Donald Trump has allegedly violated the gag order in his New York criminal trial more than a dozen times. Former federal prosecutor Renato Mariotti shares how the judge may be delaying any penalties for Trump to leave the threat "hanging over" his lawyers so they rein in their client.

We have a two tiered justice system. Trump has violated his gag order many times. Too many for that matter. Put Trump in jail, even if it is a matter of hours between trials. Of course he'll kick and scream and cry unfair, but least half the nation will support it.

The main alternative is referring to it as a campaign documents case, which would risk confusion in the public's eyes with the classified documents case.
Conviction on criminal contempt for violating the gag order is a violation of the terms for release on bail in the cases in DC and Georgia. The penalty is imprisonment pending trial, which would happen to any other defendant.

This would delay the case. Trump can appeal the imprisonment.
Conviction of another crime is not required for revocation of bail; accusation alone can suffice. Suppose a man was arrested for bank robbery and at his arraignment was released on bail. A condition of his bail is that he not commit any crime. While awaiting trial, he robs a different bank in a separate jurisdiction and is arrested. The first court is not going to wait for his conviction on the second bank robbery, they’ll just revoke his bail and remand him into custody.

Trillions of dollars go missing every year with no consequences for the money being "missing". What you're talking about already goes on every year with no consequences to the person who stole the money. In fact, the government has found government employees who have Stolen $100,000 to $500,000 Tax dollars and the federal employees are not fired and are not prosecuted for embezzlement. The federal government simply asks the employee to give the money back.

Others have opined, and I tend to agree, that the judge is giving him as much leeway as he can to avoid the possibility of a mistrial or reason for appeal. The judge wants to get it right, although any other defendant would certainly be punished for the same antics.
I remain curious - if Trump is truly civic minded and truly believes that the President should have absolute immunity, why did he not take this matter to SCOTUS during his 1st Impeachment Trial or even argue it during that trial?

The crux of his argument is that if the president is not impeached and convicted by the Senate, he can't be indicted and convicted. Of course, the argument in his second impeachment was that since he was leaving office, he couldn't be impeached and prosecutors would have to indict him. The whole thing is flimsy and legally unsound

There would probably be multiple hearings and it would take a minimum of a week or two.
There would have to be evidentiary hearings, etc. It'll drag out however long it takes to protect Trump.

The prosecution should ask for the judge to be recused, since he can't enforce simple court orders, which are basics of what a judge has to be able to. He is making a mockery out of the American justice system.
