I loved Breaking Bad. And Saul Goodman was one of my favorite characters. Despite being down on his luck and faking his own name, he somehow always managed to give good legal advice to certain meth dealers in Albuquerque. Not surprisingly I REALLY enjoyed this show. I get asked a lot about whether being a practicing attorney is like being a lawyer on TV. I love watching legal movies and courtroom dramas. It's one of the reasons I decided to become a lawyer. But sometimes they make me want to pull my hair out because they are ridiculous. Today I'm taking a break from teaching law students how to kick ass in law school to take on lawyers in the movies and on TV. While all legal movies and shows take dramatic license to make things more interesting (nobody wants to see hundreds of hours of brief writing), many of them have a grain of truth.

Vince gilligan got roasted on that mythbusters episode, where they disproved most of the chemistry in BrBa, so hard that he took it to heart and became near obsessive with law details and accuracy in BCS.
That makes me imagine he's afraid there'll be a new Mythbusters episode where they just read through a law book and point out inaccuracies in Better Call Saul and don't do anything interesting or scientific

No all of the meth making was VERY accurate on breaking bad, maybe what was not accurate was some of the other scenes where they made bombs and ricin etc.

Objection: Goodman makes his closing argument _before_ the prosecutor shows the video, which serves as his closing argument. In a trial, the prosecution always goes first. If the prosecutor wanted to show a video for his closing argument, it should have come before, allowing Goodman to respond to it. (This is the only error I saw, and I'm guessing it's what brought the final grade down from an A to an A-)
Overruled - In most jurisdictions, the government gets the last word because they carry the burden. I'm pretty sure New Mexico is like this or would have been like this at the time. Some jurisdictions recognize that this is unfair, given the power of the State and have reversed the order. In Federal Court, the prosecutor closes, then the defendant, but then the prosecutor has an opportunity to reply to the defendant's close.
And so ends another day with something new learned. Thanking you both.

OBJECTION: Even with "permission" granted to the owners property a few things have to be established: 1. Legal deed (right of authority) 1a) Capacity to authorize rights of deed and ownership 2. Current dwelling or established occupancy rate 3. That "access" of said property does not unreasinably violate or perjur current legislation for deemed "usual & customary" for said access, as in; no criminal exploitations which would violate said owners "reasonable enjoyment" and wherein "consent" is not implied for forms of harassment, criminal infringments, exploitation. Example: you let a person on your property "to talk" to you as requested. They force your house door open, have a side arm in their hand fully loaded and the safety off while uttering a threat to use said firearm with "a lot of drama in front of your kids". This is where "consent" and "reasonable" crosses the bounds of harassment & assault, wherein; "ought to have known" the actions conducted upon "permitted access " violated the owners expectation and permissable legal conduct was extremely prejudicial.

It's not at all unusual for some copyright owners to request a takedown against every use they can find, and consider withdrawing it (on fair use grounds or otherwise) only if there's pushback. This happens even more often when a copyright owner hires someone else to find this content and file the takedown notices. And yes, this does rather chill free speech and criticism, I reckon.
Just a quick FYI: I work in the building where they film the courtroom scenes (415 Tijeras Ave, Albuquerque NM--old Bernalillo County jail and courthouse). Trust me when I say the bathrooms are set set somewhere other than this building.

I would love for you to do episode 4 of the first season! I worked for a documentary film making company and I was an archivist, so we had to deal with fair use items all the the time. So when I heard Saul/Jimmy and Howard Hamlin talking about fair use, incorrectly I might add, I was bummed! I love BB and BCS, and was honestly shocked at the blatant misunderstanding of fair use in Vince Gilligan's writing. He's usually pretty darn close, haha. Anyways, I doubt you'll get to it but I had a MOMENT hahaha and thought I'd mention it after watching this one. Love your videos!

There's a lot of great episodes of this show you could review. It is among the most accurate legal shows mainly because it isn't really about the law, but about the lives of these lawyers.

You're supposed to say "objection, the attorney is not wearing pants"
I caught a municipal court judge in NJ taking his formal looking judge's robe off post trial. That guy had nothing but a Jimmy Buffet concert tee and tighty whiteys on under that shit lol. He was unshaved, and looked like he just woke up and drove to work without any hygiene routine whatsoever. I looked it up, the average judges salary in NJ is between 183, and 205 k/yr. Add the kickbacks he probably gets from prisons to lock up as many people as possible, and he gets plenty of money not to look like a homeless guy they found in Penn station and put a judges robe on his stank ass. He looked soo miserable too, I couldn't help but think about what a tough life the poor guy must have. Showing up for ,"work"' as late as he wants, and he was at least 90 min late every day. Then he has to pass judgement on others and fine the shit out of them, lock them up or both, while being as condescending, and disgusted with them as possible. I know they worked hard to get where they are, and he'd probably make more as a defense attorney, but all he has to do is work 2 or 3 times a week tops for maybe 3 hours. Plus it's not really work, there's no labor at all, and he has clerks to do all his paperwork. He just reads conditions, and fines right off a script. 999 out of a 1000 people would trade jobs in a heartbeat. Cops are the same way, the poor guys have to drive around and harass folks who kiss their ass all day. Probably once a day they get to arrest someone for a unpaid ticket warrant, or possession. Then they act like their life is on the line all day every day when 99% of them patrol really nice areas, or highways. My small town has over 70 of the pigs, while Camden, Trenton, and Newark have a handful. Camden has spots so bad cops, and ambulances won't even go there or they will get jacked for their whip. Imagine calling 911 cuz your having a heart attack, and they tell you to walk a few blocks over cuz they're shook to go into your hood. They should definitely take half the cops from the rich, crime free areas of NJ where there not needed and put them in the hood.

Yeah, you learn that you need a license for basically everything (well, i guess you don't need to represent yourself, but it is strongly advised not to represent yourself and get a lawyer)

@@dominickschrute3084 Heavily in part because some of the things that can get the entire case tossed literally can't be used if you represent yourself. The system is set up to heavily punish you if you try. It's interesting.
Just want to comment to say I didn't expect to love this channel as much as I do. Saul, Suits, and Ace Attorney are all shows that I like and it's cool to see someone not only react to them, but give some professional perspective. I would love if you continued with any or all of those shows, because there's much more in all of them that I'd love to hear you comment on!

I'm a big fan of both Breaking Bad and Better Call Saul. This is TV at its best! I just discovered your channel. I love learning about the law--I'm a jazz musician and college professor, and my best friend is a graduate of Stanford Law School and spent years as a corporate lawyer before she went to business school and eventually became a high level executive of a big company. She's the smartest person I know. But she doesn't like to talk about law-she says she doesn't know anything about litigation or criminal law. Anyway...I really enjoy your light hearted,witty and informative commentary. Thank you!
I'm a bit late here, but if you revisit this series, S3 E5 "Chicanery" would be a good one to review. Pretty much the whole episode is in a courtroom, and it's especially good if you've watched the whole series up until that point.

Almost vague enough, the judge might allow it.
Wait, how can the defense not argue just what the impact of potential punishment would be? That is one of the cornerstones of criminal law, the balance between the interests of victim, society and perpetrator.
It's vague enough I think. You're not supposed to object during closing arguments unless something really crazy is said

I know this attorney already watched the ep1 before recording this video. So I don’t think he needs to show like he is shocked. There’s no problem about that.
