Lol so we lived just outside of richmond at the time this happened. Multiple people including my brother (i didn't have a car yet) started going out to watch over this flag pole to make sure no one from the HOA tried removing it durring the night. It had the whole city halfway to martial law.

I fought for our country and I personally know men who died for it. I'll be damned if anybody tells me I can't fly our flag.
I'll mention that there is one type of HOA that is usually fine and that's the ones for shared building structures. You're in a townhouse, duplex, condo, etc. where there are shared fees for the exterior building structure and grounds, you need a group that collects money from everyone and pays fees. This sort of HOA usually works reasonably well, though they can still get taken over by busybodies or scammers.

About a yeah and a half ago I left work early and got back to my neighborhood around 3:45am. I had been curios as to how many cars are in my hood. Which seemed like a lot. I live in a "U shaped" hood. So I walked around the block and counted 33 homes. Then I went around again "Counting cars," (pun intentional) 164 cars, trucks. Now I'm looking around and realize that the cars seemed to have doubled.

any street that has an address is 100% the responsibility of the county/city. what HOAs do is put one mail box at the front thats just a wall of small boxes and assign a letter and/or number to them connected a lot in the community, and the state only deals with the one address, those are not actual roadways and state/county/city laws dont apply to them, no seat belt required, no tags or insurnace, just like if you was in your yard doing fonuts you dont need any of those things as its private property, and so are the roads in a deed restricted community aka under a HOA. its considered communal private property, it can be used by anyone as its paid for by the HOA fees, aka you are part owner of the roads. in such cases only clearly posted signs apply, just like in a parking lot, unless there is a sign that says stop you dont have to, either on a post or painted on the asphalt itself... you dont even have too use blinkers, thats why the yellow fire lane is clearly marked... same with speed limits in both, if they dont post it the standard doesnt apply lol (here in fl its 25mph in a residential zone). also if you are not driving commercially you dont have to have registration or insurance or a DL, "driving in the private" is a con protected right as per the many won cases and the supreme court ruling... HOAs are evil communist camps, i dont feel bad for anyone who lives under one tho as they chose to live in a prison... they should be illegal and all the current ones should be shut downed and its boards fined for such a thing... also local laws do apply in most cases so what i said is what i know about central fl laws mostly. I have one in my front yard. Plus one folded nicely in my night stand next to my California flag. When I lived in Texas most people didn't appear to like the latter. Lol
They tried to start an HOA in my neighborhood. I told him if they did I will get violent.
Lived on a golf course once, never again! Ticketed by code enforcement for 1. Having my convertible under a car cover 2. Excessive yard debris (small sticks under a tree), having my 15 foot camper parked in my driveway (must be parked in back yard, which is in fact a golf course). Had to go to court in my uniform (state police) prior to going on duty at the post. Was told to fix these violations and not to reoffend within the next year
Ok here's a rare instance of an HOA that actually works. For 10+ years I've lived in a small quiet 32-unit townhome development near Lancaster, Pa. Just two short streets, woods all around us, one way in and out, no gate, no clubhouse, no playground, no pool or any other amenities that would need maintenance. Our dues include snow and mow, landscaping, tree trimming, exterior house cleaning, driveway sealing, exterior repairs when needed (new roofs two years ago, no add'l assessment), hang flags, plant flowers, grow your own garden, and park anywhere you like in whatever you like and can have more than two cars or trucks. The vast majority living here employ a live and let live attitude, and no complainers because there's really nothing to complain about. We're all invited to every board meeting and mostly those are to review the budgets and ask questions. What can't we do? We are not allowed to change anything on the exterior of our structures, such as the color or style of doors, we can't stain our decks any color we want (deck maintenance not included in the dues), no visible sat dishes, no solar panels (not yet, anyway), no noise that would keep people awake at night, pets are fine but no cows or chickens, and if more than 20% of the units are rented out then you cannot sublet yours. Of course you can do whatever you like on the inside as long as the structural integrity remains intact. All of that for the hefty sum of $175/month.

After Graduating college, my brand new wife of 34 years now and I bought a house in a subdivision with a hoa that wouldn't allow me to have my company trucks parked in my own garage over night. Anything with a dot and icc # was off limits, and the realtor didn't say anything about how bad those people were. We no sooner closed before putting it right back on the market, and we bought a 54 acre farm to rais our son and daughter up on. One of the smarter investments in my life, that we sold after both kids graduated from college.

I think the problem with people anymore is they lack the ability or imagination to be an individual. They find it easiest to glom onto the hater's mentality of "I can't improve myself so it's easier to trash everyone else to make me look better". They were trying to just apply a blanket ruling. No flags. While I don't agree with HOA decision. I would be upset if some loser was flying a confederate flag, next door to me, when I am trying to sell my house. The reason for the HOA. to handle it. Some HOA rules can be extreme. Important to get the rules, before you buy the house.

Absolutely NONE of this matters....He bought the property and knew there was a HOA involved, and was given a list of HOA rules that he needed to abide by, then signed the contract to purchase the property. He knowingly surrendered any right to make his house stand out from the other houses involved in the HOA.
You are correct, he did sign a contract. However, Barfoot had been raising and flying the American flag soon after moving in and no one had an issue with it until someone complained. Plus any HOA ordinance cannot supersede the constitution and flying the US fag is protected by the 1st amendment.
And he spoke out against what he saw being ill and / or gross, and the public opinion was on his side. It's the beautiful thing about being American. If you dont like something, speak up. It's crazy to me how fast some people are to just lick boots.
Actually, you are incorrect. COL Barfoot had been flying his flag for years. HOA made a new rule and the first the good COL knew of it was the letter in his mail box telling him to cease and desist. I was sitting in Iraq as a contractor when this went down, and even us Aussies on contract were ready to mount up with our U.S. Kin, fly in and remind that HOA of how screwed up they were. Luckily, it was handled before hundreds of thousands of veterans trampled the daisies in the HOA President's garden!

Hoas often come about because a bunch of Karens want to keep out the riff raff and keep their home prices up. Cities by definition can't be lazy, they are not a single person. They can just tax a bit more make more good paying jobs and get a pat on the back for it. The workers will also milk those hourly jobs as much as they can so it's kinda win win, except for the people hindered by the long wait times on the roads being fixed.
Cities can also work on a deficit and if it's an HOA in suburbs it's even better for them since they leach off of the bigger surrounding cities so they don't even need to raise taxes, they already operate on a huge deficit.
