the drug should be banned nationwide because in emergency situations, doctors who have lodged an objection to treating patients who have used the drug will not have the time or ability to acsertain whether or not a given patient has used the drug. Their argument is that the result of this in practice will be to force such doctors either to treat patients even when they may have used the drug (thus rendering the objection futile and ineffective in practice) or to refuse to treat any patients at all in emergency situations. My own view - and I think this is a no brainer - is that doctors (especially emergency doctors) have a manifest ethical obligation to take patients as they find them, and if doctors can't cope with that, then they shouldn't be practising medicine or surgery in a field where they may encounter emergency patients whose possible behaviours conflict with their beliefs. If their religious or conscience-based convictions are so strong that they have to supersede the doctor's duty to provide emergency treatment, then the doctors are free to restrict their practice to a private clinic that will only offer emergency interventions for patients who have been pre-screened before the emergency arises, they are free to find another specailty, or they are free to find another line of work. Utterly ridiculous to expect their personal beliefs to be accommodated by instead banning the whole population of the USA from using the drug, just because of the personal, non-medical and unscientific preferences of a few individual doctors about what they would like to do in entirely hypothetical situations.

  • If those doctors are simply arguing that they shouldn’t have to treat patients encountering (rare) complications after use of any abortion drug, especially emergency room physicians, then they should just stop practicing medicine. If you can’t suspend your personal beliefs and provide life-saving care to a patient, regardless of why they need that care, then you should not be practicing medicine. The point of emergency medicine is to save lives, regardless of the situation. And if they claim that a personal exemption is not enough, then they just need to get out of the field, or go do something like family practice. In all my years working in healthcare, I have learned that you are going to have to do things you don’t want to do because a patient’s life may depend on it. Anyone who cannot handle that reality should not be working in healthcare. Your personal beliefs have no bearing on another person‘s medical treatment, especially when their life is at stake.

  • The logic here is emergency room doctors don't have time to scrub up before doing emergency room procedures! That would also apply to gunshot wounds, poisonings, etc. So they are arguing we must ban any potential poisons, guns, etc.!!! RIDICULOUS!

  • Id venture to say that if you have objections to saving someone's life based on how they got there, you likely shouldn't be a doctor at all.

  • Their lawyer says that it's an endgame type situation; the doctor is harmed by waiting for approval for them to get permission not to treat this real, live, already born woman who is in an "emergency medical situation" My question to them would be: what about the patient on the table? These arguments not only are over broad, they show how distorted the logic is.

  • So they didn't present even one case of Mifepristone harming a patient? Even kids on high school debate teams know to be better prepared.

  • These doctors really need to pick a different profession. I wouldn't trust them to oversee any aspect of patient healthcare.

  • So, justices in one state can not make a law for the rest of the country (one state preventing Trump from the ballot based on the 14th amendment) but one single judge from Amarillo can ban drug in all states!!! Why are the liberal justices who raised the 14th amendment question, raising it for this issue as well??
