Dude, I live with a family of lawyers and I became one because I wanted to be close to the inventors as they invent or creators as they create. I don't need to do it for money at this rate, but to defend creation. Like my grandfather and cousins (lots of patent lawyers) do. I've seen their cases, they defend products and also warn creators for possible lawsuits

As disgusted as I am by the "patent troll" companies, I find more disturbing that our senators can be influenced by the lobby groups to vote a certain way, even when goes against our best interests. Patent "trolls" are named in the same way as internet trolls; it's not "under a bridge" trolls, but fishing. Trolling in fishing involves slowly dragging bait through the water and hoping something sees it and takes the bait. What patent trolls do is collect patents and hope something comes along they can hook.

Patents really help individual engineers like me. You can make something, patent it, and nobody can steal your idea and if your invention is baller you can go from formal wear to riches. But yes, the system if horrendously abused.

Part of this is also student loan reform - stop subsidizing lawyer education when there's already a surplus in the profession. Bored and unemployed lawyers looking to make a quick buck are at the core of the patent troll problem. Working with the ethics of lawyers so that clear abuse of the system is seen as professional misconduct rather than the expected method of business is a broader and thornier issue.

Having no patents whatsoever would be far better than the current system. You don't need patents anyway. Even patent lawyers will often admit that it is often a better business model to rely on trade secrets and private contracts which severely penalize anyone that shares those secrets.
How is it gonna prevent people from copying your idea after you put it on the market? Some products probably don't rely on the secrets as much.

You understood my question just fine. It's just that I find the system of yours hard to become reality, and that maybe I'm not understanding your thought on how to make it work. I don't think that the majority of the people are that competent to decide a company's future, and those who have no knowledge about companies that they don't care about, just might be the best puppets to manipulate by the elites. in other words, there must be someone taking charge of each industry, and those people are the perfect candidate of selfishness and corruption. I can't speak specifically since it's a broad discussion, but that's my thought so far.

There are some absurd cases where US companies simply patent a well known process from the EU and force the original inventor to pay if they want to market it in the US.

Mads Hummelshøj-Agerholm No, if a (EU) company is sued in the US for an alleged US patent infringement then the company has to defend itself in the US (or withdraw from the US market). There exist many "patents" in the US that could never be patented in Germany or the EU as they are simply too primitive or because there is prior art. In the US these issues are often dealt with in the court, when the patent is challenged. (I'm not a patent lawyer, and this expresses my best understanding of the situation)

I feel like patents should expire after like two years if the person who what filed it doesn't DO anything with it except sue. Like lets say you have a patent for, I dunno, tablecloth weights to prevent the damn things from billowing up when someone exhales. But you never actually MAKE any weights with it, you just sue every Wendy, Marion, and Darryl on Pintrest and Etsy who make tablecloth weights out of fishing gear and fimo clay. Your patent for the idea would expire after two years because you're not actually USING the patent to make anything except money.
But then you could game the system by producing like 1 product and "selling" it to a friend or something once every 2 years.

Thing is, though, "using it for something" is actually pretty vague, and correct me if I"m wrong, but vague wording tends to be terrible when it comes to law. It also tends to affect innocent bystanders. So this idea is a good idea, but needs some serious work to prevent it from being too vague.

I believe in that my home New Zealand, but definitely in several countries across the world, there is a system where patents do expire and then nobody owns them. I am 95% sure this is the case in your country. Doesn't stop the abuse of this sort of crap happening if it is, just keeps it to a smaller time period. As you saw though, half a trillion dollars since 1990... That's insane money

software patents are the worst thing in this industry, that exists. Adobe owns a patent on a god damn side ruler. As if nobody ever could come up with the idea of setting a value from 1-100 by moving a cursor along a line. Amazon owns the famous "One-Click" patent, which I never even understood what the fuck they patented in the first place. Others patent math. Yes, math. Software patents are a curse. They do not help anyone, but the ruin a lot of really nice things. I will not go to the "open source or death" lengths, paying for software is fine. Patenting rounded edges (looking at you apple) however, what the hell...

Parents are often used to prevent copy cats from undermining the market. If I have a design and expect it’s effective lifespan to be 3 years, I want that time period protected. It’s used in medicine all the time. Generics only come to Manet when the patent expires.

In Germany (and most probably several other countries) you have/had to prove a specific "Erfindungshöhe" (level of inventiveness) before you could file a patent. This means if it's something trivial everyone else could have come up with, you can't patent it. The problem with that is that the people who are deciding over such things are probably 90 years old and don't know anything about this modern thing called "software" (apart from their electric typewriters). So they let through anything trivial as long as it's described in a complicated manner. Because they don't know better. At least that's my theory.

Perhaps some viewers here just are not familiar with the concept, or the actual processes of successfully filing (and then defending) patents. I work in specialized materials, nanomaterials, alternative energy sector related development, and other specialized tech sectors. No laughing matter here . . . patent trolling has become a horrendously expensive threat to innovation and development. If you are not familiar, or don't understand the concept, PLEASE study this, carefully. Then offer your comments.

Reminder to lobby your congressperson about issues you care about, especially if a relevant bill is on the horizon. They're like untrained pets, they need your constant cajoling in order to do anything. Otherwise, they will just go for the shiny object and cave to corporate lobbyists, or else they'll just lie around and do nothing.
Wow. That is apt. I now imagine a video game that has you groom, feed and motivate congresspeople so they do good things in return. Harder difficulties have you fight lobbyists off while maintaining an adequate happiness and stress level. If happiness goes down, they go for the shiny. If stress goes up, they vote erratically. This could have serious depth now that I think about it. I wonder how close we'd come to simulating an actual government.

The problem with having to lobby so hard for your interests: more than half the reason you need to do it is that lobbyists on the opposite side of your argument, with a lot more money than you, have members of Congress in their pockets. Damn, it really sucks that Trump tainted the phrase “drain the swamp”, because that’s what we need: take out all the corrupt politicians and get rid of the lobbyists trying to push harmful corporate agendas, and replace them all with people who actually give a damn about building a better future for this country. With how bad things are now, I think the only way to have anything change is to effectively push the reset button by having the swap happen almost instantly.
